    I know you're frustrated however you cannot just give up and adopt a defeatist frustrated mentality. Coming from West Africa myself, I know most immigrants from that part of the world have friends and family or someone they know in the USA who is legal. Tell your fiancee to help with that. On my first visit to the USA a couple decades for vacation I lived with the brother of a friend of a friend. I know signing an affidavit of support is more serious than just hosting someone on vacation however in the west African immigrant community friends of friends do sign affidavits of support.

    Why the 2014 cutoff? Is it arbitrary or there an underlying reason? Anyway I spent the past week revisiting immigration appeal cases from the district courts.
     
    I remember two such cases, one of which was the Sabri Samirah case where the appellate courts demanded the immigrant be allowed to return to th USA to continue adjusting status. It took ten years for him to be allowed back. It was before 2014 however, 2010 when judgment was rendered

    I think applicants and their attorneys are cautious because the philosophy is why do anything to jeopardize a journey when victory is in sight. Don’t forget for most people if not allowed in, there’s a bar for illegal presence and most people using advance parole go into secondary inspection which is usually intrusive.
     
    Yes the probability of an adverse result may be low, but why risk it? Everyone should make their choice based on their risk tolerance.

    Why did you even think you can go to do valunteering work for a whole year in the USA, using a tourist visa?
     
    Sorry not sorry, your chances of ever getting a b2 visa are less than 1%. And even if you get it I bet they will not admit you on the border anyway. 
     
    I bet you didnt mention on your first b2 application that you're planning on volunteering for a year either. That's another issue.

    Hello VJFamily!
     
    I’ve been lurking around since AOS and VJ has been so helpful. I’m posting today in need of some guidance as everything happened so fast.. My husband told me this Wednesday that he’s thinking about leaving me, and yesterday he told me that he’s moving out next Monday and will be filing a divorce. It all happened so fast!! My heart is broken because I still love him but there is nothing I can do now.
     
    We got married in June 2016 (he is a US citizen), same month we filed AOS, CGC arrived in September 2016, expiring JAN 2019. We filed ROC JOINTLY October 2018, received extension letter in Dec 2018, and now (JAN 2019) this happened.
     
    When we submitted ROC, we submitted the following evidence:
    joint bank statements joint credit card joint mortgage house contract (we built a house together) & house is under both of our names tax returns filed jointly for two years joint auto insurance medical plan that covers both people Affidavit from two mutual friends  
    Since filing ROC jointly, we also went to DC (have tickets and other evidence), re-elected medical insurance (covering both people), had family Holidays (have group pictures). We also have been going through marriage counseling (but I thought things were going well!!) since March 2018, and have receipts/insurance claims/emails to prove.
     
    What’s the next step for me now? I haven’t done much research on the divorce (I never thought we would divorce…), but he told me that it would take 75ish days for the divorce to finalize. Should I notify the USCIS right now? Or should I wait for the divorce to finalize while start preparing materials to send to USCIS?
     
    He mentioned that if I need his testimony or something to approve this marriage was entered into good faith, he would do it - is this going to be helpful?

    If at this very early stage (where she has not even arrived in the USA) you already have reason to lose trust in her word, then you have bigger problems than just a few hundred dollars visa fee to be honest. When trust is gone, everything crumbles and it is even worse in cross national relationships. I sincerely hope it is just a miscommunication between the two of you and not the beginning of a pattern of lies.

    Relax and just wait for your approval. Will likely happen within the next couple of weeks to a month.

    When was the last time you spoke to her?
     
    You should already have her Passport info if you are filing for her. In fact, you should have all info about her at this point (addresses, full name, work history, ect).

    True . However, it was a little bit more complicated than that. Mom was previously married to US citizen (not my father) and they tried to do a K3/CR1 and did a very bad job at it. That was circa 2004. It was a straight-up insufficient evidence of bona fide relationship (basically, they were two old people doing a DIY case in the era of pre-Facebook, pre-Viber, ... terrible job putting together the package). She was denied an immigrant visa.They ended up divorced in 2008. So in theory, there shouldn't a problem. But I wanted to be present anyway in case they tried to spin something sinister on her like a 6C1 misrepresentation or something like that. That was the whole reason for me wanting to be there. And yes, one week away wasn't bad, except for the jet lag, then by the time you got used to the time difference, it was time to go back!

    Why did you bother? I mean the worst they can do in the case of a parent petition is request DNA evidence the cost of which would be a fraction of your airfare plus one week off work. You probably were looking for an excuse for a vacation lol 😉

    Therein lies the problem. Nobody wants to compromise. Build strong tall walls and provide a path to citizenship for the non criminal undocumented/illegal aliens already in the system.
