What's the next step after failing an Interview? The CO just told him that he lied but he doesn't know what he "lied" about. She didn't answer him and after he told her that there's no reason to lie and that evrything is truthful.. She said it's too late cause she already signed the papers. He said she didn't even touch our documents. All of our evidence is there. Pictures of us together,  our FaceTime, our messages, everything and she didn't even look at it. I don't understand what happened.

So what's the next step? Who should I contact? What are my options? This is so heartbreaking. I was expecting to see him soon, I'm so lost right now. Please help.

I’m so sorry this happened to you. My fiancé was put into administrative processing today and I’m really nervous he’s going to be denied.

 

from what I understand there is no appeal process for the k-1 visa. If your fiancé was denied, I believe the next step would be traveling to your fiancés country, getting married, and applying for a spousal visa

Was he given a piece of paper and/ or his passport back and if so, is there something written on it?  Most likely a mix of numbers and letters?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

They look at it before the interview.  Just because they didnt go over it with your fiance doesnt mean they haven't looked. 

With this type of 221g it is best to get married and try for a CR1.

Looks like misrepresentation. Things just got a lot tougher.

 

Spend some time with your fiance and go over every document and evidence you have to determine how the CO came to this conclusion.

Yeah I already emailed them, just waiting to call them as well once it hits morning for them

With a K-1 denial often comes that the petition will be send back to the NVC -> USCIS to die. 

Were there any red flags in your relationship? Age difference? Religion? Amount of spending time together? Did he try to get to the US before? Previous petitions or denials?

Advise would be to spend more time together, get more evidence, marry and file the spouse visa. NuestraUnion made a good point about misrep.

04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

At this point, a K-1 is definitely out of the picture imo.......misrepresentation .  In fact, even a CR-1 will possibly be very difficult.......You might want to seek the advice of a skilled attorney........

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There has to be something that you do not know about here.  That letter is pretty strong.  I've had good luck with consular staff over the years.  I hope they tell you what happened.

What is the age difference?  Were any of the pictures taken at what may look like a wedding ceremony?  When was the last time you were together?  Could the beneficiary be hiding anything?  Has the beneficiary been convicted of a serious crime?

 

It seems to me that the decision was made prior to the interview.  The CO (yes, they are well trained) had specific questions that he was concerned about.  The answers did not seem to agree with information they already knew.  This will stay on the record at DHS and they specifically talk about fraud and misrepresentation.

 

K-1 is probably almost impossible and the CR-1 may be very difficult if there is misrepresentation.  Ask the beneficiary what questions were asked.  I sincerely doubt this was a total surprise to them.  They were not being truthful about something that the CO already knew about.

 

Find out what the questions were about.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
