Looking at one of the reviews they even asked the petitioner only! That’s an outlier of course.

 

In one case they called each person separately.

I just can't imagine that the officer would allow the petitioner to answer all the questions....that is just ridiculous.... and it defeats the purpose of the interview imo.

I will say that I have heard of petitioners being present to show support, but not to answer questions intended for the beneficiary..  Many, if not most embassies won't allow the petitioner to be present in the room.

 

There is one which says" He then asked my fiance the following questions in Khmer and asked me to confirm each answer in English:"

and how does it appear if the petitioner jumps in and answers questions directed to the beneficiary?

For the OP did you consider going to the interview? I will fly to Cambodia for it and it tends to alleviate the questioning from just one person available to answer as you both are available to answer. 

Trust me I really wanted to attend but I already used up 3 weeks in February so I don't have enough vacation days. I thought we would've been ok and the evidence we provided would've been sufficient. I figured we are a real couple so I didn't assume the worst. Now I regret just going on a leave from work. Maybe the officer wouldn't have been so harsh if i was there.

To me it seems most of the time they will ask some of the beneficiary and some of the petitioner. Given that I feel I better make sure I go!

Op.. this was not a misrep denial. 212(a)(6)(C)(i) is a misrep denial but a 221g is just a denial and they dont believe the relationship is real.  Go get married and file again with a CR1.  Try to be there for the interview this time. Best of luck.

Ok that makes me feel so much better. A misrep denial seemed so harsh and out of my hands. Thank you!

Misrepresentation by your fiance is unfortunately mentioned in the 221g letter though it is lacking the code markers.
50/50 chance either way. Wait until you hear from the embassy or senator. CO's are supposed to write the code of a misrep
on the 221g letter but not all do. Your senator's liaison needs to specifically find out not only the reason of the misrep but if it is indeed
a material misrep requiring a waiver.
Your embassy is a tough one and yes you definitely should be at the interview next time.
Don't let your guard down just yet.

But as VisaCode said, only the CO knows and we're all just speculating... 

I really think that the CO's always have their minds made up before the interview. No way did anything happen at my husband's interview that would have made them return our visa. They didn't like the fact that I had several divorces and had already brought a K1 person over. BUT that should have no bearing on letting my hubby come here after all these years.

I agree dont let her guard down but this isnt insurmountable like people have mentioned.

Of course not, misrep (if it is material misrep ) can be overcome with a good waiver package and the help of a good waiver attorney.
First they need the facts then they can proceed, anything else is speculation.

I'm highly interested in what the embassy says about this case.  Earlier comment was correct - a flat out reference to fraud or misrepresentation is relatively rare but from the USC side it looks like a straightforward situation.

I just spoke with the consulate General and she said she isn't able to discuss my case over phone. Any questions I will have to email them (which i did this morning when I first found out about the rejection) they will get back to me in 3 business days.

Should I wait to see their response or should I call my senator now?
