Did you read my response? We filed in September 2019, they asked us about health insurance at our interview last week. My wife has had insurance through my employer once we got married.

It's always been a consideration in the totality of the circumstances.

It's been added as an explicit question for people filing for AOS starting today (the 24th of February), as well as is now considered a "heavily weighted negative factor". How exactly that differs from before is unknown, but I would assume it is now something they are watching more closely.

They are not allowed to apply the new rules to petitions that are marked before the effective date. As OP’s interview is in a month I’m guessing his petition is marked as being submitted way before, and therefore he should not be subjected to the new public charges rules that are more concerned with health care.

If your wife has Medicare then she’s severely disabled since you said she’s 21 and clearly not over 65.

If your wife has Medicaid well then you CANNOT be added to that. It’s free health insurance for the poor. 
You can go to the website healthcare.gov and purchase a plan for yourself. 
Your wife and joint sponsor (presumably she couldn’t sponsor you alone) can help you out. They both signed legal documents stating you wouldn’t become a public charge.

Health Insurance and Immigration are two entirely different things and being a USC she should know full well the benifits of private health cover regardless of her “being given Medicaid” or not.. note, she’s not actually given it, she just doesn’t earn enough to get off it”

 

lack of caring about such things is no excuse for failing to be responsible for her spouse who has zero entitlement to Medicaid and who will need medical insurance in the event of an emergency

In WA state you cannot purchase health care outside of open enrolment (normally November - December) unless you have a qualifying life event. Is it different in other states? I don’t think OP would be able to use the exchange right now. Unless they just got married or moved to the US.

Good point. Yes, it isn't just WA, it is every state that is like that.

That would indeed be correct, I was unsure where the OP was in their journey. The best they could do would be to buy from any insurer available in their state privately.

Doesn't the public charge final rule only apply to applications/post-dated on/after 2/24? So if went into an AOS interview that was an AOS applied for back in 2019 the final charge rule wouldn't apply/ or if resident of Illinois.

The Illinois exception is gone now due to the Feb. 21 SCOTUS ruling.

I was unaware it was possible to buy from private insurers? I’m assuming you don’t get tax credits unless you use the exchange?

  • Our GC interview is 3/10, no health insurance for personal reasons, although we both have dental/vision, and multitudes of other things showcasing bona fide marriage (working on getting our interview prep done), and we have a joint sponsor so I am feeling really good about the interview - although that's enough talk about my personal on this post don't wanna derail from OP's :D
  • Oh, I'm working full time too
