    Congrats to you Jan/19 filers! This is MONTH 1 for you. This waiting WILL test you and your relationship with your loved one , trust me on that. But when your fiancé is here with you all the waiting was worth it. That my friends is the reward for enduring the long wait.
    I'm a Aug/17 filer and my fiancé JUST got here this past week. Based on my case If your fiancé applies for the visa in a country not her home country be prepared for Administrative processing as they will have to background check for every country she/he has lived in for 6 months or longer and will need police clearances for each. We were in AP for 8 months after the interview because my fiancé is from the Philippines but lived and worked in Taiwan which is why you see the Taiwan flag in my profile since that was the embassy that processed her K1.

    If you use a co/sponsor and they are not self employed then they need to supply last 3 years tax return. Or supporting documents to show proof of income.

    MandW got a reaction from wxman22 in What if we end up moving outside the US after she comes to the US?
    so much wrong information mentioned.....
    If she comes here on a K1 she cant leave while in AOS, then once she gets the green card she still cant live outside the USA longer than 5 months. Without hassle from customs when entering back into the states.
    My exwife, she and I went through this very thing, she had the 3 year conditional green card, conditional meaning there are conditions you must adhere to when having that card and one of them is RESIDING in the USA. Just because you have a green card doesn't mean "ok we can live anywhere and come back anytime" nope, nada , sorry. A green card is  RESIDENT card, meaning you have to live here to be a resident.
    My ex, her work sent her/us to China on a 3 year project, we didn't know about the cant stay outside the USA longer than a certain period, we came back to visit 8 months after we left, when we landed and got to customs they gave her a butt chewing saying "this is a resident card, means reside here" and then asked for letters from HER employer which we had, but a letter from YOUR employer wont do her any good.
    We went back as this was her job and again 8 months later another butt chewing and they threatened to take her green card. We pleaded our case and we won, then we went back for 6 months and requested to be sent back to the states.
    Now after you get the 10 year green card the conditions are released however you will still get the 3rd degree from customs when you re-enter as to why you have a green card and you reside more outside the usa than you do inside the usa and if its a proven track record you spend more of the time out or the us than in they can take the card away when you enter customs.
    That decision is 100% up to the border protection agency aka customs, not uscis not DHS, not NVC , but the customs officer at the POE , they have all the power to grant or deny entry and TAKE AWAY GREEN CARDS.

    shutdowm has no affect so don't pay any mind to that.
    embassies , interviews, uscis , nvc has no affect with shutdown. period.
    normally there are 2 dates a month for K1 , the rest are tourist and other visa services, this is the case with Taiwan and its probably the same for many of the embassies which is why your seeing the 2 dates offered and one is already full, so book soon as you can if not then march will have 2 more dates available and all are first come first serve basis.

    MandW got a reaction from Lemonslice in K1 for ex wife sister
    forgot to add this , if you were the sponsor for the exwife mentioned on the affidavit of support and its been less than 10 years since she got the k1, then you have to list that and even if you don't they will find out and count that as dependent against the income requirements. Not even sure you can have two people to sponsor...unless the ex left the states gave up her status...

    that's just it, they gave 221g but didn't ask for additional documents, they asked her 3 times has she been to usa and all 3 times is no. so Monday is 2 weeks since the interview, they even told her someone will call you in a couple of days , no call, no email, was a lie to her. they want you to tell the truth but they are allowed to lie to the applicant?

    she is a worker there but takes care of elderly people, one in fact.
    she has a ARC , alien resident card.
    I say I wish manila because at least she would be home near family , she only stayed because we thought Taiwan was easier or faster than going through manila processing times.

    I'm not going to worry about this anymore, US government isn't going to prevent me being with the woman I love, the woman I decided to be my life partner so I'm not going to worry. if ends up being denied, we will do the 130 route, I will go to the phils and get married there. then do 130 and if that fails I will look into selling my house and cars and moving to the phils, which is the last option. So I look at it as plan A , B and C
    A = K1
    B = 130 Spousal visa , stay in Philippines 30 days then back to USA for 60 , and keep doing that until 130 visa is/if issued
    C = Migrate to Philippines.

    if K1 interview the consulate gives a 221g , does that hurt the process of a cr1 ? like if we now plan to marry and get married then she would be my wife. so how hard is it from that point to process a cr1 and get her into USA? I'm thinking now go CR1 route

    and John, hope your plan works. if mine cant resolve soon then I will do CR-1 as well and get married! I love my girl and USA officials will not prevent us being together, one way or another we will, even if I have to move to the phils and live.
