Ok so I see it's possible to actually visit if you have another visa while your waiting on the k1.  can we apply for a tourist visa with reason being to visit my fiance, meet her family, etc.? or will they not even entertain you application at that point? is there any chance at all of my fiance being approved for a tourist visa while we are waiting on k1?

It depends.

 

I saw some people apply and explain they are waiting for k1 and get it.

 

you would need a stable job and ties to your country, as this is always the issue.

 

but nobody can tell without trying.

My fiancée is a Filipina and is currently visiting me in the USA from Singapore, where she has lived and worked for the last 10 years. She has a good job there, a US visa issued from the Singapore embassy, and has been to the USA twice before.

 

I filed a I129-F for her and we just received the NOA1 a week ago. To be safe, and according to the advice in this thread, she brought a letter from her employer, a copy of the I129-F packet and her return flight ticket with her.

 

 

Here is more or less the conversation with the CBP officer:

 

CBP: purpose for visit?

fiancée: to visit my fiancé

CBP: how long do you plan to stay?

fiancée: 2 weeks

CBP: show me your return ticket

fiancée: shows return ticket

CBP: where do you work?

fiancée: says the name of her company

CBP: what do you do there?

fiancée: says the name of her position

CBP: what is the name of your fiancé?

fiancée: says my name
CBP: are you going to stay permanently this time?

fiancée: no, my fiancé is petitioning for a visa for me

CBP: what kind of visa?

fiancée: a K-1 visa

CBP: when are you going to get married?

fiancée: August, but it depends on when the K-1 visa is approved

CBP: how long did you stay in the USA the last time you were here

fiancée: says dates and length of stay, about a week and a half

CBP: OK, enjoy your stay

 

My fiancée described the whole exchange as relatively relaxed and fast.

 

This thread helped us to make a decision with peace of mind, so I thought I'd pass along our experience. :)

Yay, I just passed through successfully. 

My entry port is ATL.

The officer only asked the purpose of visit, how much cash, how Long will I stay. What was the last time visit and how long was that stay.

I'm currently waiting for my K1 Fiance Visa to be approved but I have my Business Visa for 2 years already. So I want to share my recent experience as well, I was kinda nervous too prior my arrival but glad everything went very very well and smooth without any issues. 

 

My entry port was in Los Angeles last week, was asked the purpose of my visit, how long will I stay, what I do for living. Just 3 questions and I was allowed to leave.

 

I did prepare my documentations such as my return tickets and my appointments back in my native country in my backpack but the officer was so nice (though he looked like a very serious person) he didn't even ask for the documentations (I did not tell him that I have, was just preparing to show him just in case he ask)

Anyone have experience with visiting the US for the first time after your "Application for Entry Withdrawn" incident? I tried to visit my boyfriend back in September with a lot of luggage and a one-way ticket, and the woman at the border was having none of it. I have since wised up to the system, and also my OPT from my F-1 student visa that was still valid at that time has expired. I should be ok just entering as a Canadian visitor for 2 weeks, right? I have a ton of evidence of ties to Canada to take with me: Round-trip ticket, letters from employers, recent pay-stubs, bills with my home address on them (I live with my parents right now so no rental agreement...). If they ask me about what happened in September, I should just tell the truth, right? Any Canadians who've had this situation and visited with no problems the next time? Thanks!

I got a hard denial like you and my name is flagged when I cross. If your situation is anything like mine you will be pulled into secondary and asked questions. I traveled with a binder full of ties including all of my immigration paperwork. Do you have an immigrant petition pending? I showed a ton of ties including return ticket, school enrollment, lease agreement, bank statements, car insurance, future plans, appointments, etc. It's to the discretion of the customs officer as to whether they feel you will return to Canada. If you have a job I would make sure you have proof you will return. I have crossed a total of 4 times during the IR1 process. When I hit preclearance I prepare myself for the possibility I will be denied again. I was told the flag on my passport will not go away until I receive my IR1 visa. I waited about 5 months after our ordeal happened. The important thing is you can show you are doing everything legally.
