Maybe this "discussion" between these 2 parties can be done in messages because it's turning this thread into a "peeing match". I would unfollow but I am wanting be updated on AOS files for April. Thanks y'all.

@Abbey B does have a 15 day overstay on record, and this will be seen by CBP agents upon re-entry if they choose to travel.

And?

  • For their case: 15<180
  • The TPS part I briefly showed reveals that even with having many years of overstay there is low risk with AP travel.

Of course. No one is debating this. AP travel risk is similar with LPRs, immigrant visa holders, etc. (i.e. very, very, low).

Far from reality.

[Déjà vu]

"Discussion" is over, I apologize for the wall of posts. It's hard not to give in to trolls when it's someone's future at stake.

The "professional knowledge" you are sharing is contrary to USCIS policy. I have given a USCIS source for every single bit of information I have posted. In the thread you linked, nearly all replies to the OP are about how risky it was to do what they did. This entire conversation is long off topic, the question was answered a long time ago: @Abbey B does have a 15 day overstay on record, and this will be seen by CBP agents upon re-entry if they choose to travel. I never said they would be deported, only that they were deportable. Those are facts, and that's all there is to it.

This is easy. https://i94.cbp.dhs.gov/I94/#/compliance-search Check if 15 days shows up on compliance check, if it doesn't this is non issue. If person has AP, there is very little reason to not travel. Yes, admittance with AP and even GC is not guaranteed, and obviously there was a case recently due to Trump's travel ban when GC holders were briefly affected, but everyone needs to evaluate their own risk tolerance.

In about a week or so, assuming you won't get lost in Lockbox Limbo, you should get paper NOA1 for I-485, I-131, and I-765. We got 3 of those but apparently some only get 2, with I-765 and I-131 being combined. A week or so after that you should get NOA for biometrics, that will cover both I-485 and I-765 (should be 2 bard codes on that form) You do not need to do appointment yourself, it will be made for you, and date is printed on that biometric notice. Having said that, some were successful in doing "walk ins" for biometrics before their official appointment date (We did 10 days earlier walkin)

After that, assuming no RFIE/RFE, you enter long wait while your form I-485 and I-765 enter a derby race. I-765 and I-131 are processed at NBC with everyone else, while I-485 processed locally near where you live. For some people it means their I-485 will "win" the race which obsoletes I-765 and I-131. For others, I-485 will lag behind, and those folks will get their EAD card first. Current VJ projected timeline for EAD is about 3-5 months. I-485 is all over the place depending on your local processing center.

Hope this helps.

Thank you so much!!!! I really didnt know how was the process. Youve been very helpful. Wao I live in Vermont haha not too many People hopefullly that means it wont take too long 😅 goood luckkkkk

Thank you @treppenwitz @Dazz for the guidance--and apologies to the group if this blew up. I think both of you have some good points and I want to think that we are okay to travel given the evidence.

Also, thanks @Shiran for sharing the link. It for some reason says travel info is unavailable but maybe I'll check back in it with it.

Congrats to everyone who got their NOA1 & biometrics in this thread... I'm seeing some people did--waiting on ours still as we sent it in on April 30. Being patient.

It's not very consistent, I think. Though ours was within two weeks of NOA1.
