K1 AND COVID AS EXEMPTION

Hello! My fiance and I are applying for a K1 Visa. We are trying to find more information on if Covid is considered an exemption that falls under extreme circumstances for the requirement of having met, in-person, within the last 2 years.  As much as we would love to be together by now, this pandemic has made it impossible. Can you please advise me on the K1 process as it currently stands? Thank you

Americans can travel to the UK. There is the issue of quarantine on arrival. But it’s possible. 
 

You can’t leave the UK for now but your fiancé can visit you. 
 

Have you ever met in person?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Welcome to the forum.  Gentle correction:  You are planning to file the I-129F petition, which, if approved, would enable your beneficiary to apply for the K-1 visa.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The pandemic has not made seeing each other impossible....only inconvenient, in most cases.  The waiver would be denied, imo.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I was thinking about doing this to but it takes long to get approval. I had two flights canceled but I rebooked one in May . Just wait to be safe .

OP, the reason COVID is unlikely to be grounds for a waiver is the fact that it is a temporary situation. Borders will open again. Planes will fly again. People will be able to travel again. 

 

Waivers are granted for permanent situations where there is no possibility of it changing. The examples often quoted on here (and the only ones we have seen) were for a person who was completely unable to travel due to a permanent disability. I believe the person was paralysed or on permanent ventilation, something like that. The waiver was only granted after the foreign beneficiary had applied multiple times for a visitor visa for the US and was repeatedly denied (not because she had done anything wrong, she happened to be from a country where denials are routine for a single female with a boyfriend in the US). In other words, they had to demonstrate that they had tried to work around it and that the situation was permanent. Another one I recall was a deeply religious couple who were forbidden from seeing each other prior to marriage. 

 

I know it's a mess now. But it will end. I understand the urgency people feel. Especially those who want to get on with starting a family and so on. But the government will not grant a waiver for a temporary obstacle in the path to a K-1. 

 

For the health of your relationship it is also advisable to spend as much time together in person. That's just common sense. You want to know what this person is like beyond the sweet messages and video chats. It takes time to get to know someone well enough to commit to marriage.

The other reason is that virtually everyone in the world is affected by this. If they waive for covid they are effectively waiving the meeting requirement entirely for everyone. Unlikely they'd want to do that.
