Only U.S. Citizens and Lawful Permanent Residents with U.S. domicile can be I-864 sponsors. There are only a few exceptions: https://www.***removed***/affidavit-of-support/exemptions-exceptions.html and https://www.nolo.com/legal-encyclopedia/preparing-form-i-864w-affidavit-support-based-exemption-40-quarters-worked.html. If you qualify for an exception, you can file I-864W instead.

Yes yes yes. Your spouse can use your assets. Read Part 7 of the instructions.

"Item Numbers 6. - 9. Assets of the Intending Immigrant. You may use the assets of the intending immigrant regardless of where he or she resides. The intending immigrant must provide evidence of such assets with this affidavit. Add together Item Numbers 6. - 8. and type or print the total number in Item Number 9. Form I-864A is not required to document the intending immigrant’s assets."

 

"Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the
owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis
for the owner’s claim of its net cash value"

wow so confusing, I have cash in my bank account, it's a US bank account , but it's a business account, do I need to open a personal and transfer the money there or a business account is ok?

Worst case scenario you’re delayed a year or so until your spouse has a qualifying job (or a second job) income and taxes. You can keep the approved petition active with NVC by delaying acting on required documents- AOS included.

I think you’re gonna encounter a lot of problems with this co-sponsor. USCIS likes things simple and plain. If you’re getting financial support from someone who has a negative income is gonna be too complicated for them and they won’t approve it. Remember you’re dealing with USCIS here. You gotta pretend they’re 5 years old.

I don’t see the problem with what you said to do earlier. Open a joint savings account to show assets for the sponsorship. That is what we did. Best of luck to you two.
