lummo reacted to geowrian in Savings account/investment income on a k1
There's no issue earning income. The issue is when there is employment/work.
Personal investments are not an employment issue.

lummo got a reaction from Vee_bay_bee in Applied for SSN after AOS
No fees ever required for EAD and/or AP based on pending AOS (except if a fee waiver was used for the I-485). So if he needs to renew them in the future its also free (just remember to include a photocopy of the I-485 receipt notice).

And note that a fee waiver for family-based immigration is not available (specifically, it's not available when an I-864 is required).

lummo reacted to geowrian in Parents Petition
Then you can only petition for your father. ETA: ~1-1.5 years.
Once he enters on the immigrant visa, he can petition his spouse. ETA: ~2-2.5 years after the above.
He must maintain his permanent residence within the US during that time period while waiting for his spouse abroad..

Any immigration "advice" given by SSA employees should be disregarded. Period.
Many K-1 AOS individuals have. Not an issue at all.
Very late reminder (lol) that there is no fee for I-765 nor I-131 for AOS applicants.

lummo reacted to NikLR in Evidence of bona-fide marriage with divorce
No they don't consider if the time was happily spent or just spent. But in all honesty, don't spend that time unhappy or forcing someone else to be unhappy either. If he wants a divorce, and you feel you've tried (which IMO staying with someone after they cheat is definitely trying) then you should divorce and try to move on and be happy.
She has zero control of the USCIS's decision. In fact your spouse even has zero control once you file with a divorce waiver.
And that other forum with the "extra scrutiny" well that's a load of bologna. If anything it's easier to provide evidence that you ENTERED the marriage in good faith than it is to provide evidence you are still married and have co-mingled your lives.

You can make updates at the window at the time of the interview

lummo reacted to kris&me in Tax returns
USC files tax returns for any money earned outside the US
he may not owe any taxes as the exempt amount is well over $100,000
but still required to file them
your biggest concern will be a sponsor that makes fits the poverty level guidelines
plus having a US residence
NVC stage asks for tax returns for last 3 years
but only take the most recent on one to interview
2017 if interview before April 15th
2018 if interview after the 15ht of April

Yes, it is normal. The trasnfer from VSC to TSC is actually a good thing, since it's speeding things up. Just be patient. On average it's taking between 16-20 months at TSC, per the USCIS website.
If you need to travel, there are no issues traveling with your updated NOA1 receipt.

What the heck? The social security people have absolutely ZERO connection with how USCIS adjudicates AoS and AoS-related applications. That person had no idea what they were talking about. Your husband will receive his EAD.

This is a well known fact. With so many filipino OFWs, your girlfriend isn't the first, nor the last

Right. Not really. Living together 3 years trumps everything else you could combine in terms of evidence.

No passport photos required; https://www.uscis.gov/sites/default/files/files/form/n-400instr.pdf:
The Phoenix Lockbox: https://www.uscis.gov/n-400 "Where to File" tab. Have you considered online filing? Its a straightforward process (i.e. lower chance of USCIS misplacing documents): https://my.uscis.gov/apply/v2/naturalization/overview

Yes, you can make that assumption. She will have no bearing on your immigration status.

OP is the immigrant; her husband is the USC. OP is in the US with DACA. OP already has a SSN. OP is not eligible for AOS, so she has to interview in the DR.
OP is from DR. Another user, @AfricanQ, is from Ghana.
They live together in Connecticut.

lummo reacted to Wuozopo in I-693 help! Being told I need another physical exam by Civil Surgeons
Mr J-- yes those are the instructions which indicate a K1 is an exception the the entire I-693 full medical requirement for most who adjust status.
Do you meet the requirements?
A. Yes, you got K1
B. n/a
C. Yes, you had visa medical in London
C1a. (Assuming you had no Class 1 condition like TB that requires further evaluation or treatment in US)
C2. Yes you have proof that you have had all the shots and they are ALL on the form DS3025 signed off by the doctor at Knightsbridge clinic. You have a photocopy, but the original is with the rest of your medical file in the white envelope at POE.
And concerning what a civil surgeon would need to fill out IF you hadn't already been signed off on shots at Knightsbridge, for example the one who posted she got shots after arriving in the US.---
That is covered in C2: Parts 1, 2, 3, 4, 6, 9 of the form I-693.

lummo reacted to yuna628 in I-693 help! Being told I need another physical exam by Civil Surgeons
OP: It's best to look before you leap.
If you have
1) completed your UK medical and all shots are complete and signed off on as required
and
2) you have a copy of your DS-3025 from that medical
and
3) you are only just starting to fill out your AOS to send in
You do not need to do anything with an I-693 at all unless you:
1) receive a notice from the USCIS stating the DS-3025 you sent with your AOS is insufficient
or
2) they lost your DS-3025 or the officer is new or not aware of the rules, or they couldn't be bothered to go find your original medical results
or
3) at an interview the officer requests a new medical directly.
If either of the first two scenarios happen you would need to find a US Civil Surgeon that would only recertify the vaccination portion of the form. Your only challenge will be finding one that will comply.
