    Sincere sympathies, but you've learned some substantial things.
     
    This cavalier attitude toward crucial requirements, possibly infected by inaccurate advice from others, will carry over into marriage (to you or anyone).  Finances, for example, is a (if not the) chief cause of marital strife.  He has not respected this.  He also disrespected the need to prepare the apartment.  Finally, he dismissed the need for, and the importance of, the police certificate.
     
    At minimum, this indicates fundamental difficulties in communication between the two of you.
    At most -- and realistically, in my view -- it indicates a crucial difference in attitudes toward responsibility and sacrifice.
     
    Accompanying this is an apparent disparity in the effort put into making the mechanics of this relationship happen, with the concomitant effect on your emotional state -- and especially the lack of even token concern when you were sick.  This is not what most people would call a sound foundation for a happy marriage or even a dating relationship.
     
    You have the choice of deciding whether you can abide a lifetime of having to drag him through life's responsibilities -- the big ones, the everyday ones, and the unexpected crises that are inevitable -- and deciding whether you can overlook the mentioned deficiencies and never ever complain about them or bring them up again.  The title of your thread suggests that you've already chosen your remedy.
     
    The definitive decision is yours, but I think that the indelible handwriting is on the wall, and that you'll ultimately feel far better about yourself by calling a permanent halt to this enervating, expensive mistake.  If you decide this, you can thank your lucky stars that this didn't proceed to an unhappy short-term marriage and the mess of divorce.
     
    This world has innumerable attractive, appealing, responsible, supportive, emotionally available men who will willingly meet you halfway in forming a fulfilling lifetime relationship.  Please keep this at top of mind.

    So here is an update regarding my I-131 that was denied due to "misrepresentation or fraud". I received a call from a tier 2 officer who said that because on the I-131 I wrote under class of admission "K-1", rather than AOS spouse, they denied. The officer said that it has no implications and that I can resubmit the I-131 with the correct class of admission.
     
    * Edit: I hope that the I-131 example form on VJ will be corrected. I copied the class of admission from that form.

    Failure to adjudicate a case on a timely basis means that a case that should have received a 2 year green card now gets a 10 year green card.  
     
    I’m pretty sure when Congress amended the law that introduced conditional lawful permanent residence it did not intend that sloth at INS would defy the will of Congress aka the People.

    My expectation is that somebody will pull the file out from whereever and get it processed. My suspicion s that some cases are sat on where they think the case is not real in the expectation it will go away, no evidence to support that.
     
    You have waited a long time.
     
    Yes they can ask for an extension, but would need to say why.

    Hope for the best ( approval) and prepare for the worst ( NOID). You also have a VERY SUPPORTIVE USC wife ..so I wish the best for both. Even longggg delays by USCIS, perhaps strategic to see if marriage lasts , the both of you can get through.

    About 10 years ago, my employer did the premium processing for my H1B visa and I think that it’s worth it. The USCIS Responded within 14 days with an RFE. We responded and received an approval within another 14 days. 
     
    And now, I have been waiting for a decision on my I-485 since September 2019. I wish there were premium processing on marriage based GC. Or any type of processing.

    Honestly I don't understand why K visa recipients and those adjusting from K visas aren't just authorized to work and issued SSNs automatically (if they didn't already have them).
     
    I've never heard of an EAD application during AOS from a K-1 being denied for any reason other than paperwork errors or the underlying AOS being approved or denied before an EAD could be issued (and so rendering the application moot).

    I completely agree with your analysis. My custody order says:
    If Plaintiff (my Ex wife) is unable to obtain _____ and _____ green cards in accordance with the prior representations, Defendant (that's me) will apply and pay for their green cards after Defendant’s green card application is approved.
     
    I think that this could be a red flag. This order was approved on May 2020, almost one year after my new marriage and after filing for AOS.
    But now that I think about it, the denial of the I-131 was on 1/20/22, and the first time that I submitted this order, was during the interview on 2/16/22 (after the i-131 denial), so NVC couldn't have known about the order when they denied the I-131. On the other hand, my ex wife says she applied for a GC with her new husband, so maybe she provided this order. I have to wait for the RFE of the I-485. I feel like my case is a complete mess.

    I understand you think they focused on the dates to make sure the marriages didn't overlap. Im suggesting they are focusing on the dates for a different reason.
     
    Let me ask you- do you have any idea why they would tag your file for fraud suspicion?
     
    You and your ex lived in the US for about a decade and then when various visas expired moved back to Israel and promptly filed for divorce and both remarried USCs and moved back to the US very quickly. None of that is illegal but it is suspicious. And it seems there is something in the Nevada custody order that is concerning to them. Probably the bit about how you will apply for the kids if she doesn't. 
     
    This is something IMO an immigration attorney should look at. Often family court attorneys aren't familiar with immigration so it could be the wording in the custody order is rubbing USCIS the wrong way. USCIS may be interpreting the custody order as a legal order directing you to obtain status which you can see might be a problem right? For you to comply with the custody order (a legal decision) you must marry and obtain status. If the marriage falls apart you will not be able to obtain status for the kids as you are required to. 
     
    If the children still don't have status perhaps it's because Mom was advised to not be the one filing for them by an immigration attorney who foresaw such fraud indicators? 
     
    A solution may be to ammend the custody order wording to include wording like 'if eligible'. Dad will apply for status for the kids if eligible. 
     
    The main point is having an order that says you must marry and obtain benefits is going to make it difficult to establish that that was not the reason for the marriage.
     
    You can contact your local bar association for a list of attorneys. Look for someone who has experience with NOID and removal/court. Often they have an office in or near the court.

    I worry that the AP denial indicates that there would be an issue with the approval of the I-485. The interviewing officer said that it could take another year from the interview date to get a response for the I-485, so I thought that I could have an AP in the meantime. 
     
    My wife and I wanted to visit our family and friends in Israel. It’s hard not to see them for 3 years.

    Dont worry about it. Just wait for the outcome of your GC.
     
    Having 2 different addresses is not an issue. You're not the first, nor are you the last. People have it and have been approved. USCIS even knows of spouses who work at different town and meet on weekends. If the job is over there and pay is good, it's understandable. 
     
    Denial of AP is nothing to me. It was going to be useless after your GC anyways. 
     
    Do you have online USCIS account? If not, create one and add your receipt numbers. It'll tell you more information. Quit worrying @Gomast

    I’m sorry that he went through this experience. But  it’s good to hear that we weren’t the only ones who went through this interrogation. We felt really discouraged for a while.
    I guess you are right, we don’t need the AP urgently and I won’t reapply. In a few weeks or months I’ll get a GC, which is still faster than current AP processing times.

    hey everyone, I’m letting my wife use my profile to write what happened to us today. She is the USC:
     
    Today we had our green card interview. I’m the wife . It was such a terrible experience and feeling. The officer interrogated my husband for over two hours . We submitted tons and tons of evidence of our relationship. We been together 4 years . I said 4 words ! He asked me about my past marriage about why it ended . He also asked me how I met my husband which our mother’s introduced us . He was not interested in the marriage portion at all other than the hard evidence. He grilled my husband for hours basically trying to find out if he ever worked illegally or over stayed his visa which he did not . We can’t even say at all which way it went good or bad . There’s a very small slight chance we’ll get approved. Otherwise I think it may be another interview or request for evidence. It was so strange to feel they didn’t care about to love or marriage part just grilling my husband. 
     
    Now from my prospective. I’m the husband. The interview went on for 2 hours. 10:15am to 12:15pm. The officer started by asking my wife a couple of questions about her previous marriage. She petitioned for her first husband 15 years ago. They were married for 2 years. Then he grilled me. I filed for divorce in June 2017. We started dating in March 2018. He asked about my divorce in Israel, which was in November 2019. We applied for k-1 in January 2019. The post divorce order regarding custody was issued in may 2020. It seemed like he expressed some concern there. 
    Then he continued to ask about me participating in military  groups because I marked “yes” in the I-485 because I was in the Israeli army. Apparently I made some mistakes marking “yes” for questions about groups who are using weapons. He corrected it. 
    Then he questioned me about my mailing address for which I listed my parents home. I explained it was because we were trying to move out of our apartment. But it’s been 2.5 years that we are trying to find a house so I get his point. I am not on the lease agreement. Our landlord wanted to raise our security deposit if I were to be added. 
    I wrote on the I-485 that I’m unemployed. In the interview I said that when I got my EAD, I started helping my parents a bit, and they have been helping us financially, but I’m currently looking for a job. I added that I report all the income on my taxes. 
    He barely asked us questions about our marriage. The only question he asked was how did we meet. He didn’t ask any of the questions you typically see on forums or YouTube videos. 
    mat the end of the interview, he didn’t give us an answer. He said that we will either get a yes, rfe or second interview. It can take anything between weeks to a year. 
     
    What do you think? We are really concerned. What now? What do we need to be prepared for? If we get denied, do we need to we need to move to Israel and start the process again? Do we start the process again here while I’m in the US?

    It is the normal status when the approval does not happen during interview. There are many possible reasons for the delay.
     
    For instance, when we were interviewed some years ago, our K1 file was not at the field office and that delayed the approval a month.
