K1 for ex wife sister

I bought my 1st wife to America on a K1 Visa and we have been divorced now for one year and me and her sister have connected over the time and I would like to file for a K1 Visa for her to come to America to get married is that possible???

They will probably assume that you are helping your ex wife get around the long wait time for bringing a sibling over. 

 

Are others in her family over here? If she is the last waiting to come over it’s going to look even worse.

 

I would say lots of face time together, lots of evidence of a genuine relationship, and if possible to relocate for a time over there to show the comitment is to her and not to just getting her a green card would be better.

ETA... @Jerron305 let me elaborate on why there would be a lot of scrutiny. It is because this could be seen as an attempt to bring over the sister faster than the normal process. Normally it would take 15 years or more for your ex-wife to bring her sister here to the US as a sibling. You divorcing your ex wife and immediately marrying her sister would obviously allow her sister to come here faster. Immigration is trying to crack down on fraud so the officer may be very hard on your case. We are not saying that your relationship and circumstance is not genuine. We are just saying that you have to overcome suspicions of fraud. And if there is anything that makes an officer suspicious s/he can deny your case. Especially for a K1. Because for a K1 you two are not technically married yet so the whole thing could be made up. 

 

Best advice is to be prepared.

How long since your ex-wife arrived? How long since divorce? They may look at this as you just bringing women here. Especially within same family. So just prepare for the scrutiny.

Here's what's working for you:

 

- You are legally divorced and free to marry.

 

Here's what's working against you:

 

-You divorced your wife and want to marry her sister.  Bringing both over on K1's.

-"Connected over time" sounds like the relationship with the sister began before the divorce from the first wife was finalized.  USCIS kind of frowns on overlapping relationships.

-An incredibly quick turnaround time between divorce, the new engagement and now new K1 filing for your former sister-in-law.  All within 1 year.

 

Reading your previous threads, the timeline seems you petitioned for your ex-wife (then fiancee at the time)...a  couple of years later your wife was then looking to petition her mother (not sure if this was completed)...then you divorced the wife and are now filing a petition to bring your new fiancee (who just happens to be her sister).

 

CO might presume this is a case of a "divorce" to be able to "marry" the sister just to circumvent waiting time for a sibling petition.  

Did your ex-mother-in-law (soon-to-be-mother-in-law) end up immigrating as well?  Presumably your name is tied to that petition too (as you were the legal spouse at the time).

To OP. Legally, I don't see why not. However, you'll have an epic showdown battle in convincing adjudicating officer and consular office. The battle can still be won. This battle must be on pay-per-view.
