    Actually - we DO know he was arrested and convicted of assault.  He caused bodily harm, was fined, and kicked out of university. It was because of this violent assault the US denied him a visa to visit the US.   Instead of learning from his mistakes - he verbally assaults people online every day.  Clearly he has anger issues and I hope USCIS rejects his application and waiver to come.

    There is no V number. But there is an A number. Regardless, you have your case number, ID, and appointment. You are good to go.
     
    I have a question... is the person that told you you needed a V number the same that told you you can get the visa issued the same day as the interview? Because if it is, then I would refrain from getting further advice from them. I know people are trying to help but you keep getting misinformation.

    Of course the US government feels this way.  Why else would applicants at certain high-abuse and fraud consulates receive much greater scrutiny and denials than those from low fraud countries?  Why is there a VWP?

    It's not an argument from here. It literally IS the reason. It's not just AOS due to marriage right away... that's just a small portion of people who abuse B2 visas. That's why it is overall "immigrant intent". The existence of a US fiance certainly doesn't help matters but isn't the only reason. 
     
    The "how it should be" arguments are fairly useless when discussing how and why things actually are.
     
    But, going there, I can see the case for doing away with AOS entirely (and then everyone needs to marry first-- could have a "marriage visit visa" like in the UK for folks who can't marry abroad-- but it's just to come, marry, and leave and wait for spouse visa) just as easily as I can see why AOS exists (the wait times for any sort of interview abroad would skyrocket and families/couples would be separated for years for no reason other than "some people abuse the system"). I personally don't think it would be worth it-- far easier to allow the H1Bs and students etc who just happened to find love in the 4-5 years they were in the US to just stay and adjust here. The B2s, clearly, are a different story, but the end result on that is that all of the B2 over-stayers who are here now (and let's not pretend that there's not a lot) who are *otherwise* law abiding, who have established lives and families etc AND who would be facing a 10 year bar for their overstay.... the first thing that would do would disincentivize "getting legal" and would fairly dramatically burden the system and destablize families etc.
     
    I'm not exactly a fan of people who took this shortcut and got away with it, but I also don't see how anyone winds up better off making it impossible for them to get their papers in order. Maybe some people feel better off, or vindicated, or it feels "fair". But looking at the outcomes, I don't think it's worth it. I realize that other people prefer a more black and while, punishment focused approach, and I'm not sure that that's a difference that will ever be solved online, and certainly not at Visajourney. 
     
    While we're talking about how it should/could be.... I would like to see is AOS from certainly B2s but maybe other non-immigrant visas (or within, say, 2 years of getting that non-immigrant visa) to cost like $5,000. That way, if it is your goal to make an end-run around the K1 because you don't feel like being separated, ok, great go right ahead and pay for it. Guaranteed AOS interview. Maybe higher relationship proof standards. Heck, add another 5 years wait time for naturalization, or make AOS from a B2 something that disqualifies you for naturalization if you really want to act as a deterrent. And for those who are long ago overstayers whose lives would blow up... I'm sure they'd be more than happy to pay that sum to get legal. The additional fees could possibly help speed things across the board.

    It might not matter come a couple more weeks after mid-term elections. if Republicans gains more of a foothold in Congress the diversity lottery will be the first to be eliminated. You can also count on chain migration to be eliminated. Good luck though, I would file ASAP like thousands of others, and hope for the best.

    It's not rationale. It is US law, and yes, all of our fiances and spouses are subject to it the same as the next guy. It may not feel "fair" but.... well, it is. You're just not used to being restricted in this way (most Americans aren't) and for some people the first time can be a real slap in the face. 
     
    Where's the negativity and complaints in any of these responses? I personally found them all collaborative and sharing of experience and knowledge and perhaps providing a bit of perspective.  People sharing their own experiences and relaying experiences of others may be "negative" but that's because they're discussing being denied a B2 visa, and for the most part they're either commiserating with you or providing some (much needed) perspective. The only complaining I saw was in your posts.

    Of course.  You can get married anywhere you want to, and the visa will be the same:  CR-1.  Guides and forums for this abound here on VJ.

    Is it your daughter's K-1, or yours?  Is your daughter flying as an unaccompanied minor?  Are you already in the US with your fiancé, or are you traveling together?  Your post does not really make sense.
     
    Depending on where in the US your final destination is, you could fly into Canada, and then come across the border and activate the K-1 together.  That is what my husband (then fiance) and I did, but only because Air NZ flies directly to Vancouver and not Seattle.  It worked out very well for us - no problems at all.

    Zero visits in Nigeria? Or zero in-person visits (anywhere)?
    If the former, visits anywhere are counted fine...visits don't need to be to the beneficairy's country.
    If the latter, then the only way would have been a fiance visa with a meeting waiver, which is extraordinarily rare.

    Sorry to hear about the denial, but that is quite common.
    A tourist visa requires non-immigrant intent by law. A K-1 visa means she plans to immigrate in the "near' future.. See the inherit contradiction ? It's very, very difficult to overcome that.
    The way one shows non-immigrant intent is via strong ties to their country of residence. Your fiancee plans to abandon any such ties she has soon (and has a strong tie to the US - you). That leaves very little for the CO to go on to overcome the immigrant intent presumption as required by law.
    Edit: The other thing is the risk that she will just bypass the K-1 entirely, marry in the US, and then AOS that way.
     
    I hope you hear back on the I-129F soon, and process the K-1 quickly.
    The I-129F will be reviewed and the vast majority are approved...it just takes time.

    For us here in Western Washington, our power outages are generally related to the strong windstorms we have every Fall.  Windstorms + power lines + dense conifer forests = power outages.  We have 8 x 100 ft Douglas Firs in our front yard, and every November I silently ask them not to fall down!

    Is she from WA? I don’t know how long she has been out of the country but the weather here in WA is very similar to Northern Europe, in particular maritime areas such the British isles and the North Sea coastal countries. Maybe she’s forgotten what it’s like here or she’s hoping to move to Arizona. 
     
    Since youve bern married for more than 2 years it’ll be an IR-1 unless you obtained citizenship whilst in the USA previously? It’ll take about a year for the whole process but your wife will need to demonstrate her intent to re-establish domicile in the USA. I assume she has been filing federal tax returns whilst living in the Netherlands?

    As mentioned, Manila embassy generally doesn't ask for the I-134... but, you always go prepared... they may not ask for it again, or they may... think a lot is determined by the information they view in the original I-129f petition, which includes work history of the last five years.... it's 50/50 whether they will ask; but also consider, if not meeting the poverty guideline, how can one support someone else? Not to be rude or offensive... but even $30,000 a year in most places is hardly enough to live. So if not even at the $22,000 or whatever it is exactly amount, that's really stretching it.. there are a lot of other expenses besides rent and food.... what about cell phone bills, car insurance, car payments, down payment on a car, ect.... this all adds up really quickly... that doesn't even include date nights, dinners, movies, ect...

    Preconceived intent to stay in the US and/or file I-485 is 100% illegal. What is legal with ESTA is marriage in the US, you leave the US, and then your new spouse files the I-130.
