bantam88 reacted to Ben&Zian in Wife wants to magically create a bank account out of thin air a month before her mom's interview
We don't know anything about the OP or his wife. Obviously sounds like they have been married for 10+ years or at least together for that long. Don't know how he met his wife, he might have done a CR-1 or K-1 to get his wife here, we don;t know. OP could have spent much time in Mexico and have a very good knowledge at least of that area where his wife's family is. So that's why taking a venting/ranting so seriously is absurd. And like @SusieQQQ said, welcome to the internet where you will find anything and everything said. Get used to it.

Also please do read the initial post again, the OP's wife doesn't just want to add money to their own joint account, he said his wife wants to sell a car and make a brand new account in her mother's name in Mexico with the profits. Big big difference.

Just to add to this...I’m an organizer on the site which means I am one of the people who moves threads to the correct place. If I had a dollar for every post that was in the wrong place I’d retire tomorrow.... I don’t why this OP has been treated with such suspicion for doing something almost everyone here has done at some point...

Whoever told you that fiancé or marriage visas are harder to get than work visas has no idea what they are talking about so stop listening to them. Fiancé and marriage visas are by far the easiest to get. Provided that the relationship is genuine and the intending immigrant is not inadmissible due to criminal background or other specific factors, you are pretty much guaranteed to be granted a visa.

Work visas, on the other hand, have a multitude of requirements that rule out most of the people that want them. Many people dream of living here, very few will achieve that through work. Note also that most work visas are for a set period of time. Some do allow you to become permanent residents after a certain time frame but only if the employer spends even more money on that process, and there's no requirement on the employer's part to do so.

To be honest, I'd be surprised that a small company of the size you mention would be in a position to send employees overseas like that. The £3000 you mention is just the start of the costs for the employer. If they are worth their salt they will also pay your moving costs, transporting of pets, hotel accommodation until you find a place, furnishings, help with getting a vehicle, etc, etc.

Where is your boyfriend? You said he lives on the USA but you also said the employer suggested you both move to the USA.

bantam88 reacted to yuna628 in After moving to the states what if I feel it’s not quite for me How soon can I sponsor my husband to UK?
OP, there should be a link in my signature that might be helpful in answering the rules when it comes to returning to the UK and bringing a spouse. However, there is something I'd like you to seriously think about first.

Green cards are for living in the US. Returning home, essentially abandons the process you have started.. and rendered it for nothing. I'd always advise US/UK couples (especially because the UK rules can be a difficult wrangle for some to manage) that they decide where they want to live first, before jumping in with both feet. If it's the US, then you need to commit to being there for the long haul, and certainly completing citizenship first before making a decision to return back to the UK on a perma basis. Having citizenship in the US means you can travel back and forth between both countries freely, and that opens up a lot of options for you. You do not lose your UK citizenship either. Because US citizens are non-EEAs, there is no free movement (and if Brexit goes through this may become even more problematic in the future). The process becomes complicated to bring a US spouse. The UK citizen must return and establish residency and be making the required amount of money in the required sort of job before their spouse can even join. And that's if your application is accepted. Once accepted, it then becomes an extremely lengthy multi-years worth of process to have that spouse continue to remain with you - at which time you need to still be maintaining that financial level. There are no joint sponsors. There are healthcare surcharges and various other costs. Still, for those that have no financial constraints this may not be problematic.

Homesickness of course is a thing, and there will be a big adjustment period for you. But you can always return home to visit. My husband has been here many years now, and though he misses home dearly, there is much he enjoys about the US. It's given him many opportunities and new friendships. Stay busy, make friends, see as much as you can. Remember things will always be different than it was.. and that's okay, because you've got each other finally to start making a life out of something new.

I came here on vacation and got married to my fiancee but did not plan to stay because I still had my job back in my home country. Marrying in the US is legal and not fraudulent. My husband filed for CR-1 a month after we got married and I was back in my home country. I traveled back and forth on my tourist visa to see him, even brought along my kids to visit during Christmas time.
CBP officers were really nice about it, never had a bad experience on any of my trips.

Keep in mind that a tourist visa does not guarantee entry to the US, that decision is up to the CBP officer, and if they let you in, they also decide how long you can stay, it could be much less than 6 months.  When they ask you the purpose of your visit, and you honestly say to visit your girlfriend, they could refuse entry for possible immigrant intent.  They may question you and want to see evidence of strong ties to your home country of Brazil, so be prepared to show that evidence, and also be prepared for a possible denial of entry.  It is for these reasons that my husband and I got married in Brazil almost a year ago and I visited him there every two months.  We filed CR-1 and are almost done, we're just waiting for the interview in RIo to be scheduled.  Good luck!

    1) Legal or not, people are doing it, increasingly so: https://www.post-gazette.com/news/aging-edge/2018/03/29/Immigrant-grandparents-come-to-U-S-to-babysit/stories/201803290108

    2) Kathryn Berck is a retired and well respected Consular Officer with a long career with the State Department, very active on Quora and this her answer to this question:

Q: Do you think its a visa abuse when retired grandparents stay for a long duration on B1/B2 visa on each visit every year to look after their grandchild in the USA (even though they legally leave before 6 months on every visit)?
A: Caring for close family members, especially small children, is not considered ‘working’ unless those family members are so debilitated that they should have trained professional care but the family can’t or won’t pay for it. Grandparents babysitting grandchildren is considered ‘incidental’ to tourism.

I do not understand how people can leave their homes for months at a time for a "visit" to the US.  I am good for a couple of days and then I am ready to get back to my life. The longest I have ever been away after I had my own family was a month taking care of my father's estate after he died.  I had to do a lot of paperwork with files in his home and clearing out and packing up over 5000 sq ft of house where he had lived for over 30 years. I had to deal with his advisors in person which would have been hard from 500 miles away.

I find it amusing that people find caring for a newborn difficult.  Difficult is having a teenager or two or three or four. You spend your life in the car, grocery store (especially if you have boys!), and at work (necessary to  pay for all the food they eat).

Well, there are perks that go with paying taxes.  He should file all of the years he hasn’t in 7 years.   If you aren’t a United States Citizen you may not realize that it’s highly irresponsible to not file your taxes for multiple years.  I personally would question  a person’s integrity I was going to marry upon finding this out.

Your process may also be delayed because this will probably become a very expensive problem.  I can’t emphasize enough that not paying your taxes for at least 3 years is a big deal.

This is one thing I truly dislike about Americans.  A lot of my coworkers assume that everyone in Mexico is dying of hunger and wants to come live here and it’s not true.  My neighbors when I live in Sonora, Mexico had jobs, houses, cars, lives and family in Mexico and only wanted to come to Arizona/Texas/California for a once a year family trip to Disneyland or make a one hour drive to Tucson to blow cash on Nike’s and Gucci at the Tucson Outlet and then go back home to Sonora.

When dealing with immigration there are two extremes; 1. complete open borders and 2. no immigration at all. Both are unrealistic and are not the answer. The ideal is suppose to be somewhere in the middle of the two extremes, but it seems that there is too much tug-of-war which pulls the flag more to the extremes than to the center.

This is exactly the reason why I'm AoS at the moment.  Was here on a 3 week visit and at the end of week 2 MIL sits all the kiddos down to tell them that she's been diagnosed with cancer; and the prognosis wasn't good (7 months later she's through her treatments "successfully" but having a host of issues related to long-term side effects of the chemo) - I can't imagine not having been here to support my husband and help the MIL while she's ill - I'd be over at her place almost every day doing laundry, cleaning, preparing meals and such - though at the same time, I have a lot of mixed feelings about the way it all went down. I quit my job while on vacation, which is so incredibly unprofessional. I had to ask friends to clear out my apartment which was embarrassing. I had to arrange proper care and then transport for my cat to get here which was stressful, heartbreaking and expensive.  My savings are destroyed (over half gone, compared to this time last year) and my social life is in a total shambles because things that I'd committed to previously I couldn't do (which my friends understand, but it's not the same hearing about events vs. being at them).   I'd never call this the "easy" way at all, but it was certainly the "best" thing we could do at the time - we knew that if I went home that I'd not be able to get more time off work for at least 4-6 months (if I was lucky - talking with old workmates I'm hearing stories of how much harder it is to get time off work lately and that leave requests are being denied left, right and centre because there's too much work and not enough people)

So, even as someone who's doing AoS I personally think that it shouldn't be something that's allowed - if only to align the whole process and make it more "fair" on everyone.

I don't even know where to start  If you want to see the sights, visit places you saw in pictures in real life but you are absolutely OK with your country and want to live there. No? I thought it is obvious, the US is not the best country in the world and not everyone wants to live there no matter what. Even though it seems to me that Americans do think that everyone is dreaming about moving here.
There are different situations and sometimes you have to compromise to be with the person you love.

I love the idea of bonds. If they don't leave, we get to keep the money. Money is good. Less people are gonna risk, on the other hand i hope those bonds are gonna be a lot higher than $100 or something. Slam the most difficult countries with 3k per person.
They need to reform the whole immigration big time. And this is one small step for man, giant leap for americans..

Exactly. The President isn't saying there is a plan in place and it applies to this, this and this scenario. He has tasked the applicable agencies to look into the situation and come back with recommendations. I would imagine after the 4 months this is what will then lead to a formulated plan and proposals. So for someone to say it's not well thought out is jumping ahead of the process.

I've been saying this for years and people look at me crazy and argue it. Many people think it's okay because the government makes staying and adjusting okay by making it an option. Take it away and it stops. Heck, they may even see a decline in visitor visa applications.

One girl on a K1 visa page on FB even said to me "Well, if we had that chance to use a tourist visa, we would have. I don't see why you would want to take that away." Some people actually think that's okay, even if they are told it's fraud. They don't care; anything to get their beloved here faster. It's frustrating.
