    Update. I had sent I-751 folder on October 28,2022. Fingerprints appointment was for November 28,2022, interview was waived off & case was approved on the same day. December 1st new card is being produced.December 6th received my green card. yay 😀 🎉 .I’ll attach list of docs I submitted along with my petition. Hope it helps

    Seems like USCIS is making a push to clear out or prioritize "easy" cases. It makes the overall backlog numbers look much better (more approvals) though it screws a small minority with difficult cases.

    Got my stepdaughter's approval today! Filed DEC 2021, got an RFE in NOV 2022, replied two days later, and just got the "New Card" update... all in November! And they processed the I-751 in less than a year.
     
    She came in on a CR visa and her I-751 interview was waived... so it appears the interview waivers are definitely real. However, she is <14 y/o and her mom's I-751 was approved without interview in JULY 2022, so that may have made things a bit easier.
     
    With that said our immigration journey is done for the next 10 years (unless someone wants to file an N-400... which my happen)!!

    Update - we just got the "New Card" status update. MSC service center, entered on a CR visa, I-751 interview waived (this is for a <14y/o child FWIW).

    I can't believe how crappy of a deal the K1 has become. At one point is seemed decent when they were processed in under <6 months and AOS was taking 4-8 months, but CR1s were taking 12-18 months.
     
    Waiting 14 months for I-129 approval, plus X months for NVC/embassy interview, imagine then waiting 18 months for an AOS interview (and hoping you get EAD/AP quickly) so you still only get a 2-year green card, and then have to go through the ROC hassle which can take 1-3 years and costs more more money. Unless it's impossible to get married (eg petitioner can't travel to visit, like in the case of China), is there any benefit whatsoever to the K1 nowadays vs a CR1?

    Years ago when my then-girlfriend, now-wife, and I were dating, she'd visit me several times a year and she always had an "invitation letter" from me one her. On a few occasions the CBP officer looked at it, asked her a question or two about me, and then wished her a great visit.
     
    Also incorrect on the CBP statement - it's not quite that simple. A primary CBP officer needs suspicion, and then approval from a secondary officer after an interview, and then approval from the station chief to authorize a denial. Something like 1 in 2000 international visitors are denied entry to the US, and some of those denials are overstays, criminal records, people bringing in contraband, etc.  The chance OP's GF gets denied is tiny and certainly not worth more separation IMO. 
     
    Agree on leaving the cat at home, however. 
     
    @Ecofolux2427  I'm sorry you have been through such a lengthy separation. Honestly, the biggest hassle for your fiance will be getting back to China. Even with all the recent changes, it's still a major (and expensive) PITA.  Good luck.

    Just want to update. I don’t know if this is rare or not. But I was ready for my case to be scheduled for an interview since we all know if our case is being referred to National Benefit Center, it is most likely we have to go through an interview. I waited for about 26 months after the case was changed to “interview is ready to be scheduled”. They didn’t schedule any interview for me. They order the green card straight away without any interview! So I guess maybe it is not necessary for us to go through an interview unless my case is rare! Just want to share my experience. I hope guys has a good one. I updated my timeline that you can refer!

    I submitted a ton of info about my relationship with my stepdaughter but not with my spouse (stepdaughter's mom) - school records, medical records, photos of us going back many, many years, I am basically her guardian/authorized contact everywhere. But USCIS wanted to see evidence that the marriage that allowed her to immigrate to the US was entered in good faith. After doing some research on this, USCIS is correct in asking this, as weird as it is. I spoke to a lawyer who told me that legally, if her mom's conditions are removed, then all the kids' conditions are removed. So hopefully this should be open and shut after I sent in the additional evidence...

    Not sure they hate it at all... we adjusted from a B2 visa and had no issues. I met maybe 10 couples who did a B2/ESTA adjustment at her ESL class end of year party many many years ago. Literally no one got scrutinized about this at the interview.
     
    My wife does however know someone who blatantly used an F2 visa in place of a K1 and they got massively grilled for it with an immediate stokes interview... and they still got the green card.
     
    Not sure what the bar is (if there even is one) for a denial nowadays.
     
    I think the B2/ESTA AOS "hate" comes from a very small group of angry older guys who are very loud about it and never miss an opportunity to grandstand. Our lawyer (who had 15 years experience when we used her) literally never heard of an AOS denied for "intent". Yet you open VJ and you'd think it's equivalent to some serious crime.

    This same error happened with my husband's ROC filing in May of 2021, his name was spelled incorrectly on the NOA, both the 18 and 24 month extension letters.  First he tried the online "typographical error" feature, twice, no response at all from USCIS.  Finally in May of this year he sent a letter to the USCIS address on the NOAs, explaining the error, and included copies of both NOAs, his biometrics notice (they did not let him correct the error when he went for his appointment a year ago), copy of his I-751, and photocopy of his green card.  He was hoping to get a new, corrected NOA for work and travel if needed while continuing to wait for the ROC process to play out, who knows how long that will take.  Case receipt search finally showed "name has been updated," on the USCIS website, a few weeks ago, but no corrected extension letter has been received yet.  We travelled to Canada and returned to the US with no problem, using his expired green card and the 24-month extension letter with the name error, he also had a copy of the letter he sent to USCIS and a printout of "name has been updated" status, but the CBP officer didn't even ask for them.  He also recently got a new job with no problem, using his SS card and driver's license.  The incompetence of USCIS is legendary.  They can't even get important information like the spelling of someone's name correct when they enter it into their system manually.  It's crazy!  He is going to file a N-400 in August after his 3-year mark in the USA.  We're hopeful that the name error will not cause problems with ROC and naturalization.

    LOL if @tkyang99  listened to this very-highly rated post (and the other 20 posts parroting this nonsense) it would've cost him an extra 2 years of separation with his wife/kids.
     
    Congrats man - glad it all worked out for you. Everything is much easier to do stateside where you can have a lawyer on your side and stay together as a family.

    Hi yes, so wow it's been a while, but yes my wife did eventually get her AP after about 11 months, I mailed her the AP and she used it to come back, there were no issues and no questions at the port of entry (SFO).
     
    So afterwards, we double checked with our lawyer, and her recommendation was that we re-file our AOS, because technically, the original AOS is considered abandoned. On the safe side, we filed a new AOS so we had 2 AOS applications active at the same time.
     
    When the time came for the interview (this was about 4 months ago), our lawyer recommended to be completely truthful and tell them exactly what happened. So we told them about her leaving the country without the AP, and explained why we had 2 active applications, etc.
     
    So the interviewer agreed that the original AOS should be considered abandoned, but he said he can still do the interview for us (so the interview would actually apply to the 2nd AOS, even though that one is still going through the process). He said once the 2nd AOS reaches the local USCIS office, hopefully he can just apply the interview to that one, and not have to do a 2nd interview.
     
    So that's where we are now, just waiting for the results of the interview. Bottom line is it became quite messy, but I think in the end we did the right thing and tried to be honest and transparent to USCIS throughout the whole process.
