The problem is, this doesnt work for all or even many government sections.  My husband's job cannot be performance based, for example.  It is safety based and sometimes that takes longer.

And this is why Trump just nixed a "cross the board" pay raise for every and all government employees (millions of them?)  He wants to go with a merit based system, which is good.  When you get the exact same pay as an under performer, then there is no incentive to do your best to excel in your job to work up the ladder.

Yeah I edited my first post cause I saw you are K1. Best to prepare for an interview. Aos interviews for K1 are increasing. I wouldn't be too surprised if at some point, they make them mandatory.

I personally find it odd that OP is asking such questions, it never occurred to me to worry on any of my B visa trips.

I paid like $49 for a DIY package, and did not use it.  The some of the forms in the downloaded package were outdated.  Had I gone ahead and filed those forms, they would have sent the whole thing back. When I asked for a refund due to outdated forms, they just said they were the correct forms and no refunds.  I did it myself, and joined VisaJourney.   There are many links to things here, and plenty of good people to guide you when needed. Good luck!

If you don’t know what AOS is you should educate yourself on immigration process before going any further. A simple google search on this website and on USCIS website will give you all the information you need. You should have researched all of this before even applying.

She gets here.  you both go to the local court house clerk, show ID's like passports, etc, and both sign and pay your fees for the license.   Then, if getting married in the court by a judge, you make the appointment,  show up with 2 legal witnesses, get married ,  and you are on your way!  Come back in a couple days and collect the one and only original certificate of marriage.

This is not a DIY.  You get anything wrong and the entire thing is unenforceable.  For example, in California, generally both parties have to be represented by separate lawyers.  If the weaker party is not represented by a separate lawyer, then the prenup can be attacked.

If you have assets to protect, then don't be cheap.  The cheap gets expensive if you don't know what you're doing.

Older SS numbers where issued with geographically significant numbers.   To make it harder for ID thieves they started issuing them randomly and  that messed up some verification tools/

If she cleaned out the bank account,  and it is a JOINT account, it's not "your" money but yours and hers.  However, depending on which state you live in,  some states it's joint assets and she is only entitled to 1/2 of it all.  If you file for divorce, and with an attorney to do discovery,  you could do enough to be a pain her her neck.   If all the money was a couple hundred bucks, move on.  Just know that whomever she is with now may well be the next cheated on guy.

So, the situation sucks, and I guess from everyone's comments,  once someone has a GC, the petitioner is off the hook for financial support?  What happens if she, shortly down the road, becomes a "charge",, will the petitioner still be at fault due to the oath they took to support the beneficiary?  Does divorce stop that action?

No, the petitioner is still "hooked" until the immigrant has worked for 40 quarters, becomes a citizen, leaves the country to live, or dies......

assuming the petitioner is the sponsor, of course.

If you have all the required documents and evidence the interview is very easy.  They will ask questions about you and your husband, mostly about your husband (things you should easily know).   During the interview, smile and look the CO directly in the eyes when speaking.    Actual interview is 3-5 minutes.      Relax and smile!

The checklist for the immigrant visa, follow STEP 1-4, with STEP 5 ... read through it, have everything listed there.

Perhaps some companies view you as "over qualified" and would not stay on that job but only until something better comes along.  I don't know what your 10 yrs of exp is for, but you may want to think about scaling back the resume to fit each job you apply for.  I've been there, done that in jobs.

At some point, perhaps during her interview process,  The may look at how well the couple can converse and communicate.  And as others say,  they look at your "gross income".  It is a long process, months and months, and a LOT of money for the K1,  help with her expenses for travel to get her physical, the childs physical,  visas, interviews,  etc.. Then, the wedding,  then filing for things like Advance parole,  Green card,  EAD,  etc.. A long road.    As for work,   I don't know about how it is in Min,  but in places where there are casinos, (Nevada),  most have housekeeping staff who do not speak a lick of English.  Good luck on your journey, and keep in mind,  BE TRUTHFUL in any forms you complete for the K1.  You may also look in to the CR1 which takes a bit longer but half the price.   You go down there, get married, and file to bring your wife and child back.  In the meantime, work to get your bills down, etc..

A green card is for living in the US.  It's not for visiting the US.

You don't have to stay in the US.  You could leave anytime you want.  Failure to live in the US and take up residency in your home country can be deemed an abandonment of your green card.

You want a green card and you want to live in your home country.  The two is incompatible.   Pick having a green card and live in the US or give up your green card to live in your home country.
