Hello, 

I was wondering if anyone experienced this before or if anyone can help me figure out what I should do.

My I130 was refused and then they contacted me asking to send the passport in the mail to them as the visa has been accepted. 

I sent the passport in and its been over a week and within this time they updated the case and it is still refused. 

Should I be worried or should I just continue to wait 

 

Sorry, im just freaking out, I have no clue what to expect and want this process to be over sooner than later

Thats what I am confused about, online it says refused and after the interview they gave a paper that said refused. I submitted the extra papers they wanted and was contacted through email from the embassy instructed to send my passport in as the visa is ready. 

However I sent it on the 7 October and the case was updated again on 14 October still saying refused 

 

Not sure what's happening, Ive tried calling, emailing and no response whatsoever.

I-130 is not a visa, is a petition to get a visa. Who asked for your passport? USCIS? EMBASSY? 

And they sent you any email or letter asking you this? Can you attach some print?

Also, where are you from? Which visa are you applying?

sorry I miss worded it, the embassy has contacted me through email instructing me to send my passport to them as my visa is ready 

what I am confused about is that 

online it says refused and after the interview they gave a paper that said refused. I submitted the extra papers they wanted and was contacted through email from the embassy instructed to send my passport in as the visa is ready. 

However I sent it on the 7 October and the case was updated again on 14 October still saying refused. 

 

Im just very confused as what is happening and no one can give me a clear answer

Did you delivered your passport in person or used some service for?

Ok so you were on AP (temporary refusal) then they approved it, it will only change to issued once they have actually printed the visa stamp and put it in the passport. Sometimes things can take days just to get to the right desk inside the consulate. What do you mean “no one can give” a clear answer, are you taking about people at the consulate you asked?

Thank you, I will definitely wait some more, and yes anyone I've spoke to at the embassy has simply either hung up on me or told me that they are not answering questions at the moment and I should call back another day.

Gosh, what embassy is this? If you don’t get answers soon perhaps your petitioner can ask his congressperson to see if they can get answers from the embassy.

Its the one in Serbia, and thank you for the suggestion I will definitely have to have my petitioner ask if nothing happens soon.

online status probably is not updated. if they asked for passport means its possible that visa was granted. it can take a while.  Wait for it until you get passport back.  it has only been a week since you send it.

You were on AP, which is a normal process

Hello amy,

This situation can be nerve wrecking..My Sister in law just went through that..Its a new process they do at the embassies now. Once they print out the visa u will be fine.Good luck.

if your passport get to them just go and take chilled beer and wait for your visa you are good to go think of the flight you will board dont think about the embassy again
