I met with my fiancé one time before applying for her K-1(currently: NOA 1), before submitting I asked my immigration attorney if I should visit her once more and submit the second trip evidence as well. He said it is not necessary so we went ahead and submitted with only evidence of the first trip.

 

He sounded really sure it was not necessary because the minimum requirement is just meeting once in the past 2 years. He said for any additional trips we can submit the evidence once the application is approved, because at that stage we would be sending USCIS income documents as well?

 

My question is does this actually work? From what I've read USCIS doesn't take additional evidence unless they ask for it, which is fine, but at the interview they will only see one meeting and may not even want to see if you brought evidence from addition meetings.

 

I'm so confused.

Well, your lawyer is right - you only need to show USCIS one meeting in past 2 years. However, when it comes to the consulate stage it depends. Some are difficult and you would want to frontload your initial petition to show more time spent together. It would be helpful if you fill out your profile information so people can provide better answers.

  • Jan 26, 2021 = NOA 1 for I-129F (K1 Visa application)
  • Sep 8, 2021 = NOA 2 for I-129F (K1 Visa application)
  • Nov 16, 2021 =  K1 visa issued in Islamabad, Pakistan
  • Jan 20, 2022 = POE Dallas, Texas
  • Feb 14, 2022 = AOS (I-451, I-131, I765) Filed
  • Feb 20, 2022 = Receipt notice for all three received
  • March 21, 2022 = Biometrics in Dallas, Texas
  • August 9, 2022 = EAD (I-751 approved)
  • August 13, 2022 = EAD and SSN received (SSN applied with EAD)
  • September 6, 2022 = AP (I-131 approved)
  • September 13, 2022 = AP (I-131 receieved) 
  • March 15, 2023 = I-485 approved (interview waived, New SSN received without DHS wording)
  • March 31, 2023 = GC in hand (Total time from NOA-1 to GC in hand 794 days)

Yeah, ideally you should have front loaded your petition. Not an easy consulate and others have reported they don’t even look at the evidence of time spent together brought to the interview. However, don’t despair, just come as prepared as possible.

since my application was received in June (NOA 1) and hasn't been processed, is it possible to submit additional evidence?

So USCIS states that meeting in the past two years is fine. But people who had gone through this will tell you that more you meet the better it is. Especially when it comes to embassies from sub continent. 

 

Now all said, unless there are no red flags like anything that's completely out of the cultural norm for India then don't sweat too much.

 

Second part of your question that if you can send more evidence, we'll if they ask for it then you can but besides that there is not much you can do.

No, not for K1.  

 

The only realistic/reliable way to submit new evidence is to withdraw the current K1 and then submit a new one.  But I would advise against this.

I’m a front loading kind of guy. 
 

USCIS can debunk or nit pick evidence from the one meeting. 
 

Much harder to nit pick 10 meetings. 
 

I forget the number but is was close to ten meetings for us. 
 

The consulate didn’t collect more evidence of meetings since the I-129F

High risk, high fraud consulate.  Could be perceived as a green card marriage.  Not really anything to be done until after the interview, depending on the outcome.   If it is denied, you will have to marry and pursue a CR-1, hopefully with better evidence.

If you try to submit additional evidence now, when your petition hasn't yet been processed, it'll never match up.

 

Should you get an RFE (request for additional evidence) from USCIS, it's a golden opportunity to submit further evidence of a bona fide relationship.  Respond to what USCIS wants; then, underneath that, put a page that says (in big lettering), "Additional Evidence for Mumbai Consulate," and include a good amount of anything else that would convince trained, suspicious strangers of the bona fide nature of your relationship.

 

Warning:  Include NO (zero) chats or e-mails in which you playfully refer to one other as "husband" or "wife."  Some people do this, and it can kill a K-1 visa application by giving the impression that you're married.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think it's okay to wait until the interview stage. They do request that you show additional information since you submitted your application and that's where additional meetings, chat logs, photos, etc will come into play. I know people who only submitted evidence of the one meeting and they are recently married.

You can try to send additional evidence directly to the California service center. I remember one case where it was done and the IO had it on file at the interview. I myself actually did it during AOS and it worked. So chances are not completely zero that it will make its way to your file but they're indeed slim just because there is so much going on and they tend to loose things here and there.

I would give it a try. Adress it to the service center directly and not the lockbox and put as much information about your case in the cover letter ( names, addresses, DoB of both of you and of course your case number ). Nothing to lose than the postage.
