    Your post really makes me cringe. Your wife can't just be shipped back to her home country like some cattle, just because YOU want to. It is unfortunate that the marriage has fallen apart, but since you yourself say that there was no fraud involved, she will still be able to remove conditions by herself with a waiver. She what Boiler said.

    Re-read the instructions. At the end of paragraph (2) there is one magical word: "OR" - so #3 by itself is sufficient. Of course you do not have an AOS receipt yet, but sending the AP and AOS paperwork together fulfills that criterion.
    I was also confused about this "explanation letter" when I sent in my paperwork, but the senior members explained it to me, and they were correct. No explanation letter is needed in your situation.

    Lots of good information here. It's not hard to get the BBG, but it does take time and you do have to present compelling reasons as to why you need both citizenships. There are several Facebook groups in regards to dual citizenship US/Germany out there that I recommend the OP (or the wife) joins; they really helped me with my BBG. They have sample files of applications that got approved, as well as current timelines. From what I see, the time to get the BBG approved is currently increasing rapidly and is now at over a year on average. So I would apply for it well in advance before mailing the N-400 (or better wait until it has been approved). Personally, I did not use a lawyer and I don't think one is needed for either side. Good luck OP.

    Just adding to this:
    I got my 'Beibehaltungs'-approval this February. As for the reasons I presented: I work in IT, and there are a lot of jobs out there that require security clearance. I can't get security clearance as a Green Card holder, thus I'm at a disadvantage in the job market. My ties to Germany are strong since all my family is living in Germany, I'm the only one over here. Those were strong enough reasons to get the US, but also be allowed to keep the German citizenship. (By the way, while never engaging a lawyer for my American immigration matters, I did hire one for this German hurdle. Probably not necessary, but in this case I felt better with one, German bureaucracy... )
    It currently seems to be taking 6-9 months (applied last year July). When picking up the certificate at the German consulate I was told I did the right thing in waiting to have the certificate in hand before starting the N-400 application, since the wait times seem to be getting longer for the 'Beibehaltung', too long for keep pushing out the oath date.
    After getting the approval, you have two years to actually get the American citizenship. If it takes longer, you can go back to the German consulate and get it extended for a few months, but you should really trying to get it within the allotted time. 
    They also told me to keep the certificate in a safe place since they don't have a copy of it and if it's lost it'll be a pain in the butt to replace (no idea if that's true, but don't want to find out either ).

    I applied for the US citizenship a week after picking up the certificate and it looks as if I will have the US citizenship (if all goes well) by the end of the year.

    So, OP, if you want to keep both avenues, Germany and the US, open for future residence states, this would be your way to go.

    Beyond the one question that is maybe about your status, all of your questions are not immigration related.  Your wife and her family have no control over your status as an LPR. 
    On a personal note, have you tried marriage counselling or talking to your wife about your issues? Are you really just going to leave your child like that?

    The entire immigration process is akin to watching paint dry, or watching grass grow. If you let it, it can drive you crazy. 🙄  In reality, it makes little to no difference to you how and when other peoples' paperwork is processed. All you can do is sit back and enjoy the wait, go visit your fiance(e). If you have not acquired humility and patience before, this process will give you many opportunities to master those traits.

    They need to check with German rules because if they don’t live there it’s not sure they are still covered by medical there. At least that’s how it is in DK but don’t know about Germany just saying they can’t assume they can just get it paid for there when they don’t live there.

    You can try apply for emergency AP, but I doubt you'll get it.

    A K1 is for fiancés only. You cannot use a K1 visa if you are already married. If you decide to get married, you will have to start all over with a CR1 visa.

    Unfortunately that "I deserve better" attitude is common among military spouses. And I see it first handed. Basically women thinking they are special and their while life is a sacrifice because they married a soldier. And based on that they need to be treated better than others. There is already so many benefits for spouses and military members... even when it comes to immigration, spouses can expedite naturalization and stuff. But actually being above the law should not be a benefit. No matter who you marry.

    I hate news articles like this and the sense of entitlement that I seem to hear a lot over here. Certainly the military families seem to get well taken care of which is no surprise considering the work they do for the US so what's this couples excuse for never completing the paperwork like everybody else does?? Laziness? Maybe she has a criminal past and was scared? No one will really know the truth to that question.
     
    Its ridiculous to expect the world to revolve around you and expect special privileges- the rest of us follow the process legally (no matter how crazy, long and exhausting) so that we can not live looking over our shoulders.
     
    I'm with you- not much sympathy over here!

    This pisses me so bad I had to vent. So here we have this tearful article about poor military spouse (entered US illegaly, never fixed status) who is being deported and suddenly everyone should feel sorry because her family is being torn apart and it should NEVER happen because her spouse is veteran... And of course everyone blaming Trump. 
    I'm sorry??? Her husband never bothered to help her acquire legal status. They just lived like this until finally law caught up with then and they went crying to media about how unfair immigration are and there should be exceptions for military personnel.. 
     
    Using the husband "job" as a reason to be above the law... So what's stopping spouses of police members or foreigners for claiming exceptions also? I mean, integrity of their families don't matter? Aren't they heroes also?
     
    I've been following this story for a while and I'm really glad they didn't get away with it after all.  Being a military spouse, this kind of military entitlements is absolutely the worst. 
     
    Basically until recently she claimed that "military spouses are untouchable" and couldn't be deported but evil, bad Trump changed the rules and suddenly she realized that she is indeed deportable. 
     
    It pisses me off that thousands of other foreign military spouses do things the right way and we have this one who apparently decided that rules don't apply to her.

    I think they should just go ahead and ban AOS from a tourist Visa all together. There is a way to do things and that way circumvents the proper procedures on how to things.

    Yep, I read this wrong. Of course, if OP is the US citizen and his wife is the conditional GC holder, SHE has to file, not him.

    @jesserz I think I might be able to help. I actually immigrated by sea through the Manhattan Cruise Terminal in 2013. Came on the Queen Victoria from Southampton. I was nervous like you about the procedures and sent an e-mail to CBP before my departure. They responded immediately and told me basically that it would not be a problem - and it did, indeed, turn out to be really easy.     I actually think that immigration by sea happens more often than people think - on my cruise, I met three people (a German couple and a guy from England) who were also immigrating.

    I don't know why she'd be disappointed. Most adults move away from their parents and cope just fine without living with them. I just don't see why people feel the need to move their parents here. 
     
    But this is something to consider. If you barely made it through the AOS based on your income, then you must be earning somewhere around $20,500 a year. That's the requirement for a household of 2 (you didn't say whether you had any other children so I'll assume not). And now you want to have a child too? And your wife is not planning on going to work for 2 years? If you do bring her mother then you will be a household of 4 (3 plus the immigrant) so will need (currently) just over $30,000 a year. 
     
    I wouldn't get too involved with the financials just yet anyway. There's every chance this category could be removed in the next round of immigration reform because the current administration has made no secret of their desire to reduce or stop chain migration.

    You fault the border officers for sending the wife into secondary when they were doing their jobs. They were right in questioning her. Based on your story she was going to use the visitor visa to live in the US regardless.
     
    The extension is a possibility but not a guarantee. The options now are to file for a spousal visa and for her to return to Venezuela while it is being processed. Or file for AOS.
     
    This has nothing to do with bad border officers or Trump. A person can't use a visitor visa to go and live in another country. Look what happened to the wife in Panama. It was basically the same thing. Best for them to get the process done so they can stop breaking rules because they are scrambling.
