Why would you try to enroll on Medicaid when you have insurance?

As a secondary insurance. To cover some cost. But if its risky then I would not take that risk. I heard some people did it since its not a long term assistance only during pregnancy. But may not be applicable now because of the recent changes. I'm not sure~

Of course you can not enroll in Medicaid ; you and your sponsor should know this as he completed and hopefully read the affidavit of support. Get a job or have your husband get a second job if you are concerned about expenses.

Already submitted our AOS.

Got pregnant. I don't have a work.

We do have an insurance under my husband but I'm thinking of enrolling in Medicaid which they'll cover the labor & delivery. (Emergency Medicaid)

Will it affect my AOS? Any idea?

Thanks

Cherry

The public charge rule excludes Medicaid in case of pregnancy. And there are exceptions for the affidavit of support for getting medicaid. I think you should be fine, but make sure you talk to a lawyer that knows better.

I would imagine you will bring your updated I-944 to your AOS interview that states you are on Medicaid as well.

As long as they used the medicaid only for pregnancy, they should be fine. The public charge explicitly excludes if used for pregnancy and pregnant women up to 60 days after the day of birth.

1) Emergency Medicaid is not a public benefit for public charge purposes. Regular Medicaid using federal funds (NY and CA notably use state funds here) is prohibited.

2) There is an exception here: https://www.uscis.gov/news/public-charge-fact-sheet

Pregnancy Medicaid is not Emergency Medicaid. Two entirely different things. Both excluded from public charge considerations.
