B2 Mil passport expired while in US

Looked the boarding issue  up on the net 

it seems that it is airline discretion to allow travelers boarding if direct flight home, as they know most countries allow their nationals in even with expired passports - so if there is no risk on that front it is usually ok 

 

i looked up for brazil specifically and found a few references that say similar to this:

As stated in Timatic, the database used by check-in staff at airports:

Nationals of Brazil are allowed to enter with an expired passport. 

So your expired Brazilian passport is absolutely enough, and if check-in staff doesn't know this, tell them to check Timatic.

so in my opinion the thing for them to do is (1) find direct flights to Brazil that leave before i94 is up (2) call the airlines who do these flights  to confirm they will allow a Brazilian national to board with expired passport (3) book the ticket, swallowing the likely extra cost of last minute flight  [4)fly to Brazil, get new passport, go home to Argentina with new passport and know that B visa is still protected and valid for another visit.

Brazilian authorities only issue emergency passports in circumstances that could not be predicted by the applicant. Sadly, "forgot to check expiration date" does not qualify as a valid reason so OP is indeed subject to regular processing times, with which I am not currently familiar.

 

OP, if you file for extension, please come back to update us when you get a response.

How she can't get an emergency, same day passport is odd. My passport got stolen in Denmark (in a backpack) and I went to the US embassy there, got an appointment for following morning and they said would take them about 6 hours to make me a new one. Luckily the Danish police found my original one but still.

Not everywhere works like the US. My country only issues emergency passports to people who have a residential address in the home country and they take 5 days to issue (normal time for issuance outside the country is 6 months, so yes 5 days is totally a fast emergency issue as far as they are concerned), plus it is also issued only for unavoidable circumstances that have to be detailed and valid for one trip home only. Poster above has already indicated it will be a problem for Brazil.

I recently renewed an expired passport at a Brazilian consulate in the east coast. I could’ve gotten it the same day. I didn’t because I didn’t want to wait more than an hour and the system was having hiccups that particular day.

 

a Brazilian citizen can walk in at the consulate and ask to be seen. That happened on the day I was there.

Well then that solves OP’s problems perfectly and his MIL can leave before i94 expires.

It is an unfortunate situation that this has happened. 

 

All consulates and airlines strongly express the importance of having a valid passport for international (preferably one with atleast 6mths until expiration) to avoid these types of issues. While the officer at the port of entry stamped the passport with a date 6 months after entry, the onus is on the traveler to ensure their passport is valid fort he duration of the stay. 

Is there a reason why your MIL could not get her passport renewed before traveling in Dec 2018?

Doesn't CBP usually issue an i94 for the shorter of 6 months or until passport validity?  I've seen that apply to H1/H4s.

Timeline

Weird embassies can issue an emergency passport same day for limited time to get home. I know it happened to me in Nigeria I had to do it and got a passport that was good for 30 days.

What a nightmare situation. 

 

Definitely do everything possible to get her on a plane home before the i94 expires, for no other reason than to not jeopardize her ability to visit again in the future.

 

The responsibility was on her to have checked expiry dates prior to travel, but that argument is essentially dead based on the current situation.

We did this today in Chicago.  They would not issue a new one without her birth certificate which is in Argentina at her house.  Also they said it takes 5 days to issue one.  No exceptions.  They gave her a one way passport paper and check my response below for an update
