    1.  Your wife can not be deported for working under the table.  Illegal work is ignored for the spouse of a USC.

    2.  BS on having any attorney on retainer.

    3.  I wouldn't give this lady any personal information; especially SSN.  The chances for identity fraud and opening financial accounts are high.

    4.  Let it go.  No one has clean hands.  Your wife was working illegally.  This lady took advantage of that.  Just let it go and ignore her.  Is $1500 worth more BS?

Well there is a huge winter storm traveling through the US as you probably know so it might take a little longer 😉 don't worry about it. They always show in transit when there are no new updates cause it is still on it's way. It will get to Chicago eventually.

I'm assuming you sent the package by priority mail which normally takes up to 3 business days for delivery but it is not guaranteed.  Since you sent it out on Feb 11, it will not be transferred from your local post office until around 7pm so you can't count that as a business day.  So the first business day is Friday.  Monday was a national holiday so that does not count as a business day.   So your package should arrive today, not yesterday.   However, not only is USPS short staffed because of the pandemic, there is also some really bad weather which is causing additional delays.   Delays are to be expected.  Please be a little more patient.

I sent a priority mail package to be delivered 20 miles from my home.  It was supposed to take 1 business day due to the close location.  It was delivered on the 3rd business day.

I think O1 is about the only visa (L not applicable here) that can get anyone here relatively quickly. From the people I know on Os, sounds like a long shot but agree worth a try if OP has some cash to spend on the attempt.

Sure, if you’re good enough. I’m guessing celebrity bakers would qualify easily, cake boss type. Zumbo is an Australian one, great British bake off types, etc. Depends how specialty you are. I’m fairly sure a top restaurant type pastry chef etc would be able to swing it too. If you’re not specialty I don’t even know that EB3 would work because I’m pretty sure that there isn’t a nationwide shortage of bakers. Especially now.

In a previous thread from December where they ask about the possibility of marrying on ESTA and returning, they mentioned “We have been dating for a while, but of course have not seen each other for what feels like forever due to the pandemic” which to me sounds like they are at least implying they met once, but who knows!

I’m a little confused, have you met this individual in person at all yet? In your thread from December, you mention a partner that you have been dating a while but you haven’t seen in what feels like forever due to Covid. Was the meeting just over two years ago?

If you haven’t met at all yet, you should definitely fix that. Not just because Covid will not be an acceptable reason for hardship waiver. The UK is a low fraud country, but having a past marriage and spousal visa filing that fell apart, I’d imagine it would be wise to be able to show you have met and know this person well.

SunflowerSweet reacted to Punisher in Could I marry my USC spouse on an ESTA?
Your reply above was to the very first OP question (before she even elaborated on her situation) therefore I just want to address that before someone draws wrong "general" conclusions from your answer.

Is it legal? Legal in what sense? You must be unfamiliar with the so called "90 day rule". (used to be 30 or 60 long time ago).

Can you marry? sure. But immigration wise you are breaking the rules (purpose) under which you entered US in the first place.

It is one thing to enter US, stay over 90 days (even if it means overstay) then marry and do AOS, one way or another. It is completely different to do it within first 90 day timeframe though.

It will be extremely hard to convince AO that you entered w/o intention to marry (only business or pleasure) but the marriage "just happened" within 90 days. That's not what "normal" people do and I'm sure AO would look at that as well (subject to specific countries as well).

Now, in that particular case, OP explained later that she has been dating this guy and are separated due to covid/proclamations etc, therefore she does have a good explanation (if backed with proper documentation) for AO. Notwithstanding that, everyone else thinking of breaking 90 day rule should understand possible ramifications. "Possible" because in some countries (especially Western) AO's are more lenient.
