Minnesota Attorney General Keith Ellison would be upgrading the charge against Chauvin while also charging Thomas Lane, J. Kueng and Tou Thao with aiding and abetting second-degree murder. The newspaper cited multiple law enforcement sources familiar with the case that spoke on condition of anonymity.

The more important it is to get a conviction, the more careful the prosecutors must be with the charge (and, along with that, the more time it takes to be careful/thorough).  Maybe enough time has gone by that they have done this.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I really wish they could charge him with First Degree Murder.  I know that would be hard to prove and I understand why they don't go there - but he really deserves that charge.  I am waiting to find out what the other three are charged with.

Impossible to charge first degree I believe.  And I think the charge was upped to 2nd degree to allow the other three to be charged.  Now let's hope things are done right so that the charges actually stick.

The cop deserves whatever harsh punishment he gets, but I still want the justice system to work and everyone deserves thier day in court. 

 

In seems many of the rioters( I will not call them protestors) want him lynched.

He had better get a conviction on that second degree murder for the sake of those other charges.

I think second degree is definitely possible, but they might find the "depraved heart" burden too lofty, third seems like an easy one though. If there's any substantial difference in sentencing for second and third, I'd say go for second, if not, go for the easier one. Trying to charge him with first degree though requires explicit proof of premeditated intent, the loftiest of burdens, and without it, the guy wins. Definite no without.

 

I'm also interested in what charges the other officers there might be hit with, the intent is clear to charge them with something.

 

The most important thing is that he go to prison.

 

Whether its to get the police out of charges (while publicly positioning as wanting justice), or to appeal to emotional bias, too often these charges happen, and fail. This is one of the circumstances I think that stand a great chance, but while I personally believe second degree murder is without a doubt proven here, I'm not sure a jury will agree. So I'm hopeful that they can prove this case beyond reasonable doubt, because if they fail, it would be very disappointing when third degree is overwhelmingly a slam dunk.

Yes, like the black retired police captain in St. Louis, and the federal security officer, also black killed in Oakland.  No one seems to be protesting for them.

Napolitano needs to stop being invited on FOX, he sat there saying that Chauvin not responding affirmatively to "hey don't you think we should just let him go" means premeditated murder and that he should be charged with first degree. From the crimes he suggests Trump committed (and was clearly dead wrong about) and other conclusions, to this, the guy has no idea what he's talking about. 

 

Also, Napolitano is suggesting that they should charge him with first degree because no person in Minnesota would give Chauvin a fair trial and thus he'd plea down to second. 

 

Off his rocker. If what Napolitano says is true about not finding someone in Minnesota who isn't biased (as in doesn't have a biased opinion) to serve on a jury, second degree is a slam dunk then. First degree stands no chance of a unanimous jury vote without some actual proof (unequivocal) of premeditation. It would be dumb as hell to try without it, as the guy would basically be left to manslaughter charges alone which means he possibly walks out a (semi) free man.

Absolutely impossible to prove in this case. Since it's impossible to prove - it's also impossible to know whether he deserves it or not.

He's fine to me, most of the time he makes sense. I disagree with him on this issue though.

 

Unfortunately the defense in this case will make many attempts to utilize the toxicology report and his 'past' against the dead man. I know this because they've done it in similar cases so many times before. Christianity Today had a 'nice' piece on Mr. Floyd that was making some attempt to turn his life around, but made little mention about what was really going on. Unfortunately it does appear he needed help with a drug problem and that will be used against him... but that certainly doesn't mean he deserved to die.

 

We need to get rid of bad cops in this country and unions need to stop protecting them. One of the other officers I believe had a lengthy record of brutality. The cop in B'more that punched a woman in a face won't be removed from the force, even though he had previously had assault charges against him and was on a 'do not call list' for working certain individual's protection detail because of his 'anger problem'.

What I don’t understand is why there are 12 more deaths to honor a man who was unjustly killed, no one is against the protest, they are against the wanton destruction and crime in the name of justice
