In my case, I had to something because my case was so far out of normal processing times..waiting 441 days for an RFE is absurd.

I did a lot of inquiries, called, went to the field office, had my congresswoman call and I submitted a case to the Ombudsman. The response we kept getting was that the security checks were still pending. It wasn’t until we filed a lawsuit that we received the RFE.

Just hang in there...you can submit an inquiry or contact your congressman. I didn’t have success with either unfortunately and had to wait over 400 days for an RFE finally. Every case is different but definitely keep being the squeaky wheel and eventually you’ll get an answer. Hang in there!

Well it certainly is interesting timing that we received this after filing a lawsuit! Does anyone have input on the best/fastest way to return the RFE? My lawyer says FedEx but I thought so read some issues about FedEx a million years ago when we started this process 🤦🏼♀️

Just checking in...nothing new on this end just waiting for a response from
USCIS regarding our lawsuit. They have 60
days to respond so we should hear something by the end of September. Suspect after such a long delay with our case that they may just deny...at least we should have an answer soon so we can move on to plan B.
Congrats to those who are married or have upcoming nuptials!

I feel your pain at day 404 waiting for NOA2. I can’t believe there’s such a delay considering how long it’s been since your NOA2! That seems crazy! I hope you hear something soon

Well I think it confuses them because he had asked to be able to live in the states in the past but then changed his mind...a lot has changed since then and he also has a son here so yet another reason to be here

One thought is that he had a green card almost 20 years ago when his father was going to move the family to the states...my fiancé didn’t end up moving because of his work and ended up giving the green card back (willingly). We are told this apparently “confuses” immigration...

Thank you...we decided to file a lawsuit so that we can at least get an answer. Feel like our case is sitting on a shelf collecting dust...it’s been 13 months afterall! Hopefully we will know something by this Fall so we can make some decisions

I have done all of the above and submitted an inquiry through the Ombudsman...all to no avail. Way too long for a K1. We decided to pursue a lawsuit now to at least give us an answer so we can plan our life...

Hello, I am trying to find which K1 group might be at the same point that I (finally) am...I am a June 2017 filer and just received an RFE last week. Sent in the reply now waiting for NOA2. Good luck everyone!
