I wish more people who have filed one would come back to VJ for updates.   There was one on a facebook group I was in for the ds5535 who was from Morroco who had filed one after a year and he received his visa.  It was with Hacking Law she then got really salesman like about the lawyer which was either because of her outcome or.... something else but it started to annoy other members and became less beneficial for those looking into it.

There are also  few advocates here on VJ who have not even filed one but will point you to an attorney that can help.

If I saw more success stories I may attempt it but at this time I'd rather spend the money to see my husband.  In addition one attorney I talked to told me WOM's filed through USCIS are more successful but through the embassy they are rare because consular working overseas can be afforded protection against lawsuits under the doctrine of consular non-review ability, which is akin to diplomatic immunity.

Our ds260 was filled out in 2017 and it still has never reopened for us to update.   Even after a second interview they only requested the ds5535.   Our ds260 has still been untouched.

    Anyone have any updates?

Our case updated again today (just the date) on its own for the first time since July 25th.  We are so hopeful every time this happens...fingers crossed we hear something soon.

I was thinking because they had me send in a ds5535 they did not need the ds260 updated at that time but we will see in October if it updates then since it will be one year after my second interview.
Yes it is very disappointing seeing the same date day after day.  When it finally changes it puts us in temporary good mood.  lol

It would be he same answer you were given when you asked this same question just a few weeks ago.   You are only in stage 1 and are opening yourself up for agony if your patience has run out already.

Coming from Pakistan this process can take years!  I filed for my husband in February of 2017...we are STILL waiting....

Yes after a year of AP others have had the same status.  Contact the embassy and let them know the status and the ds260 reopening.  Let them tell you if they need you to update it.  They will change the status back to AP.

If you are already frustrated now you have a long road.  You would not hear something only 3 months after the NOA1.  Depending on the service center you can be waiting about a year.   Like above mentioned it then goes to NVC and will be there another two months or more.  Once at the US Embassy of Islamabad you will wait a few more months for the interview then.... you have a high chance of being stuck in Administrative Processing H.E. double hockey sticks where you can be prepared to wait an additional year or more.

This process is not quick or easy you need to get your mind in the right place to be prepared for what lies ahead.

When responding to a NOIR you must give them evidence in response to the points in the letter that you already have.   You must prove that the embassy was mistaken or misunderstood or that something is incorrect.   Joint lease is one of the pieces of evidence listed on every NOIR and USCIS website as evidence (second page but not one of the points) but would not have even been needed to prove the case as the beneficiary does not live in USA.   For evidence of bonafide  relationship that is long distance visits and consistent communication is most important.   The only affidavits that may have helped the situation could have been from the family that could not attend given a valid reason as to why they could not.

Unfortunetly OP I think refiling is your best option instead of  attempting to appeal with evidence you don't have.  Have more visits and work with your LIFE PARTNER on how you can overcome the red flags.  You'll need to be sure to be completely confident before your next interview to be able to answer some of the questions they have with your relationship.  If you both are truly in this you'll get through.

Some of the OP's "evidence" looks contrived.  Always concentrate on quality of evidence over quantity of evidence.........and in a long distance marriage, evidence of time actually spent together is very important.

EDIT:  Example of evidence which could be seen a contrived:  An unsigned rental agreement which lists a person non even in the US..

If you have no ban then they may only question the history and may have no impact.

I would add K-1 visa's can difficult to get at this embassy.  It may work better in your favor if you spend more time with your fiance,  plan a wedding and apply after marriage (cr1).
