    Once hubby gets to a point where he need a security clearance he will be required to truthfully answer question about his immediate relatives and their addresses.  So he will have to out her.   And he will most likely be asked about what sort of aid he has provided for her. Depending on the level he needs it will get nasty and he could be denied the clearance and thus the position.

    Having been there one understands why some are desperate to leave,  and why many think they can outsmart the embassy.  One of the younger brothers wanted to visit the US and was in his residency as a doctor and had a wife and the first attempt was a no.  Second attempt he actually managed to tell the CO how impossible it was for a doctor to run off to the US because of the years of recertification  and got a visa.

    Once the dust settles from a divorce it could be that she is best off with her parent(s) but being at ground zero can be hard and a student visa may give her that space she may need.

    He will probably be 18 by the time your application is done so will miss out ( and he would have to have a green card first which takes 2 years )   he will still be an immediate relative most likely which would get him a green card right away and then he would have to get citizenship on the 5 year rule on his own.

    Many of the postings like that , you will not seriously be considered for until you are a US citizen .  In theory a resident can be cleared but only if you are the best ever at that work.  Expect a lot of rejections

    The first response is wrong.  You are married.  Married there married here married everywhere .   She will not yet have a SSN until she has a visa.  You can file for the tax id and file jointly but you must include both your incomes world wide.   Filing separately may actually be the best way.

    In many cultures the engagement ceremony is seen as been  too committed to be considered single.  At this point he is too married for a K1 and not married enough for a CR1 .    Hate how they split hairs.  He will probably have to go back and have a full marriage  and try again.

      Your fathers household size is 3  ( him, the wife and your new wife )   plus anyone he may  have cosponsored or sponsored    in the past  that is still in the US , not yet a USC and not yet credited with 40 quarters of SS credits ( like maybe your ex or her parents  )

    The items posted above are posted from the same manual that the recruiters are supposedly reading and following.   First hand experience is a snapshot of what was valid at that time not now.  I could tell you that I passed over the Bridge into Canada with my resident alien spouse and came back without showing ID for anyone.  That is a fact and first hand experience but has little to do with the current process and procedures.

    Agree , a parents i130 is to reunite the family.  So to file AOS you would have to be living in the US and show that it is your home for the foreseeable future.  If you are living somewhere else your mother doesn't qualify for a visa.  If you are willing to make the US your home then you can file for her.

    Had you shown up at the border with all your stuff , ready to stay in the US , they would have picked up on your real intent and at least questioned you.  There is a good chance that your husband would have been on the next plane back , and could have had no where to go.   As people have brought up there are better plans that should be 100%  when he gets to the border ( unless there is some undisclosed medical or criminal issue )   Some of us have been on the boards to over a decade, long after our own immigration adventures are over to give people advise on how to do things the best way.  Short cuts tend to have their pitfalls even if that is the way you frequently here that "everyone" is doing it.

    Entering the US using a tourist visa with the intent to file AOS is immigration fraud.  Be sure to tell the immigration officials about your plans at the border so you wont get accused of lying on entry and see how your trip goes.
