Just to confirm, even with a fiance of a US Citizen or Armed Service Member, you still need a VISA to enter the U.S. Correct? I know this sounds like a dumb question but I am a US Citizen and an active duty member in the Air Force and my fiance is in Mexico and does not have her visa yet and I just wanted to be sure. Her interview was supposed to be April 2... 😞 Also, hoping they do some type of priority when the embassies and consulates resume operations.

It seems pretty clear, to me,  that K-1 visas are not affected by the latest EO.  It is a non-immigrant visas.  Be aware that CBP at POE has final say regarding any non-citizen's entry into the US.....not any consulate.

I agree with you.

1. As correctly stated somewhere above PP 9994 is a ban specific to schengen states and has nothing to do with PP 9645 or 9983

2. K1's do not pay Immigrant visa fee ...they are approved by IV division at the embassy but processed and issued by the NIV as a non immigrant visa

3. with IV once you enter the states you are an LPR, with K1 which is a NIV you can enter marry decide to adjust your status or leave the USA (ONCE YOU LEAVE YOU HAVE ABANDONED YOUR ADJUSTMENT OF STATUS IF YOU FILLED AND IF YOU DIDNT YOU CAN ONLY COME BACK ON A CR1/IR1 visa)

4. (see highlighted statement in the attachment from US EMBASSY AND CONSULATE VIETNAM. SOURCE:  https://vn.usembassy.gov/visas/fiancefaq/

So if you have already been issued your k1 visa, but wasn't able to move to the US yet due to the travel ban (I'm from the UK), will I be allowed to enter the US considering the new EO? It's confusing because although k1 is non-immigrant, you have intent to become an immigrant so I don't know where I stand. Apologies in advance if someone has answered this question already.

I asked them why is that other US embassies are still processing K1s and this is what they replied.

So I guess what they meant by the Presidential Proclamation 9994 is the EU, UK, Ireland, China and Iran travel ban?

The Sydney consulate has scheduled an emergency interview for my K1 visa today. My interview will be next week. I expect this means that the EO doesn't apply to K1 visas since they are willing to issue one to me.

That’s great news!!!! Thanks for sharing. Would you mind sharing why you need an emergency interview?

I know many of you are wondering about the k1 visa if they are allowed into the country now the ban is in effect. I will let you know my fiancée is currently on a flight right now to come to the USA. She is expected to arrive in about 9 hours from now. I would greatly appreciate people’s prayers that this would go smoothly and I hope to report good news to you all.

No that is not what we are wondering. Anyone who has a valid visa can Enter the states. We are wondering about the people who are in the process, who’s visas have not yet been issued

It’s ridiculous that the same embassy gave us different answers for the same visa!

This sounds very vague and is probably an email that they are replying to everyone with

I have a valid K1 at hand

Technically, you can enter with the K-1 after spending 14 days in a country like South Korea, Belarus, etc. prior to attempting US entry. But in practice, those countries (and any transit countries) can have their own travel restrictions that make it too convoluted and thus not feasible to travel to the US.

https://www.dhs.gov/news/2020/03/17/fact-sheet-dhs-notice-arrival-restrictions-china-iran-and-certain-countries-europe "The President issued Proclamations 9984, 9992, and 9993, which suspends entry to nearly all foreign nationals who have been in China, Iran, and certain European countries at any point during the 14 days prior to their scheduled travel to the U.S."

Proclamation 9993: https://www.whitehouse.gov/presidential-actions/proclamation-suspension-entry-immigrants-nonimmigrants-certain-additional-persons-pose-risk-transmitting-2019-novel-coronavirus/

https://lu.usembassy.gov/esta-cancellation-information-in-response-to-covid-19/ "If you have not been in the Schengen Area during the 14-day period preceding entry, and you are not departing from or transiting through the Schengen Area during your travel to the United States, then you are not subject to the Proclamation."
