    90 day rule is definitely not a thing. It is also not a USCIS policy but a DOH policy ( I am at work and cant find the source right now, but someone please correct me if I am wrong). 
     
    You were inspected and cleared at entry and that clears you from any "intent" issue. 

    I would go ahead and file. You can read through VJ, lots of cases of people filing before 90 days and having no issues.

    I don't know why a lot of people here get so aggressive when OP is genuinely trying to ask questions and do the right thing in order to keep the family safe. Did everyone lose any sort of empathy? I know we all went the right and legal way and took some time for us to become residents/citizens, but OP is in need of help to stay alive. Have some humanity for Christ's sake.

    You're the one giving poor advice.  Have you read Matter of Batista or Matter of Cavozos?  No, shocking.
     
    It does not matter if she came on a tourist visa or the VWP or anything else.  ONCE SHE HAS BEEN ADMITTED, immigrant intent does not matter.  Where is she now?  She has been admitted.  That makes it legal for her to marry and adjust status.
     
    IF SHE WAS OUTSIDE THE US, then it would be immigration fraud for her to enter with the intent to immigrate.
     
    SINCE SHE HAS BEEN ADMITTED AND IS CURRENTLY INSIDE THE US, then it's perfectly legal for her to marry and adjust status in accordance with Matter of Batista and Matter of Cavazos.  
     
    Report me to the moderators if you think I am encouraging immigration fraud.  Go right ahead.

    Per existing law, she can legally marry him and remain.  However, she can not leave the US for at least 4 to 6 months......She can not work during this time...

    Not filing AoS makes you illegal. Not having the I-864 in the AoS packet makes it incomplete, which will lead it to be denied and makes you illegal. This was already explained earlier and in your previous threads. The fact that you are hung up on the I-864 AND still do not understand the details of the process are extremely troubling.

    She entered in April and filed in May? Did she come in under K1 visa? Us Canadians don't need a visa to go to the US but we still have to adhere to the same visa rules, we cannot go in with the intent to get married and adjust status.

    @Boiler....what did I ever do to you to warrant ur snarky comments. Some of us are unlearned of these process and what is needed and though you might be fully educated on all the topics am not hence my questions...if you think my questions is too dumb for ur educated brain please ignore when I post them. Am looking for genuine suggestions and advice not someone who is condescending with their responses

    I had a lot of help from this forum through this process, so I wanted to share my experience. 
     
    I hope this helps those of you who are freaking out despite knowing that you're in a legitimate marriage and technically should have nothing to worry about. 
     
    Our situation:
    I, the beneficiary, was working in the US on a TN visa when applying for AOS. My husband is a USC by birth. We met four years ago on vacation, while I was technically married to my first husband but we were separated. I got my second TN in Charleston for a perfect job. I planned to stay with my now-husband while I looked for my own place but never left. Technically, I moved in as soon as I entered the country, though that wasn't the intent. We have one child born last year, and have been married for 1.5 years as of today. 
     
    Things that supported our application:
     
    - we do have a kid
    - we have some joint bills (some of the important ones anyway) 
    - we're really legit 
     
    Things that didn't support our application:
     
    - while we do have joint finances, it's only when it "made sense" - like joint car and home insurance, medical and dental, a family cell phone. Everything else, like internet and utility bills, are separate. We still have no joint baking accounts. 
    - we have no pictures. I hate pictures, and can't budge. 
     
    Other things:
     
    - I make well above the 125% poverty line on my TN. My husband started his own business last year, and as it's in the process, his expenses far outweigh the revenues, so his profits are "R&D scale". I am supporting the household financially, and we did not seek a joint sponsor nor include my husband's assets (I just have student loans). This was the basis for my successful EAD expedite, which allowed me to continue working after my TN expired. 
     
    Among the obvious (marriage certificates, birth certificates, etc.) we submitted:
     
    - a joint tax return for 2017
    - my W-2s and pay stubs 
    - a letter from my employer saying that they want to employ me forever because I'm fantastic
    - my husband's business and other licenses 
    - medical, dental, and home insurance statements in both of our names 
    - a cell phone bill in both of our names
    - a deed to the house, owned in full by my husband only
    - some bills to our address in my name only - internet, phone, etc. 
    - a lone photograph of our family for no apparent reason 
    - affidavits from my coworker, my husband's ex-coworker and now family friend, and my husband's parents 
     
    Since we don't have any joint accounts (though we do have joint finances, in that we both pay for things), no photographs of ourselves ever, and since my USC sponsor isn't really much of a sponsor at the moment, I was quite a bit worried. 
     
    I therefore assembled the following for the interview, on top of updated bills already listed:
     
    - car insurance we finally consolidated (we still own our cars individually)
    - property card for the house with my husband as the owner, and the bills that he handles in his name (like electricity) 
    - memberships to various things like Costco and the Children's Museum with both of our names, and pet insurance records with both of us as owners 
    - recent family trips: a flight we all took together, some recent hotels in my name only but for two adults and a baby, and a giant list of AirBnbs and associated reviews from the hosts, most of whom mentioned both of us, our baby, and the dogs. 
     
    The interview:
     
    We showed up about 15 minutes early and didn't realize we had to check in. We were called when our CO was wondering if we showed. I apologized profusely. My husband was annoyingly calm. 
     
    We were called about 10-15 minutes after our official interview time. The CO introduced herself and went through our forms, confirming generic biographical information (name, address, date of birth, date of marriage). She checkmarked as she went along. She reshuffled the documents for a while and I told her that I swear I organized it better than that, she chuckled. 
     
    She asked where we met, and I explained in two sentences. She wrote it down. 
     
    She confirmed my husband's company name and asked where I worked. 
     
    She asked the "are you a terrorist" questions one by one on the application form, checkmarking as I confirmed no. 
     
    She then asked if I have any additional evidence for our marriage. I unloaded everything I prepared, down to pet insurance. She didn't look at it while she was taking it and adding it to the binder. I'm pretty sure she would be rolling her eyes and laughing if she weren't so professional. 
     
    She then told us the card will be in the mail shortly and explained the ROC procedure. My husband asked me if I needed to write that down. I said I was fully aware. CO laughed and said she'll walk us out and congratulations.

    That's a bummer. I hope you get the RFE asap and it is something trivial you can sort out rather quick. Keep us updated and best of luck!

    USCIS online status is notorious for showing incorrect information. That being said, there is a slight chance that there is something they realized that they did not have. 

    I would sign up for the next available infopass and go in to talk to them.

    It is kind of alarming that so many people think they can just decide if someone gets to be deported or not. I feel like I have seen so many threads that say this exact same thing. Just because you helped get someone here doesn't mean you get to slam the nation's door in their face because you feel like it.

    It should be the employer that is hiring you to pay for all expenses including attorney fees.
    If you have to pay them money, then something is not right.

    according to your history of attempts to get to USA, you filed DV lottery and won, you had a GF at the time, and you attempted to include her as a spouse so she could go with you, you filled out papers as she was your spouse while she was in a different country, so this appeared as if you were married, you miss represented the DV lottery papers as if she was your wife. insert misrepresentation, sure you never attended the DV lottery interview, you still misrepresented the circumstances of that relationship for her to be able to join you on the DV lottery, you say you were never married but they clearly believed you were so the first spouse visa was denied at interview because of this, and the fact the married to women 2 was not legal.
     
    now fast forward, as you claim you got a divorce from a GF which is pretty hard process if just a gf, but since you claimed on the DV paper she was your spouse you had to jump through hoops, now second petition filed USCIS approved, sent to NVC and onto interview, the past will always come back to haunt you.
     
    there is a chance you are facing a ban for misrepresentation and will likely need a waiver, and this is not a DIY case, your going to need an attorney.
