DIAGNOSED WITH BRAIN CA, NEED TO GO SEE HER SON IN ANOTHER COUNTRY WITH EXPIRED GC

I believe many (all?) field offices will want to see an I-90 NoA before they will give an I-551 passport stamp.

I believe you have to show the NOA to get the stamp (ie not at discretion of the field office). I guess that’s to prevent people just getting stamps rather than filing/paying for a new GC.

SOLUTIONS WOULD BE?

 

1. Infopass have her passport stamped?? Coz somebody said its also 1 year extension and travel approval?is that correct?

 

2. N400, so biometrics and interview then oath , then she can go home? How long would that be? Like 6- 12 months?

 

3. Renewal? How long? 

 

All she wants is to see her eldest son before she passes. 

 

Another question..

Eldest is about maybe 35 to 40 years old with kids and wife. He was petitoned when when he turned 21 thats why he's still there. 

 

Is his petition status still active? Of all the 5 siblings, he's the only one left.

True, i told them to just go make an infopass appt. But they said they will try to just drop by tomorrow at the uscis office and have her passport stamped

Most likely, depending on how busy /nice they sure they won't let them in without an appointment letter.

They might refuse until she submits an I-90.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If and it’s a big “if”. I depends on the Embassy/Consulate.

 

There was a case of a Vietnamese mother/daugher the year before that made big headlines, at least in the Vietnamese community. The daughter in that case was in the US, immigrated since 2003. She was suddenly diagnosed with terminal lung cancer and was given only few weeks to live. Her dying wish was to see her mother one last time. They denied the mother’s visa twice. It was all over the Vietnamese news networks both in Vietnam and in the US. The Vietnamese Foreign Ministry and  US Representative Zoe Lofgren of California personally got involved and she called  and wrote a letter to Trump. Eventually the Consulate had to cave under pressure and gave her a visa.

 

I’m just saying, you might have that kind of a flight ahead.

 

P.S: I might add, the daughter in that case became a citizen in 2010 and was eligible to petition her mother but the mother never had any intention to immigrate to the US so she never filed anything.
