I am going to apply to adjust my husband status. He came on a b2 visitors visa in October of 2015, we got married in 4/2016 we have been married for ALMOST 3years. I have been a US citizen for 8 months now.. my question is: Once all the paper work is submitted will they look at his visa application (b2) to check for discrepancies?

They will review hos whole case.

We went for a consultation from a lawyer and he want to know if my husband  had check that he was married on the app. Because the lawyer said most of the time when u check married on the visa app. Ur more likely to be approved. But my husband cant remember if he did or not.

Well if he was married he will need the Divorce Certificate as apart of the application.

Yes, they will review past visa applications, including possibly any notes from the CO when he interviewed for it.

If he marked that he was married, then he will need to present documentation that the marriage was dissolved. If he wasn't actually married, providing that documentation is impossible. There would also very likely be a misrepresentation inadmissibility.

Never lie to anybody in immigration or on any immigration forms.

Sounds like he might already be "married".  Not telling the truth on the visa application isn't something a lawyer can fix.

There is no waiver for not sure what I put down on my B2 application.

Waivers aren't decided by you. Immigration decides is a person is eligible for a waiver based on the severity of the infraction.

A waiver can apply for misrepresentation.

A waiver can't get around needing to provide documentation of a divorce.
