    In case anyone sees this in the future...we had a K2 to follow on our application. We did not provide a birth certificate at the time of the K1 application or interview and it was not needed. It will be needed for the K2 actual interview.

    These are all great! It's exciting to see progress. I'm a May AOS filer and my status changed to this on July 11. I haven't been scheduled for an interview yet, but others from my month have. How quickly you are scheduled will depend entirely on your local field office. I live in an area with a long wait. So you won't be able to determine when you get your interview scheduled by others in the this group because they aren't in your same office. But you can keep an eye on the progress of the EAD/AP cards while you wait. We're also waiting on that to be processed (early May filer). Best of luck as you wait!

    The processing times for EAD/AP got updated, it's 3.5 months to 5.5 months now with the receipt date for March 12, 2019 as of today

    It seems that you are actually dealing with two problems. One, as you promptly identified, is the situation of the K1 visa once the arrest is disclosed. Let's assume, however, that the visa gets approved and your fiance is able to move to the US. Does he have a strong support network in the place where you are both planning to live? Friends, family? Are you both prepared for him to be unable to work, or to travel, or to gain a relative level of independence from you for several months? 
     
    The whole immigration process will go far beyond the K1 interview so it would be wise of you to have a serious conversation with your fiance when you feel less frustrated and disappointed. The AoS phase is not an easy one, and the challenges of adapting to a new culture and a new routine are tough even for those that do not have a problem with substance abuse. The fact that he turns violent when he overdrinks might pose a threat to your own wellbeing, so please don't overlook it. We tend to let emotions cloud our judgement because we are so anxious to have our beloved ones close to us, but in immigration we need to use reason. It's a long, tiring, expensive process, so make sure to consult with a specialist if you feel overwhelmed, and plan ahead (financially and emotionally) to avoid bad surprises in the future.

    I thought that the whole point of affidavit of support was to ensure that immigrants don’t become public charges. All they really need to do is to make sure that sponsors are legally compelled to support those they sponsored. If a wealthy individual decided to sponsor a poor spouse/parent/sibling from overseas for example, they shouldn’t be penalized just because the applicant is poor. The sponsor should just be made to carry the consequences of their decision - if the immigrant becomes a liability, then said immigrant becomes the burden of the sponsor and not the government. By barring the immigrant entry based on how much he or she makes, they are essentially punishing both and USC and the immigrant for an unforeseeable potential outcome.

    Okay. I understand the "not using public benefits"portion of all of this. I agree with that as it's our job as sponsors to take care of our beneficiaries. My fiance won't even receive his K1 visa until Oct/Nov and by the time we marry and apply for his green card, we may not get it, according to these new regulations. The credit checks and 250% over poverty level is too much. This excludes (and I'm sure on purpose) those coming here from poorer countries, who also have lower income families that are supporting them. I make enough to support both of us until he can start working legally but not at 250%! This reeks of not only racism but of class-ism as well.

    I get more annoyed that they are attempting to take people away from a fee based service that is paid by citizens to do a job that is paid by tax money. Go find other government employees that are paid by tax dollars to help. There should be some type of accounting/audit rules that should prevent them from mixing like that, unless they say that the fees only cover a portion of the employees salaries, and the rest is covered by taxes. Grr. But I think I also read that it didn't end up happening.

Not too long ago it said 6-8 months. I'm so excited because we are definitely in that window of time! Come on USCIS, bring on the work authorizations!!!

    Congratulations on your engagement! You're right, it's relatively straight-forward, yet long, process if you don't need to file any waivers. I would encourage you to check out the K1 guide here on VJ and it's example forms. You can also use the search function if you have any specific questions.
     
    It looks like you are missing the signed intent to marry. You each need to write a letter basically stating that you intend to marry the other person within 90 day of their arrival to the USA. There is a suggested letter on the K1 visa guide. You don't need written statements from you and your fiance about meeting in the past two years. You would just need to adequately answer the question about it in the I-129f form. I believe it's question 54.
     
    By any chance did you happen to meet online? If so, to avoid an RFE later in the process, it would be wise to print the website's terms of service to prove that it isn't an International Marriage Broker.
     
    1. No, at this stage you don't need to include your fiance's birth certificate. She will need to have it at the interview stage.

    3. She would need to sign the letter of intent to marry. Yes, that is perfectly acceptable to print the photo here and write her name on the back.

    Hi All,
     
    Noticed that NBC processing time for "Based on a pending I-485 adjustment application [(c)(9)]" changed.
    It was 6.5 - 8.5 months  but now it reduced to 2.5-5 months.
     
    Great news for all who are waiting for AOS EAD.

    Wow these are awesome news!! I am honestly ready to wait longer for my greencard as long as I receive my EAD so I could get a drivers license and start looking for a job! 
    I am also among those people who haven't received their biometrics appointment yet... I hope this wont be an issue and wont prolong the process of getting an EAD!

    If you have your AOS interview and are approved for your Green Card before you receive your EAD/AP, then your EAD/AP applications are canceled (because the GC confers these benefits on you anyways).  
     
    If you receive your EAD/AP before your AOS interview, then you continue waiting for your AOS interview, have it, and subsequently get your GC.  
     
    The vast majority of May 2019 applicants are still waiting for EAD/AP and GC interviews.  The processing time for EAD/AP until was 6-8 months until yesterday, when it was randomly scaled all the way back to 2.5-5 months (putting beginning of March able to submit an inquiry).  Follow that date as it moves, and if you don't have your EAD/AP prior to when the inquiry date passes your NOA1 date, submit one.  
     
    You can also check how long it might take to get your interview based on your field office.
