As far as I know Argentina doesn't have the option for Direct Consular Filling (DCF) since there is no USCIS field office, otherwise we/I could have advised you that path since you mention you will move there. (Only possible if you are a resident for at least six months)

You have a path forward focus on that. If being together during the whole process is important to you then yes move there, but do be advised that upon coming back you will need a sponsor with US based income and you will need to maintain US domicile or reestablish it upon returning. The option is going there to marry and then visit throughout when you have the chance.

I read about that this last week. in order for me to move there, I have to resign from my job. So obviously I will not qualify to be the sponsor because I will have no employment here, unless I find a job here before returning from Argentina. To live, that will not be an issue as I have my mothers home to return to.

Just your passport; that is seriously all you need.

If you own your mother's home you can potentially use the equity in it as an asset when it comes to the sponsorship part. As the spouse, you will always be the sponsor even if you earn nothing. You can have a joint sponsor, if necessary. But cash in the bank and assets can be used to meet the requirements.

NOA1: February 8, 2016 Nebraska

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath

If you want, but not needed. We just went to the civil registry, told them we wanted to be married, they took down my info, including passport number, and that was it. You both just need to sign a book, along with several witnesses, in front of a judge and that is literally the whole legal ceremony.

 

You get an official copy of the page in the book you signed and that is your official marriage certificate, called an "acta de matrimonio" by going to the civil registry after the wedding and requesting it. It comes with stamps on it and is signed. That is the only document that will be accepted by the USA as a marriage certificate. You will get a slip of paper the day of your wedding that says "certificado de matrimonio" that has your names on it, but don't submit that one. As confusing at it may sound, that piece of paper does not count as evidence of your marriage, even if it says "marriage certificate" right on the paper. That one is not official, and to be honest, could easily be reproduced by anyone with Microsoft Word.

 

Some friends of ours had a delay of a couple months with their visa because they submitted that stupid piece of paper instead of the "acta". They sent the acta and were later approved. We submitted the acta (when we were about to submit the "certificado") after we were told by our friends about the inconvenience they had with the different marriage certificates. We made it through with no problems.

 

Later in the process you will be saved a couple of months of waiting because Buenos Aires is one of the few embassies that allows for "email processing" of documents at the second stage in the process. So that is a big advantage for you as far as the waiting time.

 

I have loads of other little items we discovered along the way that we were fortunate enough to have friends who had been through the process before explain to us, since Argentina has some nitpicky stuff as far as documents go. Let me know when you are ready to get the visa paperwork together and I can give you any advice you would like.

No one said anything about him marrying you for a green card.  You are looking for moral support from a group of people who have been going through this long drawn out process the right way....some people who can't get a tourist visa, some people who go into months or AP with no answers....and your boyfriend had a tourist visa and abused it.  You are looking for someone to say "poor baby" but it's not gonna happen.  You were told what you have to do now.  Now you either apply for a K1 or a CR1 after you marry him.  No one is bitter but majority of what you wrote is fraudulent and you are mad because you are being told so.  Who ever would think it is okay to work in the USA with no authorization to work? No need to snap on people who are just being honest with you...you and your boyfriend were doing something with the intent that was not right and whether you knew it was wrong or not CBP knew it was wrong and sent him home.  K1 would be the fastest if he is not banned but it's more expensive in the long run and he has to wait to work when he gets here.  CR1 is longer but cheaper and he will be able to work when he gets here and hav a conditional green card. You should not be so mean to people trying to help you. I know it seems people are bitter. But many of them have been through a lot of trouble getting their spouse and children to the U.S. Many have been through complex cases and have been separated from their families for years.

 

You are American. This might be a shock to you but getting to the U.S. the legal way can take years and a lot of money. Marrying someone for love does not make any difference. Many have gotten their visas rejected because they come from certain countries or have some types of characteristics. American citizens that make below poverty line are not allowed to get their family to the U.S. (unless they find sponsors with more money). There are a lot of unfair requirements. 

 

If more Americans were aware of the situation many are going through, maybe legislators would have incentives to changes the law or hire more people at UCSIS to go through CR1 or K1 applications faster.

He can be back in the U.S. with you in 18 months. Get married in Argentina. File an I-30. A year later he'll have his interview in Buenos Aires and be refused under 212(a)(9)(A)(ii) - expedited removal. USCIS will approve an I-212 waiver around 6 months later and you can be on your way.
