Parents Stuck in USA

My parents are currently on B2 Visa and arrived here in the US last year, there return flight was March 31, 2020 and there stay is good until May 15, 2020 only,  and due to Corona Virus, Pakistan closed international flights on March 20, 2020, Now my parents are stuck, I just filed (I-539 + I-539A paper) to extend there stay here with me so in-case if flights still closed till May 15, there should have there extend visa, Do you think that USCIS worker still working and able to get response before May 15 ?

At the best of times the i539 form to extend status takes 4 months to process. Average this year so far has been 5 months. It will certainly be longer now as you need biometrics done as part of the process and the ASCs are closed. The best you can do is get them “extension pending” status by filing, but it is still overstay (though not unlawful presence) until and unless their applications are approved. if they leave after their authorized stay expires but before a decision is reached make sure they have copies of the application and they keep records of when they departed. They may well face questions about this next time they try visit, and there is a risk that their visas might be cancelled. Hopefully whoever looks at it will be understanding about the circumstances, but there’s no guarantee. 
I agree that enquiring about repatriation flights is the best bet.

I agree that enquiring about repatriation flights is the best bet.

And if you want to try this route make sure they can extend their Travel Insurance, in those times and at their ages super important.

Thankyou all for quick response. I will try to contact embassy for returning flight. Oh definitely I've full medical/travel insurance since the day 1. 

I'm also thinking to apply Online I-539, separately for both, pay separately fees for both. As it might take less time than the paper filing,  not sure.

Contact the Embassy, no one is stuck, because countries have obligations to their citizens.. 

 

its highly unlikely any request for extension of stay will be will be reviewed in time for them to remain in status, you’re now running the risk of overstay, loss of B2 etc without any assurance that the extension will be approved.. 

 

best St bet is for them to check with the embassy about flights home

Timeline

They don't have to go home, they just have to leave the United States by the Time their authorized stay expires. Maybe you have friends or family they can go stay with in another country until they can return to Pakistan. Or they could go stay in another country where a Visa isn't needed. You can easily get 30-60-90 days in another country. This should buy them time to get home.

Flights are due to resume after April 11. Plenty of time to get back to Pakistan.

Thy can remain in US while i-539 pending.  Once they have the decision, if the extension is approved, they can stay  through the expiration date of that new extension.
