    Agreed. Some 'salaries' (particularly stipends for graduate students) don't receive a W-2 and are not taxed via the W-4 deduction allowance. If this is the case (and your spouse is a non-resident alien and has no SSN/ITIN) your employer may maintain your W-4 as "single". However, like missileman said, this is just stating how much should be deducted. When you go to file your actual taxes and make your estimated payments, you should file those as married (as quoted above).

    No, you are NOT authorized to work. K-1 is not authorized to work without EAD. I don't care what the SSA is telling you because as I mentioned, the SSA does NOT have the authority to grant work authorization to aliens in the US. Only the DHS, which USCIS is part of, can do that. You cannot work until to have an EAD in hand is the right answer.

    Sadly your lawyer isnt as competent as you think. Happens more often than not. Just search the site for horror stories.  Most people on here got this far and further without lawyers. Good luck!

    I also question the Lawyer competency as this is pretty basic stuff, is this Lawyer an Immigration Lawyer?
     
    SSN is not work authorisation, it is a Social Security Number, useful as effectively it is used as an identity card in the US. Even if it is not.
     
    Used to be that you could get EAD associated with the K1 as a stamp on arrival or very soon after, could still be useful if you expedite, but might make more sense just to marry file to adjust and expedite EAD associated with that that asap.

    Hire a more competent lawyer. The difference between getting married and going the CR-1 route instead of the K-1 is that the CR-1 provides an EAD (ready to work when he/she lands in the U.S.). Not so with the K-1.

    This is a viable option. You are not required to file for AOS - you can leave before the 90 days are up and get a new visa just fine.
    The main potential challenge would be him being a financial sponsor still.
     
    I hope the surgery went well and is and remains in good shape. Fight the fight.
     
    Edit: I just saw your timeline. Seems like POE was early July, which was over 90 days ago. If you haven't yet filed the I-485, or if you filed it after the 90 days, then you have at least 1 day of overstay and your VWP privileges are gone forever. You would need a tourist visa to visit in the future (if you want to visit before getting the CR-1).

    yeah it's just really confusing because of all the notices sent out about needing this realistically now all that is blocked but people having interviews say Monday may not know the difference. Hopefully the nvc or consulates send out notice for this block to clients.

    We had a similar situation at a similar consulate.  My now-husband's medical was completed only three days before his interview, so of course the CO did not have it by that time.  They kept his passport and as soon as the medical was received and reviewed by the consulate, the visa was issued.  
     
    So technically, yes it was an AP situation, but in reality it lengthened the process by less than a week I believe.

    1) Since the visa is not approvable without,  you will receive a 221g for the missing medical and be in AP until it arrives and they can proceed. 
     
    2)  Let the panel physician decide what is needed.  Typically it is tdap,  mmr, varicella and flu (if in season).  Any of the vaccinations can be skipped if medical history or prior vaccination records indicate they already have had

    I submitted paystubs and a letter from my employer with professional letterhead and a signature. If your interview is after the next fiscal year starts but you haven't gotten your tax return back yet, you can always submit a copy of the form you filed in place of a return transcript. Just be sure to submit the W2s with this.

    I have a major update!!!!!!!!!!!!
     
    Got the Interview Letter today October 24th.
    The Embassy needs me November 20th.
    Case Complete October 9th.
     
    Never thought this day will come so soon.
    But we're all thankful and looking forward to get this whole process over with once and for all.

    I think from a personal financial standpoint have a minimum coverage like a high deductible or tourist plan to transition, then look at a regular policy, ACA policy  (open enrollment runs Nov 1 to Dec 15) or an employers plan if they are going right to work.
     
     
    From an interviewee standpoint: I don't see how they are going to have this implented on Nov 3rd. Nothing in this administration moves that fast. If you are stressed, get the high deductible "catastrophic" plan now and cancel it once he arrives because that is specifically addressed in the so called "proclamation".

    Does anyone have any guesses as to whether travel insurance will be acceptable and what level might be required? I couldn't add my spouse under my employment based insurance without an SSN (and admittedly wasn't worried about it at the time because was just planning to add him once he arrived during our open-enrolment period, though the timeframes for this don't add up anymore). We are willing to buy travel insurance or short-term to cover him until my open enrollment period (which will be more than 30 days after his arrival in the US) but the lack of guidance means we don't even know where to start with coverage levels. 
     
    If anyone has any ideas/suggestions as to what kind of stop-gap insurance to look into, I am all ears. And feeling desperate

    At least prior to this, new immigrants had the opportunity to have subsidized health care on the Exchange. If this was in place last year, this would have been a real struggle for us. Even the most basic plan on the marketplace in my state is astronomical cost-wise.

    I’d say start collecting documents now, given the average time frame of 6-8 weeks for case creation. Police reports need to be issued within the last year to be valid for NVC, but be aware certain counties have their own imposed expiration dates on these report certificates (such as Portugal).     No problem! Yes it seems it’s all about luck at waiting stages (and reading/educating/preparing ourselves in between)! Unfortunately I was unlucky at case creation and it took 10 weeks just to get a case number, so I was surprised and pleased that dq came quickly after submission. Hopefully dq comes quickly for you!
