What if i don't get the recorded marriage certificate back before the 90 day K1 fiance visa expires?

Thanks. I was going to call the Monroe County Florida clerk and ask if I could do that, but instead we decided to make the Florida wedding a ceremony only and got married yesterday at the courthouse in Las Vegas. Walked certificate in today and ordered five  certified copies.  One for her to carry in her purse at least until we get the i-797, one to send in with the i-485 (I know that a photocopy would suffice), etc.

 

I'm sending in the i-485 packet tomorrow, day 75.

 

I just didn't want to take the chance of not being able to get a certified/recorded copy on the spot in Florida since their county website says it takes three weeks.

In Dallas, the Judge told us that he would give the signed license back to us immediately so that we could take to the County Clerk the same day and have it immediately recorded.    And  the clerk’s office will also provide us as many certified copies as we want the same day.    So it seems like there may be different ways to get the license recorded besides having the officiant mail it in which takes longer to get back for the AOS.

 

The official documents are:  Passport with K1 Visa Sticker, I94 and the AOS NOA.  You have legal protection now by the courts as long as you don’t leave the country until the Green Card is issued.    If you leave, you lose the court protection and are subject to Boarder Control Review Decision without any legal review ability.

 

Dont file the AOS without your marriage certificate as the RFE process will cause the whole process to be drawn out longer.

If this case if for Florida , that’s odd because I got married nov 8 and it was available to me the same exact days and they gave me 3 copies. You might want to call the court house and ask...the only difference in state of fl you can elect to take a pre marital course and it’ll void out the waiting period which is 3 days never heard of weeks and or if you don’t take it you have to apply summit your information then there after return 3 days later to signed and receive your licenses.

I think it may depend on the specific county. Or maybe the fearmongering on the Monroe County website wasn't accurate and I could have gotten it the next day.

 

Anyway, we decided not to take the risk and just got married legally in Las Vegas where we new we could get the marriage certificate.

So our marriage certificate took 2 months to come... and we decided to send in the packet before the 90 days ended just to be safe. We had a customer copy of our marriage certificate without the county clerk’s signature, so we sent in a copy of that + a certificate from the church we were married in + a receipt showing we purchased official copies + a letter explaining why we didn’t have an official marriage certificate. Our interview was just scheduled two days ago. :) so that’s always an option that seemed to work for us.

I just came back from my AOS interview today. We just submitted a photocopy of the customer copy of the marriage certificate with the original filing, and took a certified copy to the interview (which they didn’t even ask to see). Had no problems with that.

We had the confidential marriage license because we didn't want any witnesses there. The confidential marriage license requires you to get married within the county it was issued.

 

But I would assume anyone in L.A. who wants to drive down to O.C. for the marriage license alone and then later on for the wedding itself then that's an option. 2 weeks is better than 8.

You don't need to drive there twice. You book your appointment online and you only need to show up once for the whole thing. The license is issued right before the ceremony. You only need to go back there when you pick up your certificate and only one of the spouses is needed for that. Pretty easy.

Exactly the same here, married in courthouse and we were given 3 copies of certificate all stamped up and ready to go as we were leaving (whole process took under 20 minutes) I honestly think getting married "officially" in the courthouse is the way to go and get your documents all for the grand total of about $30 for us ! Then have a separate ceremony with family friends etc if you choose.
