On what basis was the lawsuit? Might be helpful for others...

No response on our case for over one year so the writ of mandamus...interesting that within 6 weeks of filing the suit we got an RFE 🤔 Maybe we could’ve just continued to wait but we really needed to know what was going on with our case do we could plan our future...waiting as long as we did, we were concerned and thinking of a plan B

Have u spoken to a tier 2 person? Tbh all u can do is wait. Some from February are still waiting and there are many from previous months waiting also.

1 member waited over 400 days to even get a rfe

There r other tools that u can use.

Can contact ur local congressmen or senator. https://www.senate.gov/general/contact_information/senators_cfm.cfm

    https://www.contactingcongress.org/

    Contact obudsman.

Yes, we waited over 400 days with the same response that “security checks are still pending”...only to finally get an RFE then finally NOA2. Probably just bad luck for us, but nothing happened until we filed a lawsuit. I would recommend contacting your congressman and file an inquiry with the Ombudsman at this point...although neither helped us unfortunately! I know other members have had better luck though.

    I used this link:

    https://secureforms.travel.state.gov/ask-nvc.php

My NOA2 was issued September 14th.

I emailed the NVC with that link on October 3rd.

Today I got a response with my new case # and they said I would be notified when my case is sent to the assigned U.S. Embassy/Consulate General.

Every case/country will probably have a different timeline.

If you have already emailed, just wait and you will eventually get a response.  After waiting 8 months for the NOA2, a few more weeks is no big deal, right? 😉

After waiting 15 months for NOA2 I suppose I should be used to more waiting! Hopefully soon though 🙂

Congratulations. In comparison to others here who complain that their at day 200 and want something done now, you have really persevered. My hat is tipped to your tenacity. Not many would have lasted as long as you. Welcome to the thread and if we can help bring you up to speed please ask. There are many here that would gladly share their experiences with current regulations and processes. Here's wishing you wind in your sails for a smooth journey from here on out.

Thank you! Believe me, this has not been easy and at time truly spirit crushing...but my fiancé and I were determined to persevere! 😎

    Hi everyone,

Just wanted to let you know that I have recieved my case number and invoice number just now by calling NVC ;) It is still at NVC though, but hoping to be send with the next batch on October 3rd.

How long is it taking now from NOA2 to NVC? How long is everyone waiting before they call? Sorry, I’m a bit behind and things have changed a bit since I started this process!

I've read some mixed things about unchecked boxes on various reports. One guy said they got their NOA1 in July 2017 and had to get their congresswoman and sue to get USCIS to finally give them a decision. Two weeks later, he got an RFE for not checking some box. Stupid. My guess is USCIS was just looking for anything at that point. But a couple other people had unchecked or unfilled boxes too that didn't have such dramatic cases. They were mostly "I didn't think I had to fill this in because I checked NO to the question above." I left a bunch of lines blank to questions under "if you answered yes to...then..." instead of putting NA or something. I hope they don't give me a hard time on that. If they do, I'll be quite aggravated as I don't remember reading that as a suggestion/requirement anywhere in all the guides I read. 🙄I guess time will tell!

Yes, we are hoping they didn’t just come up with this unchecked box thing after waiting 441 days for a response...and of course the timing is interesting since we had filed a lawsuit 6 weeks before 🤔 I send the RFE back so more waiting and we’ll hopefully be approved finally

This is what's so frustrating. Every time I call, I get different information. But I believed the last person, because I checked the USCIS website and Laguna Niguel is no longer listed as a service center.

I just googled it and it came up with the hours...etc so it doesn’t seem like it’s closed. Hope this gets sorted out soon for you

    Hello.

In early July I sent our I-751 package to the Laguna Niguel location, per the instructions on the USCIS website for my state. The check has still not been cashed. My wife's green card expires this September 20th, so we contacted USCIS to follow up, and they said the Laguna Niguel location has closed! They indicated that our package must have been sent to a new location, but since it's not in their system they can't tell me where, and when they will get to it.

My concern is, we are not going to have proof that we submitted the I-751 before her green card expires. I do have my USPS receipt and a screen shot from USPS that the package was delivered in July. I'm just not sure this serves as proper proof that we filed on time. Should we take them at their word, do nothing, and wait for them to get to our application no matter how long it takes? Or should we prepare a new package and send it to the (now) proper location? Or, should we just get a lawyer? I'm hoping someone here knows about this situation and can give us some friendly advice!

That doesn’t seem accurate...I just received an RFE which said to mail it back to the Laguna Niguel location. I would try calling again, seems like a mix up

Well.... ur in the right place for where they are currently processing cases. Still plenty awaiting from previous months also.

If u don't mind. What was ur rfe about. I know u been waiting WAY LONGER then the majority of us.

makes no since Rome why it would take so long with Canada being our neighbor and information between the 2 countries being  readily available .

The RFE was for not checking a box under the criminal history part, part 3 question 4a. Because I had answered NO to the questions above it I did not think I needed to complete that part. They have been telling us and our congresswoman that our security checks were pending for 8 months...no other answers. We filed a lawsuit after the one year mark for lack of response on our case and 6 weeks later received an RFE...all I can say is interesting timing! 🤔
