While your mother does not receive income from a U.S. source she does receive income from Argentina. She should research the tax obligations of reporting foreign pension in the US. Her income might not actually be 0.

This link states children up to the age of 26 can be a dependent on parents insurance but nothing about parents being dependents for children

Well no Day one Medicaid in Florida.

I also agree a Parent is not a dependent.

She can certainly buy though OCare and yes her income is her World Wide income not US.

There are a variety of plans and even the most expensive does not cover everything by any stretch.

    Welcome to America.

I totally understand you. We become so paranoid all these years with this and that, that at least to me now that I'm a USC it feels like I broke up with a past friend who I'm gonna "miss" somehow.

My story on AP. I traveled on my AP (while on AOS from K1) and on my return to POE Miami they sent me to secondary inspection. I was aware of this would happen because the custom officer told me that since I was traveling with the AP  he needed to send me to secondary inspection. He was nice.
Then the lady in the room had an attitude (she was very young and I guess new at this job) and kept questioning why I left the country, etc. I only spent 2 months in my home country visiting my mom who needed my help at that time. She kept me for like 1 hour or so staring at me weirdly like deciding if she would let me in or not. She let me wait until the last person left.
I said to her, what is the purpose of having the AP if can not be used for a family situation. Kinda that I got a little upset about the whole waiting. My husband was waiting outside for me wondering why it was taking so long.  She asked me if I had planned another trip which I replied not that I'm aware now. I will if I have to. She kept thinking.
At the end I told the lady that if she has any more questions, she could also talk to my husband who was worried already waiting outside. She just let me in. Of course after that episode, my next trip was with my 2 year GC and I had no problem at all at POE.
Now with my recent acquired citizenship and US passport I will be able to travel "freely" with no concerns if they will let me in or out.

Get your lovely grandmother to do an affidavit explaining the fact that she owns the condo, and that you pay her rent directly.  There is no reason to have to mention how MUCH rent you do or do not pay her - the important thing is that she lets you rent directly from her.  No need to send in an "agreement" if she does an affidavit.

The important thing to show is that the two of you live together.

    Best of luck!

Yeah, getting married 10 days post divorce may surprisingly be the least of their concerns.

I think the problem here is the term "remarried me again".

OP,  that phrase is usually understood as marrying the same person again.

If, as I suspect, you are trying to convey that your wife divorced her ex-husband and married you - that is, you were not her previous husband - then the correct wording would be:

"My wife married me within 10 days of her divorce from her previous husband."

If this is the case, then it would be questioned by the CO, but is not insurmountable.  Especially if, in your case, your wife was separated for a long time from her previous husband and was just waiting for the final divorce decree.

    Edit: clarification

I think you will have problems down the line and need to reach out to USCIS again and ask to speak with a tier 2 officer. Hopefully a senior member can chime in.

Things will get better with time. The department of state laid out plans for reopening embassies and processing visas and it really is based on how well countries are overcoming the COVID-19 situation in their country. According to the DOS, if a country is mostly reopened, they will begin processing between 40 to 80% of their usual workload. I would expected K-1 visas to be amongst the visas prioritised. All we can do now is wait and be patient, which I appreciate is easier said than done, but think about when you and your partner can look back on this period in the future, how you got through it together, and how it strengthened your relationship going forward. Best of luck!

I know I can't quit and I can't sell everything, but I want to scream!!!!   I will continue to focus my energy on trying to move forward....I am working with my congressmen, as well as investigating other options to move forward.   As long as the Consulates don't believe that we fall under pp 10052, and they will resume the K-1 when they open, I will feel better.   Ultimately, it is the not knowing that is driving me crazy.    I am glad I have this site and the knowledge that there are hundreds or thousands of us struggling with the same thing.  Thank you all.

    +1 to Gibraltar.

No quarantine, no special visa, no apostille requirements, and all documents are in English.

    We got married there pre-covid.

Sounds like a textbook case of someone who is planning to bypass the queue and adjust status.  Hopefully that is not her plan, but these circumstances may lead CBP to deny entry.

Agreed, I'd strongly recommend getting a return ticket; most flights are offering flexibility so that you can change the date if required at no additional cost. I think most would agree this is going to make things a lot easier for her at the border.

There was a spouse who was removed at the border, detained and sent back because of no return ticket (read somewhere here on visajourney). Please get a return ticket to be on the safe side.

I just want to say I am sorry you are going through this. You have no reason to be embarrassed- he is the cheater. @geowrian gave great advice/guidance. It might be hard to see now but it may have been in your best interest you didn’t have children together. File for divorce- file your ROC- it’s not like AOS- plenty of people file for ROC w a divorce waiver. Find support in your friends and family and work on you.

Too little information, what is far more relevant is what your ties to your home country are
But clearly you are already on their radar so maybe expect the same again, obviously there is a risk you are denied entry, no one here can say how big that risk is

curious as to where you are from, and why if medical care in your home country is not adequate you choose the country with the highest healthcare costs in the world for a checkup (maybe CBP thinks this was strange too)

My mom's interview is on Feb 10 and I remember asking the same question in this forum. Based from what I've read here, the interview process for parents are easier. They will ask mostly basic questions pertaining to their relationship to us (petitioner) like where we live, if we're working, how many people live in our house, our spouse (if married), birthdays, etc. As for the documents they need to bring on the interview, it will all be mentioned on the Interview Letter that they're gonna send to you & the applicant. Mine only asked for orig passport, photos, Interview letter, & Medical Exam results (should be completed before the interview). Hope this helps :)
Anyway, good luck to our parents & to those going through the same process!
My mom's interview is on Feb 10. They asked for the same thing (orig passport, photos, interview letter, & if nbi clearance is more than a yr old). I noticed our timelines are just a week apart. :)

FYI healthcare.gov may show you a medicaid policy if you qualify based on income; just make sure you don't chose that one (the website isn't responsible for weeding out those who are and are not allowed to have medicaid)

    1.  Protect yourself both physically and legally through an attorney..
    2.  If you have evidence of fraud, you can report it.  Other than that, you have no control over his immigration status.  If he was issued a Green Card, your affidavit of support remains in effect....you cannot withdraw it.....and it will remain in effect for several years...maybe even many years..a divorce will not alter your responsibilities.....the best solution might be for him to gain citizenship...which will remove you from financial responsibility for him.  Remember, You verified that the marriage was bona fide.
    3.  Seek happiness for yourself.

Also consider what would be best for your fiancée. Being "stuck" for 5-7 months waiting for the EAD is hard. She won't be able to travel, work and in many states she can't get a driver's license. It is very difficult to go through that, in a new country, while her spouse is working every day. It can be a very depressing experience.
CR1 takes longer, but you will be able to visit during the process.
