ha!   I actually saved the P3 instructions from last year..........so nice they clarified that you only submit the tax transcript, but probably would be a lot less confusing to people if they had left in the bit about "a copy of the petitioner's most recent year tax..........."   

 

this is the former wording.............

 

EVIDENCE OF FINANCIAL SUPPORT: The petitioner must present evidence that neither the applicant nor any dependent children (if applicable) will become a public charge in the United States. A Form I-134, Affidavit of Support signed by the petitioner must be submitted with a copy of the petitioner’s most recent year tax return (Form 1040). An IRS tax transcript may be submitted in lieu of the tax return and is available online at http://www.irs.gov/Individuals/Get-Transcript.

 

and the current wording..............

 

EVIDENCE OF FINANCIAL SUPPORT: The petitioner must present evidence that neither the applicant nor any dependent children (if applicable) will become a public charge in the United States. I was pretty surprised when I started adding it all up, and then saw the bit about "yeah, if you're JUST above poverty guidelines, you're good to go".   I believe the potential for a public charge is exponentially greater in some situations.

my fiance wants to start working as soon as possible. I make enough money, but it is her nature to not be lazy. also, she doesn't want to spend all day at home. she wanted to know if she could work even before she gets her greencard.

i do not like paying for other people to sit on their asses eating potato chips as it is. i dont want anymore of them leeching. 

i got my first job as an 8/9 year old delivering penny savers in NY. no reason for able people to expect others to carry their load.

She cannot work until she gets her EAD. Which you apply for at the same time as AOS. It is processed before the greencard. Timelines vary.

Get ready for at least 140 to 180 days of processing of your EAD. Until that you will pay for her.

i believe you misread or did not understand my point. She wants to work as soon as she can. I am not calling her a leech. that was term was a call back to the earlier messages about meeting minimum poverty levels. and likelihood of someone becoming a public charge. if you need a sponsor to get above those minimum requirements, how can you expect to support someone else.

she will be going from a manager to a stay at home wife for sometime. she knows she will get bored.

I think my suggestions were good ones, and I'm sure there are many others I haven't thought of.

I mean, this year I'll make well above the poverty line, but for the past few years, I haven't. So we will be using a co-sponsor. The I-134 actually isn't required for our embassy, but we still included a co-sponsor since I didn't make enough. Neither of us are lazy or leeches.

I’m using a co-sponsor because even though i have my degree and worked my ### off to become a teacher we’re sadly not all lucky enough to be in careers where we make tons of money and I’d hate if something like not being able to have a co-sponsor could keep me from being with the love of my life❤️

No one needs to justify themselves on this forum.  Everyone has different circumstances and no one has a full understanding of others situations.

She can't work till she has her EAD or Green Card and SSN. One or the other along with SSN will allow her to work.

Use this link to determine the income levels needed https://www.uscis.gov/i-864p. If you are at 100% or above you are fine without a co-sponsor with the exception of some are harder on this amount then others. Best to be in the sub-forum to learn more about your consulate track record for this issue. Sub-forums can be found on the blue ribbon at the top of the this page select the tab "forums" and scroll down about 3/4 of the way to find your region/country.

 

AOS after marriage requires 125%. If you are a 125% now then the interview should be smooth without a co-sponsor. Just my knowledge talking.

Most embassies only require one year of tax transcripts along with other items which I will mention below. When they review it and determine you are above the poverty level for your family size then you have nothing to worry about. No need for a co-sponsor. Please read my post above for additional information.

 

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form (https://www.uscis.gov/i-134) K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with an original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Most embassies are going to IRS tax transcripts as they are harder to forge. So it's best to be aware of what the P3 states as you have advised. :thumbs:
