Sunnyland got a reaction from Cyberfx1024 in K1 with a refugee
The OP posted the same question a month ago. Hopefully someone in similar situation can provide some advise.

OP,  did your fiance return to Gambia like you mentioned in your September thread?

Slight damage is not a problem.  If the side is ripped open allowing documents to be removed, that would be an issue.......imo

Agreed. If the damage would make one wonder if the contents were potentially tampered with, then it's an issue.
Embassy should allow you to send it back to be resealed.
The corner cut is normal (for immigration / customs to see it's only documents inside).

We had our AOS interview last week, adjusting from a  K-1. While I don't think that in itself decreases scrutiny, the IO said she reviewed what we sent already. We were in and out in 5 min with an approval, and that's with us chatting about her kids' drawings on the walls for a minute + asking questions of the IO for another minute. The actual interview was just a couple minutes. It was very pleasant. I can't imagine most people doing AOS from other visa types having such a smooth ride unless they were together long enough within the US to have a good chunk of evidence to submit beforehand.

The point is that we had a decent chunk of evidence to submit beforehand + was already scrutinized by a CO. Doing AOS from other visa types may not offer quite as many opportunities (without overstay, or being on a visa that permits temporary residency).

This is one thing that concerns me so bad.  I realize the sacrifice Rose will make.  She has previously lived in Ireland with her ex husband and left her kids in the Philippines.  I know she is strong but it will be tough.  I also worry about the kids.  They are 15 and 18 and they are leaving the only home they have ever known.  They are leaving all of their friends and their family.  I love them so much that I don't want them to feel that pain.  We have spoken about it and they have decided that they want a new life with a new family.  That humbles and scares me a bit.  There is a lot of talk of the beneficiaries feelings and that is very understandable.  They are moving halfway around the earth to a strange land with no friends.  I don't think I am the only petitioner who is humbled by that commitment and I want so badly to make it as easy on them as possible.

If OP's girlfriend has $500,000 in assets she most likely owes the IRS some back taxes, that is if she in fact has been a US citizen her whole life, which seems likely.  Once the US citizenship question has been determined, check with the IRS to be sure about back taxes.  I have a dual US/Canadian citizen brother who lives in Canada who has not moved to the US because of the back taxes problem.

your wife HAS to sponsor you. She could ALSO find a co sponsor if income was an issue but SHE has to sponsor you.

    or you leave.

    those are the options.

And she should have known this was coming for a VERY long time. Something is going on. What that is, i dont know, but this is not new news, this is not unexpected, and there is no work around. I cant IMAGINE telling  my husband (once we reach AOS stage) that ' yeah ... this is a big deal. sorry i cant do it'.

unless i was wanting out of the marriage.

OP. Your post seems a little confusing. When you create your VJ timeline you have to type in your information, the system obviously does not do it automatically. If you left the consulate field blank (Armenia as default) then that does not mean you will be interviewed there. Seriously?
Btw, why would you need a lawyer to create a profile on VJ? This is an online DIY immigration forum that has nothing to do with any US embassy in the world.

Better listen to the lawyer at this point.
clearly a violation of the law and He should have known as said above
i know when you open any business there is a mountain of paperwork you have to know the rules and laws /  this is part of owning a business and being responsible as the business owner.
having a good accountant,  a lawyer known for business law (as no way could anyone read the piles of mail that u get upon opening a business) is necessary.
let us know how you make out with this please as many here have small businesses like small grocery stores, convenient stores and resturants.
    good luck

follow the instructions when they return it to you. the directions are VERY clear as to where it should be sent. Given this error, I would go over your petition AND the instructions with a fine tooth comb before you resubmit it.

This is true.  In my case, both biological parents have allowed me power of attorney to make emergency medical decisions for the kids if they are not available.  I trust them and they trust me.  It was done by legal consul.  I don't want to adopt AJ because he is the last of his father's bloodline.  Aira wants me to adopt her.  We will decide that later when we are all together.

Like others said, only US citizens are guaranteed entry. A few years ago I used my AP to travel to my home country and after 2 months abroad, at my POE I was sent to secondary inspection. The officer inspecting me allowed me re-entry but gave me a hard time just for being in my home country for 2 months visiting my family. And then or now I don't have any criminal records, not even a speeding ticket.
Thanks God now I'm a US citizen and I won't have to worry about this kind of travel issues on my return.

Fortunately, I have income on a regular basis from investments, and the company I used to work for have a great inexpensive medical and have said they would look into myself or even both of us a part-time position.  Enough hours to get medical.  Also Costco have Medical Plans at really good rates.  I have used them previously.  I earn enough from that cover the amounts they are talking about being minimum.  While out of the USA I/we don't pay USA taxes, because I am out for more than 330 days per year.  South Africa have extremely high taxes as does Nigeria, so we are used to paying.

Another thing to think about - and something that is often glossed-over...

If you are SURE that you want to live out the rest of your life in the US, then get married and go through the green card process.  But...if for ANY reason, you think you may NOT end your days in the US, you will want to think long and hard about the tax consequences of his becoming a US citizen or LPR.  The US is one of 3 countries in the world that taxes citizens and LPRs on WORLD-WIDE income (Eritrea and China are the other two, but China does not enforce the rule).  That means ANY monies - whether earned income, investment income, interest income, inheritance, etc., are subject to US tax consideration.

Many retirees don't think about this.  We are both retired (in our 60s). Our case is that I am the USC and my spouse is an Australian, and just got her US Citizenship.  In Australia, the saving-for-retirement system is tax-free in Australia when you withdraw the money after you are retired.  But the US sees that as money that is taxed - and it will do so.  This is causing US/Oz couples much stress at the moment, and many US persons are actively renouncing their US citizenship if they intend to live out their days in Australia.

So take a breath for a moment, and make sure the two of you want to live in the US, knowing that any overseas income will be taxed.  Depending on your professions, this could be a killer.

    1.  Only your spouse will interview.
    2.  Your husband (or fiance) can not come to the US via a tourist visa with the intent to stay.  That is visa fraud.  However, he can come to the US and visit during the spousal visa process.  But he MUST leave the US prior to the expiration of his authorized stay.  Of course all non-immigrant entries into the US are at the discretion of the CBP officer upon his arrival.  Therefore, it is wise to bring evidence of his ties to his home country or country of residence.

BTW, my wife and I were 59 and 64, respectively, when we applied......good luck.

They understand that people that goes thru AOS from K1 don't have much evidence in the beginning.
For my AOS (long time ago) I remember all what we sent was a copy of the marriage certificate (we requested extra copies at the courthouse to have just in case) and a few recent pictures (wedding, family gathering etc).
If you are the beneficiary and already added to your spouse health insurance (or car insurance) then you can add that as extra evidence.
So do not worry about about having a lot of evidence at this point. but you will need to have more evidence by when you have the AOS interview (if you have an interview) and also when you do ROC 2 years later after AOS is approved.

Don't listen to those friends that will only freak you out. If you guys have no red flags (like big major age difference, previous petitions in the past, etc.) then you can do this yourself. This is a DIY website. If you have any questions on how to fill the forms, just follow the guide here on VJ or simply ask the forum.
