    Your wife is stuck with that DV for the rest of her life whether or not you drop the charges. It will make her life a living hell. You made a stupid unnecessary call that could have been avoided if only you had chosen to control yourself. Put the trip on hold until she gets her greencard and all this DV stuff sorted out and maybe this will be a lesson learned type of thing for you.

    Nope. Even though CR1 was cheaper and time to greencard faster I would do K1 all over again if I had to. It got us together faster, even if just by a couple of months. We were getting so stressed out towards the last couple of months because we couldn’t be together that it was worth getting a K1 for. AOS takes a long time and it’s more money but if you go in with that in mind you can make it because at least you are going through it together.

    This is not standard at all. They definitely suspected fraud. Most interviews are just a couple of questions for formality. I don’t mean to offend by what I’m about to say but please don’t say this is normal on a forum like this. You’re scaring people saying this is normal. This is not normal procedure. For whatever reason, and that is no one’s business, they suspected you weren’t a real couple. This is the procedure when they think the relationship isn’t genuine. A standard aos interview is nothing but a couple of questions and basically just looking over paperwork with the couple together.

    Hi All
     
    I looked back about 15 pages and didn’t find any discussion so I’m starting a new one but if there is one around this topic already, feel free to point me to it and close this one out. 
     
    I know some folks on K1 visas received 10 yr Greencards instead of 2 yr greencards and some people were saying it might have been a USCIS mistake and some others said USCIS had just started doing that to K1 filers during Greencard interviews. Has anyone checked with USCIS if after receiving a 10 yr Greencard instead of a 2 yr Greencard, they still needed to file for removal of conditions or can they go ahead and file for citizenship already?
     
    I’d appreciate insights. Thanks

    Not that it’s anyone’s business but no I’m not intending to never file ROC. I’m not stupid. But apparently this IS happening a lot and it’s actually NOT a mistake and people just file ROC when the time comes and move on from that. Some are even told they do not need to file ROC and collect proof they were told so and file for naturalization later on without problems because they did everything they were supposed to. And yes I know the rules so I don’t need anyone telling me what I NEED to do. That is not the question I asked.

    Unfortunately at this time foreigners are not allowed to enter the US from the majority of European countries. This should have been researched while booking a ticket as well was most likely listed on the airline website. She will now have to quarantine herself for 14 days OUTSIDE a banned country and then can travel to the US.

    The first thing you need to do is decide which visa route you wanna take. Then you decide where to get married. If you want to file for K1 fiancé visa, you need to get married in the US. CR1 is a spousal visa you apply after getting married, any country in the world. 
     
    K1 is faster to receive visa in hand and be living together, around 9 months currently, but more expensive and more time until you can travel abroad and work. 
     
    CR1 is cheaper but takes longer, around 12-14 months currently, but you arrive with a greencard and permission to travel abroad and work almost immediately.

    If this pandemic doesn't qualify for change in circumstances, I don't know what does. Marry and adjust, try to file before her authorized stay is over so that she doesn't accrue illegal presence. Many others have done it, you'll be fine. You'll need things like her birth certificate, make sure you have those.

    That’s legal. What you can’t do is get paid for a US job. Just remember that if you do continue to work for your home country and they need you back in your home country for anything that you need to wait for AP approval and that takes as long as EAD. So if they require you to go back and forth in the first few months you’re SOL.

    No. You’re not a resident when you enter the US. You’re only a resident when your adjustment of status is approved. That’s the start of your LPR status.

    You’re not required to send marriage evidence with aos package. This is why there is a ROC after 2 years. A recently married couple won’t have much in terms of marriage evidence. Most AOS interviews are just a formality and only last a couple of questions and are not separated. They separate couple and bombard them with questions like yours when they suspect fraud. None of the reasons you have stated here are cause for fraud suspicion. They definitely saw something on your file that made them suspicious about your relationship. Most people who get lawyers for this late into the process have complicated cases. You say you have no complications so why did you use a lawyer if you don’t mind us asking? The answer to your scruitinity may be in why you used a lawyer. I feel like we haven’t gotten the full story here.

    First rule of K1: you never ever ever make wedding plans or moving plans. 
     
    Your original timeline wasn’t realistic then, it’s even less realistic now. The problem with your plan to have a celebration where your wedding was gonna be is gonna look to the USCIS and the embassy when you finally get to your interview that it was a marriage celebration and your K1 will be denied. Then you’re gonna have to actually get married again, kill the K1 and file for a CR1 which will take even longer. 12-14 months from petition. You shouldn’t have made plans but by doing what you wanna do now you’re just gonna prolong your move even more now. My advice to you would be to cancel everything and deal with the consequences of some angry vendors and guests. It’s better to deal with that than to lose your visa.

    Honestly you’d be wasting your time. Too much time has passed. You have long gaps between Visa and us entry and filing which is why the medical is no longer good. They already asked for a new medical and that’s the only th8ng pending. Don’t waste your time and get a new medical and submit.
