Scared what to do? Please hlep me

I have been reading this forum since I began a K1 visa journey to the United States.

 

I have my AOS interview in one week.

 

My relationship with my husband isnt working well. I dated him two years before living together in Miami, and everything seemed fine,

until I arrived here and we lived together and everything became a nightmare. We have been in counselling since one year ago, but it hasnt worked. 

We fight quite a lot. He was lay off three weeks ago and we have this interview with USCIS which I dont think he wants to attend and obviously without a job I cant be aproved! I am crying right now.

 

Since two weeks ago he has been giving me threats on daily basis. He said he is not suporting me financially anymore etc.

 

I am tired of this and today he told me he wants to divorce. I aslo want to divorce since we are uncompatible at so many levels and I had endured quite a lot of abuse.

 

I had a huge financial lost while coming to the United States. Huge one. I feel I did a huge mistake and I will never trust anyone as I did with this man.

 

I have a ton of debt and I need to work in the United States to pay my debt and move on with my life.

 

What can I do ?

 

I have an EAD and looking for a job right now.

The first question is whether he will attend the interview and not withdraw the Affidavit of Support?

I dont think he will attend the interview. I dont know what he will do honestly.

I cant have a proper conversation with him since it is ending on a big figth always.

I dont think we can end this amicable. Not possible. His character and personality is more asking for revenge and he is an angry person.

Well without his participation you can not adjust or stay in the Country or keep your EAD.

He has to keep the AOS in effect and go to the interview.   Without that you can not get a green card.

If he doesn’t show up to the interview next week, the AOS will be denied.

 

Self-petition would be out, well at least on the surface seems unlikely as nothing you’ve yet said sounds like you would be eligible if just argument/fighting.

First off.....breathe.

I'm sorry to learn that you are going thru this and it is never easy when you don't have your family around for support 😕 

It can all become very overwhelming transitioning from one country to the next and starting a new life. I won't ask you to get into details of how you both met and decided to marry but the signs of his negative behaviour and clashing personality may have been apparent before you two got wed.

Without his support (showing up for the interview AND not withdrawing the I-864), your AOS will be denied. There is no basis to appeal that...your permanent residency (and legal presence) is dependent upon him being a willing participant.

 

The only possible option is via VAWA, although "extreme cruelty" would be necessary. It sounds like an incompatibility here, sorry...not every marriage works out.

I think we need to remember that k1 places significant financial strain onto a couple through the inability to earn an Income. This is one of the massive downsides to the visa. 

 

Many couples argue due to lack of finance, particularly when one sits at home, (immigration or not).. his loss of employment is likely compounding the problem too resulting in more arguments..

 

have you discussed with him how the relationship could potentially improve once you have completed AOS and gotten work approvals?

 

Don’t give up, you both obviously cared enough for each other to go through this entire process, your getting closer to passing a major milestone with AOS.. unfortunately couples fight do to lack money, it’s just one of those evils sometimes.. you’re nearly there, keep at it 🤗🤗

If he doesn't attend the interview you will be denied. If he has no job and no additional sponsor you will be denied. Your EAD is no good if you are denied. I suggest you begin seeking ways to return home.
