My K1 Visa is about to expire and all the courthouses are closed -- What should I do?

That was the information tonight (8:50 pm Central Time), but might be worth checking the page within the next few days for an update to see if you could obtain a marriage license ONLINE from Cook County?

The best bet seems like Cook County online marriage license. 
 

If you cannot get married in time, don’t panic.  
 

Plan B is to

 

* lie low until you do get married. Don’t leave the house. Leaving increased the the however improbable odds of being apprehended for being out of status. 
 

* file an I-130 / I-485 plus the EAD and AP. Once USCIS gets these applications your unattributed stay is forgiven because you are married to a USA citizen and filing on that basis. 

 

* Once you get the NOA1, you are free to Leave the home from an immigration risk perspective (carry copy with you at all times)  Of course the Covid-19 lock down might  still be happening.

Don't muddy the waters.  K-1 entrants must marry first, then file.  Period.

I don’t think you’ve a clue about how the virus is escalating.  Having someone officiate the wedding might not be possible even after the license is obtained.

Tbone has been on this site for an extremely long time and has helped alot of us. Including myself, he knows what he's talking about. In reference to your post. You get married after the 90 days you submit an I-130. Filing for EAD and AP won't work. Your status is based upon the marriage and you need to get married first. 

 

Tbone wasn't being unwelcoming, we do not like misinformation on this site. It can lead to all kinds of confusion, so when it's noticed it is stopped very quickly. It can seem as if people are being harsh, but this is why it is that way on here.

Hi All! New to Visa Journey but have been following this thread. I'm in the same boat with my fiance's K1 90 days expiring April 30th to get married. We live in Indianapolis, Indiana (Marion County) and the clerk's office is closed; no more issuing marriage certificates for foreseeable future. Been e-mailing the clerk's office to see if they can issue via mail or do some emergency route; in limbo. Getting rather nervous now as it's the 30 days remaining and there's no good way forward. I saw the earlier posts that proposed a different course of of action should the 90 days might not be feasible. But I can't help thinking that hundreds of other people may be in the same boat. Might USCICS make an exception to policy in the coming weeks? 

 

Also, what are the acronyms in the other scenario posted if can't get married in 90 days - "file an I-130 / I-485 plus the EAD and AP. Once USCIS gets these applications your unattributed stay is forgiven because you are married to a USA citizen and filing on that basis." Just trying to be clear what these steps mean. Thank you all for your help! Looking forward to monitoring other conversations!

  1. check with nearby counties and states.  You may need to travel to get married. 
  2. EAD = I-765 = Employment Authorization Document
  3. AP = I-131 = Advance Parole

Focus on getting married within the 90 days first. Worry about what happens if that is impossible later. There is a path available if it comes to that.

Hey 

I’m in Arizona and our 90 days end on 9th June so when all this COVID19 started kicking off I said to my fiancé we better get started with our marriage. Although it’s very early stages for us (3 weeks since I’ve arrived) we went and got our marriage license on Monday. These were done by appointment (only since March 23rd appointments were needed) Courts seem to be still open at this stage in Arizona. Although I am getting anxious about the actual marriage. So I’m keeping a close eye on the restrictions that are happening on a day to day basis. My fiancé has people that he knows that are ordained and that can do our marriage on a last minute basis. I know that this wasn’t in our plan, but I’m actually really really grateful that I’m finally here to be with my fiancé! Different options for you include; maybe travelling to a different state for a marriage license and ask around your fiancées friends and family if they know anyone who’s ordained. At this stage I’m thinking about having our marriage out my fiancé’s back garden with an officiate. Best of luck hun! I know these times are so unsure, but rest assured u will get sorted. Don’t lose faith, stay calm and the rest will follow xxx
