Do you know anything about the waiver? What makes someone “eligible”?

Quote

I’ve heard that the Department of State does not grant waivers of the Proclamation.  Is this correct?

This information is incorrect. As specified in the Proclamation, for nationals of countries covered by the Proclamation who are otherwise eligible for a visa and who do not qualify for one of the Proclamation’s exceptions, a consular officers may issue a visa with a waiver on a case-by-case basis, when they determine: that issuance is in the national interest, the applicant poses no national security or public safety threat to the United States, and denial of the visa would cause undue hardship.  There is no separate application for a waiver.  An individual who seeks to travel to the United States should apply for a visa and disclose during the visa interview any information that might demonstrate that he or she is eligible for a waiver.

Do they need a Laywer?

There is no application for a waiver so a laywer couldnt even help. CO will make a case by case determination

That mean you don’t think it wise to wait till a later date for my second wedding anniversary?

Up to you if you want to wait. Based on the proclamation you should be fine

I received my immigrant visa but I haven’t yet entered the United States.  Can I still travel there using my immigrant visa?

The Proclamation provides specifically that no visas issued before the effective date of the Proclamation will be revoked pursuant to the Proclamation, and it does not apply to nationals of affected countries who have valid visas on the date it becomes effective.

Good day everyone!

Please I’m a little bit curious about few things that I’ll like your guys to shed some light on for me—

1. I’ll like to know the implications of PresidentTrump recent expanded travel ban on the issuance of immigrant visas Nigerians and other countries that will lead to permanent residency in the U.S.

2. If you were already issued the immigrant visa before the travel ban comes into effect on Feb 21st, but decides to wait till a later date for your second wedding anniversary (in a bit to get the 10years Green Card) which is around the corner, do you think the immigrant will have problems at POE?

Please I’ll greatly appreciate everyone’s opinions/answers.

Thank you with anticipations.

I would not wait if I were you.

Hello guys. Yours truly is so confused beyond words. After waiting for more than 7 months for my i-129f to be adjudicated, I get hit with this news about Nigeria being added to the list of countries banned from immigrating to the United States. My question is, what happens to all who have fiances and spouses in Nigeria and these other countries? I'm so devastated.

Paul & Mary, thanks. I didn't think anyone could reply me tonight. Its almost 4 a.m and I am unable to sleep.  This is the worst news and not what I anticipated at all. I hope my case is approved and my fiance can travel.

I doubt that. K-1 is non immigrant with the intention of becoming an immigrant. Anyway  I don't want to speculate on anything. I would be positive. Paul & Mary may be right. If not, I hope whatever issues Nigeria has to work on are taken care of, so that the situation is resolved soon. I will keep waiting for a decision to be reached on.my application.

So my husband's interview date is February 10th..our immigration laywer told us that in Nigerian they already do the biometrics ect the day of interview. He said that if everything goes smoothly at his interview and that if he is told he is being aproved that day(even if he does not have visa in hand by February 22nd) that means that he should be exempt from this...does anyone else know or have an opinion on this? His interview being so close. They say 7 to ten buisness days typically for the visa to actual be issued out for him to pick up.

Hello VJ any help is appreciated

I just saw the new Donald Trump's administration immigrant visa ban on NIGERIA  & 4 other African countries today .

My dad who is a US Citizen started filing an IR3 VISA for i & my sister on Feb 22nd 2018  and we've been waiting for our interview date to be scheduled by US Consulate/embassy Nigeria since july 23, 2019 after we got a mail from  NVC that we would be contacted by Nigeria Embassy for Medical test date & Interview date . But since then nothing and now with the new immigration visa ban affecting my country .(NIGERIA)

I WANT TO ASK IS THERE STILL HOPE OF GETTING AN INTERVIEW DATE (WE STARTED FILING THE CASE SINCE 2018 ) DESPITE DONALD TRUMP'S IMMIGRANTS VISA BAN ??

"First, as I said before, it is important to remember that this Proclamation only restricts entry on certain categories of immigrant visas. Family members can still visit their loved ones, businesses can still employ qualified candidates, and other visits can take place on a temporary basis with a non-immigrant visa."

I just observed he used certain categories of immigrant visas and not all categories of immigrant visas. Hopefully fiance(e) and spousal visas won't be affected
