"Recruiting Agency" in Mexico - Scam?

I am a USC petitioning for my husband and stepdaughters, but I'm posting here for a friend of mine (seems like since I've started this process, I am everyone's go-to for immigration questions 😀).

 

He's a franchise owner of a couple restaurants in the U.S., and he has a former employee that now lives in Mexico that he would like to help bring to the U.S. through an employment-based visa (if that's even possible). I believe he's already discussed this with the former employee because my friend received an e-mail from a place called LaborMexy, which seems to be a recruiting agency for companies for workers from Mexico. He wanted to know if the e-mail he got looked legit, and I really don't think it does, but wanted the opinions of all of VJers who are much more knowledgeable than me.

 

The lawyer and company do exist, so maybe the spelling errors are due to a language barrier issue. Still, to my knowledge, employment-based visas are petitioned by the employer in the U.S., NOT by the employee in the foreign country through a lawyer, correct?

 

Also - any insight into what "process their pardons with USCIS" means would be great.

1. Yes, this is done by the employer's attorney, not the other way around. 

2. Hiring driver for employment visas is not gonna fly. We have enough drivers in US. 

3. Crooks nowadays have legit websites. I nearly got duped into one scam. Crooks have upped their game.

i would never give all that business and/or personal info to someone outside the US 

 

and not sure why your friend would not be able to find workers here/  that is one thing he would have to prove 

 

BTW the lawyer to do this type of visa is expensive

“Job visa” without mentioning what type of visa sounds dodgy. The stuff I’ve seen from legit agencies, whether on their website or in letters, usually mentions the visa classification. 
Is it normal in Mexico for lawyers to use a yahoo email address?

I know there is a visa for drivers in the US, but it is a seasonal visa for long distance truck drivers. I cannot for the life of me think how anyone can make a case for a labor shortage for drivers for a restaurant business.

You said he had previously worked for your friend so what visa did he have to do so and why can he not continue on the basis.

Ah gotcha. Honestly, I'm not sure the circumstances that led to him no longer being in the U.S. / no longer working for my friend - that's a good question. I basically just wanted to help him parse out if the email he got was legit, and it looks like it's absolutely not.

It looks like 3rd party agency at some sort. Shady. Don’t like the wording, I won’t give them anything. And there’s no shortage of driver in the states for employment visa IMHO.

 

i know for sure one person  get EB-3 visa in cape cod working in a famous fish place for his employer because it’s seasonal place and hard to get staff but that person worked for years before he even get his green card. Seems like before he got GC he is working using temporary seasonal visa ( not sure the name )

Yeah, the Yahoo email address was a red flag to me, even though I do know lawyers where I live on the border in Mexico that use them. But the bigger red flag was the attempts to sound official while unknowingly sounding way off ("job visa," "process pardons with USCIS," etc.)

Yeah, I agree on the no shortage front. I think a lot of people not super familiar with immigration think that it's fairly easy to bring someone to the U.S. (whether it's as an employee, spouse, etc.), but those of us on here know that it's nowhere close to being easy. I think he's probably unaware of the high bar needed for employment-based visas (or seasonal situations, like you mentioned).

This is fishy and scammy to say the least. 
Just out of curiosity, I googled the “consultoría internacional” and they have only five reviews, three are really nice, one is a one-star saying that they essentially took her money. What’s surprising is that they didn’t even reply to that one. You’d think that, if they are serious about their business, they would try to say something. The other one- star review didn’t have any explanation as to why.
