    Forget about the NY court marriage thing. 
     
    1. Get a Utah zoom wedding marriage license now (but no sooner than 3 weeks before he arrives as the license is good for 30 days) https://www.utahcounty.gov/dept/clerkaud/PassMarr/RemoteAppearanceFAQ.asp and 
     
    2. Two working days after he arrives, go to the social security office to apply for his SSN.  Sone SSA employees will not process SSN applications of the K-1 is married. He must do this while single. 
     
    3. get married. 
     
    4. the Utah zoom marriage certificate will be emailed to you within 24 hours. Print it. 
     
    5. file the I-485 package once you’ve printed the marriage certificate 
     
    6. the paper marriage certificate will be mailed to you. Bring it to the I-485 interview 
     
    You can have this all done in a week.

    I married my husband soon to be 3 years ago. He and I filed an immigration petition, and it was approved for expedite but he had entered USA due to an emergency on a tourist visa last year as we lost a child. Now we just had a baby, but he did not come to the delivery despite having a tourist visa and ticket. I came to find out he was actually here in another state living with another woman and working on the tourist visa under the table. He came two days prior to our child's delivery and never told me. His family had been lying to me saying he was asleep in his bed. He has not been in contact with me whatsoever. Is there anything I can do about him being here living with another woman? I want to also withdraw my I-130 but will it be too late due to being married for close to three years? I need to also know what to do because he is in another state, and I need temporary child support but have no idea how to get his address. I found out he entered USA by a friend of his, so I checked his I-94 and was so saddened that he was in USA with another woman while I was giving birth to his first child, and we had lost two children last year. Is this immigration fraud and what can I do about it?

    He doesn't want to come to the US. He's asked you to cancel the process. He wants a divorce and not continue with this relationship. Just follow his request to cancel the process, and get divorced. 
    It hurts, but sadly you not wanting a divorce will not stop him from getting one. 
    Do not lie to any part of the US government it will not end well for you. Which you would have to do and have him also lie in order to get a visa at this point.

    Here's what could happen if you get divorced and do not request a cancellation by contacting the embassy where his file is.  At the spousal visa interview, they may ask him about your marriage relationship, questions about you, and review all his answers on the DS-260.  If he is not truthful and tells the officer that he is married when in fact he is divorced, that is a serious misrepresentation, a federal offense.  If he is ever caught, his visa could be revoked and he could be deported for the misrepresentation.  It could also be considered fraud and you could be implicated if you knowingly let him proceed on the basis of a marriage that has been terminated.  Also consider that if he comes to the US with a spousal visa, you are on the hook for the I-864 even after you divorce.  Why take all these risks?  If you don't want a divorce, all you can do is talk to him about it.  If he wants a divorce and you don't, he'll eventually get his divorce.  If you love him, respect his decision and let him go.  So sorry you are dealing with all of this.  Good luck!

    The visa cannot be legally issued if you are divorced.  Cancel the visa, Divorce, move on, and seek happiness for yourself.  Good luck.   This could a blessing in disguise.

    Move on. Don't be with someone who doesn't want you. 
    If you don't cancel the visa, he may come and you'll never know

    He can come, but if he wants to work on the marriage. Otherwise coming on a CR1 and divorcing shortly after will cause problems down the road

    First off, trying to conceal info from USCIS would NOT help your husband, so get that idea out of your mind.
     
    Your spouse can complete ROC without you with a divorce waiver. USCIS understands that marriages can be entered in good faith and still fail. 
     
    If you truly want to help him, file for divorce ASAP and get the process over with as quickly as possible so he can proceed with the divorce waiver with no issues or hiccups. Having the divorce decree in hand makes it easier. 
     
    You can also help him by making sure he has every ounce of evidence he needs that your marriage was legitimate up until you separated from each other.

    Hey y’all, long story short, we went thru the K1, did the AOS, and now we just filed for his ROC in February of this years. I decided to divorce in March. Nothing bad happed, I am just growing apart from him. He sacrificed his whole life to be here with me and I don’t want to pull the application. He deserves to continue the life he has made here. So my question is: Can immigration learn about the divorce if I DONT tell them? I would have to submit the paperwork right? If I never submit it and stay quiet, they would never know about the divorce right?? Everything we submitted proved that we were married at the time, so they would go based on that right?
     
    btw, divorce papers are NOT filed yet. Wanted to file this month.

    For the citizenship I believe it was only $750  and you just have to show proof of 3 years of marriage …if you have been married for 3 years or had ur green card for 5 years you can apply for citizenship.

    The perception won't change upon receipt of GC nor US PP. 
     
    With a GC and sometimes US PP, you still need to apply for some countries' visa. 
     
    A GC or US PP won't change the negative perception. They may just help to make traveling easier eg, when you don't have to apply for visa. 
     
    Negative perceptions are ingrained situations. I live in Texas but get ignored sometimes out in public or call agents tone become less endearing as soon as they smell my accent, and I don't have a thick accent.

    Since it’s a day before ur trip I would recommend just going, I heard way to many horror stories were people rescheduled and it ended up not being properly updated n they end up getting denied. I would keep the interview and reschedule the oath ceremony if it’s not gonna be on same day.

    This is the fastest and probably easiest way to get it done. Downside is minor passports are only good for 5 years, so when you need the next one, and stepdaughter is 16, you will be in the same situation again.
    I like this route, solves all your issues in one go around. Things to consider is how fast the court process is, and how much this route will cost.
     
    Both of the above are good suggestions.

    If you want to stay longer, see if you can find a doctor who can capably counsel and treat you.  Surely there are a few.
     
    You'll need to decide on your own whether to withdraw the I-129F in favor of marriage and the I-130. This legal-immigration process is neither short nor pleasant.  Commendations to you for recognizing your understandable mental state and for relying on outside recommendations for advice.

    seems to me a wise decision as the CR1 visa would allow your spouse to work when he comes to the USA and that's always a plus
    also easier to get SS #,  his DL and add him to needed accounts like banking ,  health care insurance,  etc 
     
    u need to relax now and take care of u

    MASH reacted to Timona in Mom of a 6 month old. I am a LPR and had him outside of the US. I also have been outside of the US for 2years and have to apply for a returning resident visa to re-enter.   
    COVID excuse is old already.
     
    If you're close to an external inspection points eg Europe, try that avenue and if they let you, you're good and saved $$ and time.

    The N-600 is for someone who has already become a citizen and who wants proof of his citizenship (most commonly for children whose parents naturalized and the children then became citizens automatically, they may want proof of their citizenship other than just a passport).

    It doesn't apply to you, since 1. you're not a citizen, and 2. you will get your certificate when you take the oath.

    It will void your eligibility for a K1 entirely. You should instead consider switching to spousal visa.

    Sorry, there is no such thing as canceling the withdrawal. It cannot be taken back, this question has come up several times before. Your fiancé needs to re-file again.

    Hey December Filers! 
     
    today I had my oath ceremony and I am happy I no longer have to do interviews and pay anymore to USCIS ❤️ .
     
    it was a simple ceremony ,
    my ceremony was set for 10:30 so I got to the location by 10am, they let us in at 10:30, got in a line of 2 where the security tells us to get our letter ready and to provide our 10 year green cards. Sadly, I lost my green card back in July so if anyone has the same issue just make sure you bring in a police report and a form of ID such as a drivers license . Once got to that part they told us to go in a line where we provide our paper to them as well and they said once the ceremony is done I come back to the same line and get my actual certificate. The ceremony took literally an hr to start and 15 mins to finish. After that I went back to my line , got my certificate and me and my husband went back home. 
     
    I would say this is the end of my journey , but I feel once I get my passport and update my SSN than I feel all the waiting is done lol.
     
    all in all I am happy the part till the oath ceremony is done and I wish nothing but the best for everyone still waiting and I will update later on with the passport process.
