When you start the process (I-129F petition), nothing about your finances is required or reviewed. That comes into play at the embassy interview later (~8-12 months after filing).

At that time, they must be able to show that they will not become a public charge in the US. This is generally via submitting an I-134. The CO makes the final call on the public charge concern.

 

I'm not aware of anything specific to a homeless shelter impacting the process, but you will need to list your address, and that may or may not be a concern for the CO.

 

Furthermore, what's the plan for when your fiance/fiancee arrives in the US? They will not qualify for most public aid, and are unable to work for at least several months after entry.

I'm not looking for an answer here...just raising questions that I think both may be in a CO's mind plus practical. The K-1 process is not cheap.

Yes, at some point the Beneficiary must list an address where the couple will be residing at, and to get mail delivery there.  You will need a physical address, but you can use a PO box for mail.

Can you please allow me to ask this first? I know its tough there and earning is not that easy. Can you get a second job where  you can at least afford to rent a room somewhere and use it as your home and your address, that would be great.

Now, have you met someone or planning on meeting someone? Have you traveled to meet that person as of yet? If not, have you thought about the expenses involved with K1 visa? Travel tickets, hotel stays, if all goes well and lets you file for K1 visa, have you thought about the visa fee, the medical exam, the ticket and travel expenses for your future fiance, wedding expenses etc...Is your fiance going to help with paying for the expenses and all that. 

 

I hope you don't get disappointed with what am saying, but I am realistic. But if  you already have plan and the Address is what the problem is, then Kudos to you and best of luck.

I am sure the shelter has an address

 

Just put Attention : "XXXXXXXXXXXX"

and dont forget, for adjustment of status, you have to make 125% of poverty level. If you can't afford yourself or pay for a home (in some fashion) for yourself, how can you afford to support another? The AOS fee is $1200ish plus possible other, incidental fees ( ie medical if its out of date)

 

The address is the least of your concerns right now. This is not a cheap process, in any way, shape or form.

if you are in a homeless shelter, how do you have 125% of the poverty level and how can you afford the immigration process?

I agree about prior posts saying this may be a troll.

He has gone from needing a visitor visa to come into the US from Indonesia,  to wanting to do a I-130 for his wife but asked about joint sponsors because he didn't have a job because he was with his wife, to being in the US and homeless but with a job that makes enough money for the poverty lines for a fiance visa?

Other posts have asked him multiple times for his background, is he a USC? How long have they been married? How long had he been out of the country? No questions have been answered from the OP. The OP also has had a history of getting upset when people tell him where to look up the information instead of just giving it all to him in a post, or if people make posts that he doesn't like.



With that said, the answer is yes you can file. But when your fiancé/spouse goes for their interview You will need a place for your fiance/spouse/whatever to live when they come to the US. A Homeless Shelter is not acceptable. 

If you make enough to meet the poverty lines, you should be able to afford a place unless you live in Silicon Valley, and if that's the case you may need to transfer jobs and move to be able to afford a home for your wife/fiance/whatever.

The questions about the tourist visa might've been for his wife/fiancée. She probably applied for it, was denied, and in December while he was visiting her they decided to do the IR1/CR1 (or K1) visa instead.

 

I think staying in a homeless shelter may be a problem immigration-wise simply because it's not permanent, it comes with requirements. If I were the OP I would just get my own place.
