K1 (lgbt) previously married to a male now engaged to another female

I am bisexual and I’m marrying this amazing woman for love, (we’ve known each other for over 10 years but got disconnected then reconnected during my divorce process and fell in love) but I was previously married to once an amazing guy (we had a child, 9 y.o.) and I got my citizenship through him. Would that be a red flag that I was once married to a guy and that I also had another child (now adult)  to a man (we were not married) before I married him.

I’m filing the K1 papers before end of this year. Also, this amazing woman has a pending petition from her parents but that would take years to be current.

I don't see any red flags as long as you and your wife to be weren't in relationship while you were in marital relationship with your ex. Make sure she know your past as it could be asked during the interview.

You should be fine. The only issue would be if you were sponsoring your partner too soon after you entered the States whilst still an LPR. 

USCIS doesn't care if you are sponsoring a man or a woman.

That's not a red flag at all. USCIS is only interested in whether the relationship is genuine. They aren't there to pass moral judgements.

 

When I first met my now wife she was (unhappily) married, and when we started our relationship she was separated from her ex, but still married.  It wasn't a problem with USCIS at all, and I was never asked about it at any point of the immigration process.

 

In our case we had to wait over a year until her divorce was finalized before we could start the k1 (NC law requires at least 1 year separation). I think that tends to add to the evidence of a genuine relationship, it meant we'd had 4 or 5 visits to each other by the time we filed the k1 application. A scammer would probably prefer to find someone who is available to marry immediately and not bother with multiple meetings.

Each case is different. There are couples who are approved with only 4 questions and some approved or denied after asking 40 questions. It's about the totality of the circumstances.

 

My point was related to situations where someone in relationship with someone in their country, gets married with a USC, get GC thru the USC spouse, divorce and then marry their former friend and petition. As long as that's not the case and CO doesn't sense that, of course there will be no problem.

Yes, good point, that would be a consideration in such cases. In the present case OP had stated she has a 9 year old child with their USC spouse, so that scenario isn't applicable here - both the time passed since OP immigrated, plus the fact that they had a child makes it very unlikely USCIS will see any chance of it having been illegitimate in some way.

I don’t think you will run into any issues.  My wife and I (also female) both almost exclusively had relationships to men all through our lives until we became a couple, and she even almost got married to her ex.  We have always openly talked about this, up to and including our AoS interview, and it has never been an issue at all.

If you are thinking..being married to a man and then getting married to a woman is going to be an issue then you dont have to worry at all . Me and my wife ( US citizen) we both were married to a man and we both have  a kid from previous marriage. We met online and fell in love with each other and we got divorced from respective men and my wife ( US citizen) sponsored K1 visa for me. It was approved without any issues and we got married here in US.

Also, State and USCIS, in my personal experience, don’t care if you started a romantic relationship while still married to the USA citizen who petitioned your own green card.  Maybe you or your fiancée will get asked about it.  In your case and in my case, your marriage was irrevocably broken, and the evidence was divorce proceedings.

This is 2021 and thus there will be no issue at all

Wow this was November 2021. I might need to update my timeline.

 

what happened was I decided that 

we have to see each other again because it was past 2 years since the last time we were together. (June 2019 was the last and this was Nov 2021). I did not file.

 

Anyway, fast forward, waited for another year, we met again on December 2022. We celebrated welcoming year 2023 in another country.

 

filed the K-1 March 2023. Latest status is “RECEIVED” By USCIS.
