Mom passed US citizen interview, but DAD failed

Your dad applies for his own citizenship. Him being married to your mom who is now a citizen has nothing to do with his citizenship application. 

Take some time to teach him English and reapply in the future. 

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

06/24/2016 - biometrics appointment

11/28/2016 - interview scheduled for January 9th, 2017

There is no “n400 through marriage”.  He has to pass the test on his own regardless how he got his green card.

Op, you are trying to find some loop hole to get your father to naturalize because he failed his prior citizenship interview. Such loop does not exist. Your dad can reapply when he feels confident enough to do so; help him get some English lessons.

But that's NOT A THING. A person files for naturalization for themselves, it's not like permanent residency when someone else can file for them and they get it on that basis.... You are confusing these 2 things by talking about how you filed for your parents' naturalization or how your mother wants to file for your father's, you can help them fill out forms, sure but you are not the petitioner...

 

The English requirements are what they are and the only exceptions are these: 

"You are exempt from the English language requirement, but are still required to take the civics test if you are:

  • Age 50 or older at the time of filing for naturalization and have lived as a permanent resident (Green Card holder) in the United States for 20 years   (commonly referred to as the “50/20” exception).
    OR
  • Age 55 or older at the time of filing for naturalization and have lived as a permanent resident in the United States for 15 years (commonly referred to as the “55/15” exception)"

 

In 8 years, when he's been a Green Card holder for 15 years, your father will qualify under the 55/15 exception, at the age of 84 or so.

No,

1) it's not through marriage, your father has been a GC holder for over 5 years AND  he has NOT been married to a USC for 3 years since your mother just became a USC, he's been married to a USC for a few days....

2) there is no difference anyway in the civics & English portion whether one files under 3-year-rule or 5-year-rule

Does dad really need to become USC? I thought maybe he wants to spend longer time in Peru and enjoy retirement….If that’s the case ( am assuming) , then u can file a re-entry permit I-131 and he can stay out for 2 years at a time

He doesn't need to become a US citizen. He is enjoying retirement since he was 70 years old. He lives here in Florida too. The only reason for him to become a US citizen is because he just want it. Yesterday after he failed his exam, he told me is not the end of the world, he is not obsessed to become one either, and after you guys clarify me many things. It's up to him if he wants to try it or not. :), but know him very well, I don't think he wants to do it right away, at least not for now.

Tell him I admire him for making the effort at 76! And if he wants to have fun and take classes like a youngster as @Adventine suggested , many are available in your area for free. And Big Big congratulations to your Mom!
