I got married to my fiancee 26 day after she entered the USA. She is from Ukraine and we have a 2 year old boy together. He has a dual citizenship, two passports. Ukrainian and American. I got crba and USA passport for him. I'm his legal and biological father in Ukraine and in USA
Now my relationship with my relationship is not going well. I'm daily threatened by my wife that she will take him back to Ukraine. We are still married. Our marriage is less than 3 months old.
I hid his both passports.
How do I also alert US customs to not to let my son leave USA?

The sooner you file, the sooner she will be a permanent resident. I’d also recommend applying for the EAD at the same time so that she can work.
Whilst there is no deadline per se, she will officially be in overstay if you don’t have a receipt for the AOS before her 90 days expire. That’s not as scary as it sounds since overstay is forgiven for spouses of USCs but surely the purpose of bringing her here was for her to build a life with you. Until you file AOS she is still in limbo status and cannot get on with starting to “live” here in the full
sense of the word.

USCIS doesn't have a time limit for AOS filing. But the K-1 only allows 90 days of status. It's risky to overstay:
A pending I-485 results in a period of stay authorized by the Secretary of Homeland Security. Thus, it's in the best interest of the immigrant to file for AOS ASAP.

When everything on your fiancee's end is completed (medical, DS-160, etc), the consulate will contact you for an interview.

Just a quick update. We have tickets to return to Kiev on LOT Polish airlines in June. We were notified today that our flight has been canceled. LOT international flights were previously canceled until May 31. Now all LOT international flights are cancelled until June 14th. We previously had tickets on Turkish Airlines in April but that was also cancelled.

I understand your desire but do you have a residence permit? Unless they change that requirement, even though I am a US citizen husband married to a Ukrainian citizen, I cannot get into Ukraine.

It's currently a voluntary 14 day quarantine and for now remains in effect until May 11. Penalty is 17,000 Hryvnia if caught out of quarantine. Seems like Ukraine government will keep extending that 3 weeks at a time. My understanding is there are no commercial flights allowed at this time. We have tickets purchased long ago for a June return to Ukraine and are not optimistic that will happen.
All foreigners without residence permits are barred from entering Ukraine. Starting April 6, all travelers, both Ukrainian citizens and foreigners, arriving in Ukraine will be required to undergo a 14-day supervised quarantine period. Not sure what that exactly means.

The trump Administration is planning to pass an Executive Order in the next 24 hours to suspend immigration to America. While it's unlikely the President will change their mind on the general policy, we believe they may consider a narrow exception for immediate family members of US Citizens, including fiancés. You shouldn't have a concern for the expiration date on your NOA2. The NOA2 has an expiration date of four months but extendable in four months increments to one year. If you go beyond the one year you will have to start over. With the current situation, I see no problem with you being able to proceed to receiving a visa in the NOA2 period of one year. Embassies when the reopen will advise you as to how they will handle this. Under the circumstance I believe it will be extended automatically. Wait for further instructions once your embassy opens. Be sure to follow the embassy website for your country for news updated status.

Those dates are the time frame that the petition is valid from USCIS. With that said, the embassy can extend the validity of the petition for up to ONE year. Some embassies does this automatically, some require you to contact them .. I don't know the policy for your embassy.

i just think it means you can go onto the page and schedule the interviews, the fees should have already been done when you did the ds 160. just need the medical exam fees and the vaccinations if you want to do those. are you filing also for a child? that could be why you have 2 ready statuses.

Why would you start all over after you have come this far. They have not flatly denied your case but given you three options. Choose the one that works for you and get this done before the door shuts and then you will have to start over.

Your only lost because you are not reading or following the answers to your question. Reading the P3 will give you everything you will need to do to secure your visa from the embassy.

In our case, we received an e-mail from NVC-do-not-reply@state.gov nearly a month after NOA2 with the case no. etc. Two weeks later, we got another e-mail from the consulate on how to apply for the visa and prepare for the interview (packet 3). Not aware of a way to find case details online without a case number. I see from your time line that you received your NOA2 on 12/23 so it could be any day now that NVC receives your info, forward it to the consulate and notify you. Best of luck.

did you get invoice id number that will be used to assign an agent to the case? how did you get this, from snail mail or by calling NVC?
I am talking about the first of 6 steps that is done after receiving the NOA2.
