    AOS = Adjustment of Status
     
    EAD/AP (work- and travel permit) currently take 5-7 months right now.
    Green Card depends on your local office, and can take anywhere from 3 months to 1+ years.
     
    Please educate yourself on this process. Knowledge is key. Without proper knowledge you can bump into RFE's, unpleasant surprises down the road and even denials.

    And as other said, without proper income there's no chance your fiancé will get a visa. You need to be able to proof at least 6 months of stable 125% poverty line income (K1 requires 100%, but for AOS you need 125% and some IO's at the embassy won't give out the visa if you make only 100%), so get a stable job and find a co-sponsor, just in case you need one.
     
    Keep in mind, barely making the 125% is no guarantee that a visa will be granted or AOS will be accepted. Many, many stories on VJ where people barely made the 125% and were required to get a co-sponsor.

    @craig21123  Your last thread was Jan 22nd where you stated you were set to depart on Jan 9th but found out she was pregnant. Members outlined the 2 possible paths- K or CR. You repeatedly stated you did not overstay- so I am assuming you left the US and have since returned under ESTA. Because you were very aware of the 2 paths on Jan 22nd it is very hard to believe you returned on ESTA in late March and it was not your intention to bypass the 129f or 130 process. 
     
    Visajourney has a very strict policy on fraud and assisting with fraud. Before I ask for the thread to be closed accordingly I am going to wait for you to respond and perhaps clarify things, however I dont really see anyway you can justify coming back on ESTA to marry and stay- which it seems you are doing. Correct me if Im wrong.

    I always used to travel to the US with 1 checked bag, 1 carry on and 1 personal item, and I always stayed for 2-3 weeks at a time before I moved here. Never had any trouble. 
    If she would arrive with say 3 suitcases than yeah, she could run into some trouble

    You or your friend or whoever this story is really about is toast. K1 visa was obtained with misinformation, therefore everything obtained after that (green card, citizenship) is obtained with misinformation aka lying. This will (most likely) result in revoking whatever was obtained (and probably a ban to the US) If the person is a USC by birth there (probably) will be other consequences. 
     
    He/she/you has to disclose the K1 visa on the new visa application and they will find out. Not disclosing it is lying. So no matter how you twist or turn it, it's not going to work.

    There's at least 5-10 other topics with this exact question created in the last few weeks. I would advise you to use the search field (right upper corner of the site) to find all those topics.
     
    As long as you filed for AOS within 1 year of your medical AND your medical was marked complete (check your DS-3025) you don't need a new medical. If one of these is not the case, you'll have to get a new medical done.
     
    USCIS sends out a standard letter to everyone. It should also state to bring a new medical unless already submitted

    Than you wouldn't need a lawyer, but in the end you've gotta do whatever makes you feel most comfortable. The last thing you want is adding more stress to this process.
     
    My now husband and I (came here on K1) filed K1 and AOS ourselves (we had a pretty straight forward case), but I've seen tons of people on here that have some kind of record and they still DYI and get approved. So no, you don't NEED a lawyer.

    The embassy can extend your NOA2 for up to 12 months. What's the 'expiration date' on your new NOA2? If your case isn't at the embassy on time, they're not going to cancel it, they'll just extend it (the embassy). 
    If you have your NVC case number already and your new NOA2 is close to expiration, you can email your embassy to inform them so they can extend. If not, no biggie. In that case it usually automatically gets extended.

    Did you call m? $680 is the right amount ($595 + $85 biometrics fee that you have to pay, regardless if you actually have to do biometrics again or not)
     
    If I were you I would call before you refile (just to explain the situation and so there's a note in the system that you called for info before refiling), than refile with the $680 check (1 check) and put on your cover letter what the amount is for + a print of the USCIS website where it clearly states the amounts (highlight the amounts if needed, that way they have absolutely no way of telling you you're wrong)

    Damn, this sucks, sorry you have to go through this. Did you get an info pass appointment at your local office to get another I-151 stamp? That would serve as another 1 year GC (or if the 2yr GC expires before that, it would be good until that date) At this point you could also try to reach out to your local senator / congressman.

    I wonder, if USCIS finds out the Canadian visa was just obtained to get out of India (no intent to obtain a degree in Canada) won't it have an impact on the US visa? I mean, if she's willing to commit fraud there, what would stop a person to do anything against the law here? Anyone?
     
    OP, if it can have an impact (I'm waiting for other people who prob will know this better, I might be way off) I would seriously reconsider moving her to Canada. USCIS frowns big upon any kind of fraud in any country, and they should since immigrating is a privilege, not a right.

    So within 1 1/2 months you talked, visited, and married? In any country that's a red flag, especially with a previous petition from family and being arranged by the family to marry her.
     
    I mean, spend a lot of money now on a quick marriage and get her into the US within 1-2 years, or wait 15+ years through the sibling category...  that's how the CO sees it. 
     
    We aren't saying it's a sham marriage, but definitely raises eyebrows.
     
     
    And a lawyer has no authority or power over an embassy. So that in a sense is just wasting money.

    How long did you know her? Did you get married after you first met? And if not, how much time did you spend in total together before you got married?
     
    It sucks, but I do agree with others that the timeline could raise red flags to the IO. She couldn't come to the US through her sister (or it would've taken 15+ years), and right after she gets married. Not saying your marriage is fake in any way, just looking through the eyes of the IO.
     
    Is there any way for you to move to India for now? You could live there for a few years and then petition for an IR1 visa. When they see you've been married an living together for a good amount of time, the red flags will probably go done by a lot.

    You'll have to wait for his/her EAD to come in. This is what I pulled from the CA DMV website:
     
    4. Which documents do I need to apply for a REAL ID?
    To apply for a REAL ID driver license or identification card, you must visit a DMV field office and provide:
    Proof of identity, such as an original or certified copy of a U.S. birth certificate, U.S. passport, employment authorization, permanent resident card or unexpired foreign passport with valid U.S. visa and approved I-94 form. No photocopies will be accepted. Proof of Social Security number, such as an SSN card, W-2 or paystub with full SSN. Original or certified copies are required. No photocopies will be accepted. Beginning April 2019, two different California residency documents, such as a utility bill, rental agreement, mortgage statement or medical document. Photocopies accepted.

    No one can tell you. Once you go into AP it could take days, weeks, months or years. All depends on how busy the consulate/embassy is, how fast all the checks go trough, the outcome of the checks etc. The fact that they did ask her passport back is a good sign. So yeah, sit back and just wait.

    Your fiancé will need a police report from every country (s)he lived in more than 6 months since turning 16 (just to show that there's no criminal record OR if you have one you should bring all court documents etc), but usually the embassy requires it not to be older than x amount of time, so don't rush into that.
     
    Since you're still waiting for NOA2, I wouldn't spend too much time on this yet. Once you get your NOA2 you have at least another 2-3+ months before the interview (NVC usually takes a few weeks, and than it usually takes a few weeks to plan the interview), so you'll have more than enough time to gather everything you need.
     
    I know the American consulate in the Netherlands sends a checklist with everything you need to bring to the interview, I would assume London would do something similar. So for now, just slowly gather some extra proof of relationship and get the rest done once you're actually closer to the interview.
